Rules of forming, maintaining and use of basic state information resource of registration accounting of citizens of the Russian Federation in the place of stay and at the place of residence within the Russian Federation

1. These rules determine procedure for forming, maintaining and use of basic state information resource of registration accounting of citizens of the Russian Federation by the place of stay and at the place of residence within the Russian Federation (further - the database).

2. Creation and maintaining the database is performed by the Ministry of Internal Affairs of the Russian Federation (further - the operator). The operator has the right to choose independently applied information and telecommunication technologies, program and technical means used for creation of the database and ensuring its functioning. For the purpose of ensuring access to the database the operator shall follow the production requirements accepted within functioning of single system of interdepartmental electronic interaction.

The database is kept federal state information system, in electronic form with use. Maintaining the database on papers is not allowed.

3. Information provided by part 11 of article 3 of the Law of the Russian Federation "About the right of citizens of the Russian Federation to freedom of travel, the choice of the place of stay and residence within the Russian Federation" is subject to inclusion in the database (further - information).

4. Collection, record, systematization, accumulating, storage, refining (updating, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking of information in the database is performed in accordance with the legislation of the Russian Federation about information, information technologies and on information security and the legislation of the Russian Federation in the field of personal data.

5. The database joins information arriving from territorial authorities of the Ministry of Internal Affairs of the Russian Federation and their structural divisions, administrations of the organizations performing registration and removal of the citizen of the Russian Federation from registration accounting in the place of stay in hotel, sanatorium, rest house, boarding house, camping on tourist center in the medical organization or other similar organization, the organization of criminal executive system performing custodial sanction or forced labor (further - the supplier of information), and also from citizens of the Russian Federation, federal executive bodies, executive bodies of the government of subjects of the Russian Federation and other authorities, local government bodies.

6. The database joins information arriving in shape:

the electronic documents signed by the authorized officer of the supplier of information with use of the strengthened qualified digital signature;

documents on papers which in case of receipt are transferred to electronic type and are signed by person making transfer in electronic document type from papers with use of the strengthened qualified digital signature.

7. Information is subject to transfer of information by the supplier in the database in time, not exceeding 1 day from the date of obtaining by such supplier of the specified information.

Information which arrived from suppliers of information is placed the operator in the database within 1 working day from the date of its receipt.

8. Information exchange of the Ministry of Internal Affairs of the Russian Federation and its territorial authorities with administrations of hotels, sanatoria, rest houses, boarding houses, campings, tourist bases, the medical organizations or other similar organizations, the organizations of criminal executive system performing custodial sanction or forced labor by provision of information is direct or in case of the direction of information with use of the means of communication which are part of network of telecommunication or with use of information and telecommunication networks, and also the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services and execution of the state and municipal functions electronically is performed based on agreements on interaction which standard form is established by the Ministry of Internal Affairs of the Russian Federation.

9. Information containing in the database is provided based on the requests sent in electronic form and (or) on papers. Information is provided to physical persons and legal entities in cases and according to the procedure which are established by the legislation of the Russian Federation.

Information is also provided to public authorities of the Russian Federation and local government bodies in cases, when necessary for implementation of the powers by them, including for provision of the state and municipal services and execution of the state and municipal functions by them.

Citizens have the right to acquaintance with information on themselves containing in the database to protection of such information and to correction of the mistakes containing in it, including with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)".

The owner of premises has the right to obtain the address reference information containing in the database about persons registered in the place of stay and (or) at the place of residence in the premises belonging to it on the property right without their consent in the amount provided by paragraphs the second, third and fifth (regarding data on registration date at the place of residence (the place of stay) of part eleven of article 3 of the Law of the Russian Federation "About the right of citizens of the Russian Federation to freedom of travel, the choice of the place of stay and residence within the Russian Federation", including with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)".

Provision of information containing in the database to physical persons and legal entities is performed by the Ministry of Internal Affairs of the Russian Federation and its territorial authorities.
