About approval of the Regulations on ensuring access to public information in the Ministry of Education and Science of Ukraine

According to article 14 of the Law of Ukraine "About access to public information", to the Presidential decree of Ukraine of May 5, 2011 No. 547 "Questions of ensuring with executive bodies of access to public information" and to the proper organization of access to public information which manager is the Ministry of Education and Science Ukraine, I order:

1. Approve Regulations on ensuring access to public information in the Ministry of Education and Science of Ukraine which is applied.

2. Declare invalid the order of the Ministry of Education and Science, youth and sport of Ukraine of July 30, 2012 No. 845 "About approval of the Regulations on ensuring access to public information in the Ministry of Education and Science, youth and sport of Ukraine", registered in the Ministry of Justice of Ukraine on August 17, 2012 in case of No. 1392/21704.

3. To management on public relations and ensuring activities of the Minister (foster service) (Zagoruyko Yu. A.):

provide submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine;

make mark for archive.

4. To impose control over the implementation of this order on the deputy minister - the chief of staff Dnieper Ampere-second.

5. This order becomes effective from the date of its official publication.

Regulations on ensuring access to public information in the Ministry of Education and Science of Ukraine

I. General provisions

1. This Provision determines procedure for access to public information to MON.

2. In this Provision terms are used in the following values:

request for information - request of person or group of persons in oral, written or other form to provide the public information which is in ownership of MON;

the asking information - physical, legal entities, associations of citizens without the status of the legal entity, except subjects of powers of authority;

public information - information displayed and documented by all means and on any carriers which was received or created in the course of accomplishment of MON of the obligations provided by the current legislation or which is in ownership of MON

3. Legal regulation of the relations connected with ensuring access to public information is performed according to the Laws of Ukraine "About access to public information", "About information", "About the state secret" and other regulatory legal acts on these questions.

4. Action of this provision does not extend to the relations connected with receipt of public information of MON when implementing of the functions by it and also to the relations arising in the field of addresses of citizens which are regulated by the Law of Ukraine "About addresses of citizens".

5. Direct, coordinate and control work of structural divisions on provision of access to public information of the deputy minister of science and education of Ukraine according to functional distribution of obligations.

6. Observance of established procedure of provision of public information (accounting, the analysis, systematization, maintaining the electronic register) and control on satisfaction of requests for information, determination of special places for work of asking will organize the responsible official of structural division to which competence are carried systematization, the analysis and control of requests for information.

7. Heads of independent structural divisions of MON which possess the queried information and are determined by the resolution of management, provide accomplishment and provision of public information on request for information.

II. Ensuring access to public information

1. Access to public information to MON is provided in the way:

1) systematic and operational promulgation of information:

in official printing publications;

on the official site of MON;

at information stands;

by any other method;

2) provisions of information on request for information.

2. Publication and placement on the official site of the Ministry of the public information prepared and provided by structural divisions of MON taking into account requirements of the Law of Ukraine "About access to public information" are provided with structural division to which competence interaction with mass media and public relations is referred.

3. To placement on the official site of MON are subject for publication with indication of dates of the document and date of updating of information:

regulatory legal acts, acts of individual action (except intra organizational) adopted by MON, drafts of the decisions which are subject to discussion, information on the normative legal basis of activities;

list and conditions of receipt of services MON, forms and samples of documents, rules of their filling;

procedure for creation, giving of request for information, appeals of decisions of MON, actions or failure to act;

information on system of accounting, types of information which is stored by MON;

information on mechanisms or procedures by means of which the public can represent the interests or otherwise influences realization of powers of MON;

plans of carrying out and agenda of the open sessions;

arrangement of places where are provided necessary requesting forms and forms of organization;

general rules of work of MON, employment policies and procedures;

reports, including on satisfaction of requests for information;

information on activities of subjects of powers of authority, namely about:

their location, postal address, numbers of means of communication, addresses of the official site and e-mail;
