AGREEMENT BETWEEN THE GOVERNMENT OF THE KYRGYZ REPUBLIC AND GOVERNMENT OF TURKMENISTAN

About the Intergovernmental Kyrgyz-Turkmen commission on trade and economic, scientific and technical and humanitarian cooperation

The government of the Kyrgyz Republic and the Government of Turkmenistan which further are referred to as with the Parties

for the purpose of further deepening of friendship between two states,

aiming at expansion and strengthening of trade and economic, scientific and technical and humanitarian cooperation on the basis of the principles of international law, equality and mutual advantage, agreed as follows:

Article 1

The parties create the Intergovernmental Kyrgyz-Turkmen commission on trade and economic, scientific and technical and humanitarian cooperation (further referred to as - the Commission).

Article 2

The main objectives of the Commission are:

assistance to development and strengthening of mutually beneficial trade and economic, scientific and technical and humanitarian cooperation between the Kyrgyz Republic and Turkmenistan;

rendering assistance in development and realization of the most perspective directions of development in different spheres of economy of two countries;

the analysis behind the course of implementation of the international treaties signed between two states and also control of accomplishment of the decisions made on commission sessions;

coordination of activities of the ministries, departments and organizations of the states of the Parties for preparation of drafts of bilateral international treaties for the different directions of trade and economic, scientific and technical and humanitarian cooperation and their introduction for consideration of the Parties;

rendering assistance in development and approval of programs of the Kyrgyz-Turkmen economic cooperation, including on attraction rendering assistance in development and approval of programs of the Kyrgyz-Turkmen economic cooperation, including on attraction of the foreign capital and technologies, creation of financial and industrial groups, joint businesses, establishment of direct production connections, and also determination of interaction on their realization;

preparation and carrying out commission sessions.

Article 3

The commission consists of two parts - Kyrgyz and Turkmen. Each Party according to the national legal system appoints the chairman of the corresponding national part of the Commission (further - the cochairman), the responsible secretary and members of the commission.

If necessary the Commission can create permanent or temporary subcommittees and working groups (further - working bodies) in the different directions of bilateral cooperation.

Article 4

Commission sessions and meetings of cochairmen are held as required, but at least once a year serially in the Kyrgyz Republic and Turkmenistan. Terms of holding meetings and meetings are approved but to diplomatic channels no later than two months before date of their carrying out. The agenda of the regular meeting of the Commission is approved previously by the Parties not later than one month before its carrying out. On commission session under mutual approval of cochairmen the questions which are not included in the agenda can be considered.

Emergency meetings of the Commission, meeting of cochairmen, meetings of working bodies are held according to the mutual arrangement of the Parties.

The cochairman of the Commission in the territory of whose state the meeting or meeting is held presides over meeting.

To preparation and participation in commission sessions each Party can involve experts and specialists.

Article 5

Information support of commission sessions, preparation of materials and documents, execution of protocols of meetings, coordination of activities of working bodies, control of implementation of the made decisions, and also other obligations of organizational nature on ensuring work of the Commission are assigned to responsible secretaries of national parts of the Commission.

For accomplishment of the obligations responsible secretaries of the Commission support among themselves working contacts and if necessary hold meetings between commission sessions.

Article 6

The expenses connected with the direction and stay of delegation for participation in commission sessions, meetings of cochairmen of the Commission, meetings of working bodies are financed by means of the sending party.

The expenses connected with carrying out commission sessions, meetings of cochairmen of the Commission, meetings of working bodies are financed by means of the Party in the territory of which state these events are held.

Article 7

Decisions of the Commission are made on the basis of consensus and become effective from signature date of the minutes of the Commission.

Commission sessions and execution of its documents it is conducted in mutually agreed language.

Article 8

Disputes which can arise in case of application or interpretation of provisions of this agreement will be solved by consultations and negotiations between the Parties.

Article 9

By mutual consent of the Parties changes and additions which are drawn up by the separate protocols which are integral part of this agreement can be made to this agreement.

Article 10

This agreement is signed for a period of five years and becomes effective from the date of its signing. Action of this agreement is automatically prolonged for the subsequent five-year periods if any of the Parties does not send to other Party at least in six months prior to expiration of the Agreement the written notice of the intention to stop its action.

It is made in the city of Ashgabat on November 11, 2014 in duplicate, everyone in the Kyrgyz, Turkmen and Russian languages, and all texts have identical legal force.

For the purposes of interpretation of provisions of this agreement the text in Russian is used.
