Within realization of Item 5 of Article 35 (1) the Federal Law "About Legal Status of Foreign Citizens in the Russian Federation" Government of the Russian Federation decides:

1. Approve the enclosed Rules of content (stay) in special facilities of the Ministry of Internal Affairs of the Russian Federation or its territorial authority of the foreign citizens and stateless persons who are subject to administrative expulsion out of limits of the Russian Federation in the form of exclusion out of limits of the Russian Federation, deportation or readmission.

2. Recognize invalid acts of the Government of the Russian Federation according to the list according to appendix.

3. This resolution becomes effective since January 1, 2014.

Rules of content (stay) in special facilities of the Ministry of Internal Affairs of the Russian Federation or its territorial authority of the foreign citizens and stateless persons who are subject to administrative expulsion out of limits of the Russian Federation in the form of exclusion out of limits of the Russian Federation, deportation or readmission

I. General provisions

1. These rules determine conditions and procedure for content (stay), including questions of primary medical and sanitary providing (further - content), in special facilities of the Ministry of Internal Affairs of the Russian Federation or its territorial authority (further - special facilities) the foreign citizens and stateless persons which are subject to administrative expulsion out of limits of the Russian Federation in the form of exclusion out of limits of the Russian Federation, deportation or readmission (further - foreign citizens).

2. The foreign citizens containing in special facility shall follow these rules and daily routines of special facility, the check and inside modes established by the head (chief) of special facility (further - detention regime).

The daily routine of special facility is established by the head (chief) of special facility on the basis of the approximate (standard) daily routine of special facilities approved by the Minister of Internal Affairs of the Russian Federation.

3. Foreign citizens contain in special facilities in the conditions excluding possibility of unauthorized leaving of such special facilities by them.

In special facilities the living conditions for the containing foreign citizens meeting the requirements of hygiene, sanitary and fire safety are created.

4. The head (chief) of special facility or its replacement employee (worker) of special facility provides to the foreign citizens containing in special facility, information on their rights and obligations, on procedure and conditions of keeping in special facility, and in case of need provides them with translation service.

II. Procedure for acceptance and content of foreign citizens

5. The special facility performs acceptance and accommodation of the arrived foreign citizens based on the decision of the Minister of Internal Affairs of the Russian Federation (his deputy), or the head (chief) of the relevant territorial authority of the Ministry of Internal Affairs of the Russian Federation (his deputy), or the head of federal executive body in the field of safety (his deputy), or the head of boundary body (his deputy), or based on the judge's ruling.

Information about the foreign citizens who arrived in special facility is registered by the employee (worker) of special facility foreign citizens in special facility, constituted in form according to appendix No. 1.

6. In case of receipt in special facility foreign citizens shall be informed under list of these rules and daily routine of special facility, and are in case of need provided with translation service.

These rules and daily routine of special facility are hung out in rooms of special facility in a visible place.

6(1). At the request of the foreign citizen placed in special facility, territorial authority of the Ministry of Internal Affairs of the Russian Federation on which materials the decision on the placement to special facility is made or territorial authority of the Ministry of Internal Affairs of the Russian Federation at the regional level in the location of special facility in the shortest possible time notifies on the location of the foreign citizen of his relatives, administration in the place of its work or study, the defender, diplomatic representation or consular establishment of the state of its civil accessory.

If the foreign citizen placed in special facility is the exclusive legal representative of the child or incapacitated person which is in the Russian Federation, or the location of other legal representative of the child or incapacitated person is unknown or he is absent in the Russian Federation, territorial authority of the Ministry of Internal Affairs of the Russian Federation on which materials the decision on the placement to special facility is made, or the territorial authority of the Ministry of Internal Affairs of the Russian Federation at the regional level in the location of special facility in the shortest possible time notifies guardianship and custody bodies on the location of such foreign citizen.

Territorial authority of the Ministry of Internal Affairs of the Russian Federation on which materials the decision on the placement to special facility is made or the territorial authority of the Ministry of Internal Affairs of the Russian Federation at the regional level in the location of special facility without fail notifies parents of the minor or other legal representatives on the placement to special facility of the minor.

7. In case of receipt in special facility foreign citizens are subject to personal inspection, fingerprinting and photography.

On each foreign citizen who arrived in special facility the personal record in form according to appendix No. 2, is opened which join the decision specified in Item 5 of these rules, the materials concerning administrative expulsion, deportation or readmission of this foreign citizen, the inventory of the personal belongings and objects which are available for this foreign citizen in case of receipt in special facility, received in transfers and sending or issued by special facility in use.

8. In case of arrival of the foreign citizen in special facility by health workers of the medical organizations subordinated to territorial authorities of federal executive body in the sphere of internal affairs (further - the health worker), conduct survey and medical examination of this person according to Item 18 of these rules.

9. In case of arrival of the foreign citizen in special facility by the employee (worker) of special facility or the employee of territorial authority of the Ministry of Internal Affairs of the Russian Federation make in the presence of this foreign citizen examination of the things which are in case of it.

