About approval of the Regulations on appointment and payment of daily benefit for the children placed in the Communal house for the children who are in risk situation

Based on article 9 of the Law on the public assistance No. 547-XV of December 25, 2003 (The official monitor of the Republic of Moldova, 2004, Art. No. 42-44, 249), with subsequent changes and amendments, DECIDES: the Government

1. Approve Regulations on appointment and payment of daily benefit for the children placed in the Communal house for the children who are in risk situation.

2. Expenses on payment of daily benefit for children are performed within the assignments provided in budgets of administrative and territorial units of the second level for the purpose of the organization and functioning of social service "The communal house for the children who are in risk situation" and also at the expense of other means according to the legislation.

3. In case of private suppliers of social services expenses on payment of daily benefits for children are performed at the expense of own means of suppliers.

4. To impose control over the implementation of provisions of this resolution on the Ministry of Labour, Social Protection and Family.

Regulations on appointment and payment of daily benefit for the children placed in the Communal house for the children who are in risk situation

Chapter I. General provisions

1. Requirements of the Regulations on appointment and payment of daily benefit for the children placed in the Communal house for the children who are in risk situation (further – the Provision), extend to social service "The communal house for the children who are in risk situation", created according to the Order of the Government No. 52 of January 17, 2013. "About approval of the Standard regulations on the organization and functioning of social service "Communal house for the children who are in risk situation".

2. For the purpose of this provision the following concepts are used:

1) the Communal house for the children who are in risk situation (further – the Communal house) – specialized social service of temporary placement for development and education in premises of family type of children, temporarily or constantly deprived of the native family circle, and also the children who are in risk situation;

2) daily benefit for the child – the fixed amount of money provided to the child daily for the individual order;

3) beneficiaries of daily benefit are the children placed in the Communal house for the children who are in risk situation which is enlisted in initial, gymnasia, lyceum educational institution;

4) the key worker for the child – one of social teachers of the Communal house appointed his director who bears responsibility for education and support of the child, coordination and monitoring of process of the daily help given him.

3. The daily benefit is provided on the basis of the following principles:

1) respect for the highest interest of the child;

2) nondiscriminations;

3) providing right to informing;

4) providing equal opportunities.

Chapter II. Appointment and allowance payment

4. The benefit is provided to children daily throughout the entire period of their placement in the Communal house.

5. The size of daily benefit is established in the amount of 10 lei a day on one child.

6. At birthdays of children the daily benefit constitutes 100 lei on each child.

7. In holidays: Christmas, New year (on January 1), Easter, the International Children's Day (on June 1) daily benefit constitutes 70 lei on each child.

8. The size of daily benefit provided in Item 5 of this provision annually is reviewed taking into account indicators of growth of consumer prices for the corresponding year.

9. Annual expenses on payment of daily benefit for children are calculated proceeding from the number of the children placed in the Communal house and its size as follows:

From everything – the calculated annual expenses on allowance payment for children;

Nr of children – the number of the children placed in the Communal house;

10 lei – the size of daily child allowance;

100 lei – the size of benefit of the child in day of its birth;

70 lei – the size of benefit of the child in days of official holidays;

Nr of days/year – total quantity of days in year for which provision of benefit, except for the number of days of the official holidays in year listed in Item 7 of this provision, and birthday is planned;

10. For service providers with the status of public organization expenses on payment of daily benefit are performed within the means provided in budgets of administrative and territorial units of the second level and also from other sources according to the current legislation.

11. Service providers with the status of public organization issue the financial resources necessary for payment of daily benefit to children, cash to the director or the responsible person of the Communal house for the children who are in risk situation according to the list, with indication of surname of the child.

12. In case of private suppliers of social services expenses on payment of daily benefit are performed by own financial means.

Chapter III. The issue of daily benefit and support provided to the child in the course of the order by it

13. The director of the Communal house is responsible for planning and issue of daily benefit, and also for the organization and monitoring of the support provided to the child in the course of the order by it.

14. For realization of these tasks the director performs the following obligations:

1) participates in planning in the annual budget of the Communal house of financial resources for payment of daily benefit for the children placed in it;

2) requests monthly from the service provider financial resources for payment of daily benefit to the children placed in it;