10. Documents, valuable things and money the foreign citizen who arrived in special facility and containing in is mute, has the right to transfer to storage of administration of special facility.

In the presence at the foreign citizen who arrived in special facility, phone of cellular communication it is given to storage of administration of special facility. These foreign citizens are allowed to use phones of cellular communication belonging to them in time established by daily routine of special facility.

Other things, except for medicines for medical application which procedure for transfer is stipulated in Item 37 these rules according to the inventory are given on safe custody on warehouse where are stored in separate cell.

Responsibility for the checked documents, things, including valuable things, and money is born by the head (chief) of special facility.

III. Requirements to content of foreign citizens in special facilities

11. Foreign citizens contain in special facilities in rooms which regulation of the sanitary area constitutes at least 6 sq.m on 1 person, in case of installation of 2-level beds - 4,5 of sq.m on 1 person suffices. The room for placement of family has the area at least 15 sq.m.

In rooms foreign citizens are provided with individual berth and bedding (mattress, pillow and blanket).

12. The special facility separately contains:

a) males and female, except as specified, stipulated in Item 14 these rules;

b) persons having signs of infectious disease which are isolated to specially equipped rooms (infectious insulators) until their placement to the specialized medical organizations providing medical care by the patient with infectious diseases in stationary conditions.

13. The foreign citizens who arrived and containing in special facilities with signs of mental disease are isolated from people around to certain premises of special facility to the direction them in the medical organization.

14. Jointly the certain premises of special facility can contain only the spouse, the spouse, parents, children, adoptive parents adopted brothers, sisters, the grandfather, the grandmother, grandsons of the foreign citizen.

15. The foreign citizens containing in special facilities are provided with food on regulations according to appendices No. 3 and No. 3(1).

The minor foreign citizens and stateless persons containing in special facilities together with parents or other full age close relatives - foreign citizens (further - minor foreign citizens), are provided with food on regulation according to appendix No. 4.

Under catering services of foreign citizens on regulations according to appendices No. 3, No. 3(1) and No. 4 products are allowed to be replaced with other products and to make the return replacement on regulation according to appendix No. 4(1).

In cases if provision 3, No. 3(1) and No. 4 is impossible for foreign citizens of hot food on regulations according to appendices No., they are provided with food on regulation according to appendix No. 4(2).

16. Material and household providing the foreign citizens containing in special facilities is performed on regulation according to appendix No. 5.

17. During heating season temperature not below 18 degrees Celsius is maintained in premises of special facilities.

IV. The organization of primary medical and sanitary providing and providing with medicines for medical application of the foreign citizens containing in special facilities

18. The foreign citizens arriving in special facility are subject to poll and medical inspection (including thermometry, survey of integuments, pharynx, survey on pediculosis) which are performed by the health worker for the purpose of identification of foreign citizens with suspicion of the infectious diseases constituting danger to people around, and the patients having indications for hospitalization.

19. The foreign citizens containing in special facilities within 3 working days from the date of receipt in special facility are subject to routine medical examination on tuberculosis.

Routine medical examinations for the purpose of detection of other infectious and parasitic diseases are carried out to destination the health worker in the presence of medical indications.

20. Delivery of health care to the foreign citizens containing in special facilities is performed according to the Rules of delivery of health care to foreign citizens in the territory of the Russian Federation approved by the order of the Government of the Russian Federation of March 6, 2013 No. 186 "About approval of Rules of delivery of health care to foreign citizens in the territory of the Russian Federation".

21. To the foreign citizens who are containing in special facilities and not needing hospitalization, primary health care is provided in special facility in out-patient conditions.

22. Health workers perform:

a) identification of patients with suspicion of infectious, parasitic, mental and other diseases in case of arrival of foreign citizens in special facility, and also during daily bypasses and in case of requests of specified persons for medical care;

b) organization and rendering primary health care;

c) the organization of consultations of specialists doctors of the medical organizations by the patient needing rendering specialized medical care;

d) the organization of hospitalization of the patients needing treatment in stationary conditions;

e) ensuring accomplishment by foreign citizens of recommendations and appointments of specialists doctors;

e) calculation of need for medicines, disinfectants and medical products, timely submission of the corresponding requests about their replenishment (acquisition) and observance of rules of their storage;

g) ensuring compliance with the legislation of the Russian Federation in the field of ensuring sanitary and epidemiologic wellbeing of the population (further - the sanitary legislation) in case of content, catering services, water supply, bath-and-laundry providing, sanitary processing of foreign citizens;

h) organization and carrying out sanitary and anti-epidemic (preventive), including disinfection, actions;

i) sanitary and educational work among foreign citizens;

j) the direction in the body exercising federal state sanitary and epidemiological surveillance for the location of special facility of information on identification of persons sick with infectious or parasitic diseases or with suspicion of these diseases;
