Chapter 1. General provisions

Article 1. Subject of regulation of this Federal Law

This Federal Law governs the relations arising between the subjects performing activities in the field of the industry, the organizations which are part of infrastructure of support to the specified activities, public authorities of the Russian Federation, public authorities of subjects of the Russian Federation, local government bodies during the forming and realization of industrial policy in the Russian Federation.

Article 2. Legal regulation in the field of industrial policy

1. Legal regulation in the field of industrial policy is based on the Constitution of the Russian Federation, the Federal constitutional Laws and is performed according to this Federal Law, other Federal Laws adopted according to it, the Federal Laws governing the relations in the field of industrial policy in separate industries of economy, other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation governing the relations in the field of industrial policy.

2. This Federal Law is not applied to the relations connected with production of alcohol-containing food products, alcoholic products and tobacco products manufacture.

Article 3. The basic concepts used in this Federal Law

For the purposes of this Federal Law the following basic concepts are used:

1) industrial policy - complex of the legal, economic, organizational and other measures aimed at the development of industrial capacity of the Russian Federation, ensuring production of competitive industrial output;

2) industrial production (industry) - the set of the types of economic activity relating to mining, the processing production, ensuring with electrical energy, gas and vapor, air conditioning, water supply, water disposal, the organization of collection and waste recycling, and also liquidation of pollution determined based on the All-Russian Classifier of Economic Activities;

3) subjects of activities in the field of the industry - the legal entities, individual entrepreneurs performing activities in the field of the industry in the territory of the Russian Federation on the continental shelf of the Russian Federation, in exclusive economic zone of the Russian Federation;

4) measures of stimulation of activities in the field of the industry - actions of legal, economic and organizational nature which are performed by public authorities, local government bodies, the organizations which are part of infrastructure of support of activities in the field of the industry and are directed to goal achievement of industrial policy;

5) industry - set of the subjects performing activities in the field of the industry within one or several classification groups of one or several types of economic activity according to the All-Russian Classifier of Economic Activities;

6) industrial output - the goods made as a result of implementation of activities in the field of the industry;

7) the industrial output which does not have the analogs made in the Russian Federation, - the industrial output which answers criteria, stipulated in Item 2 parts 1 of article 6 of this Federal Law, and cannot be replaced with the products made in the territory of the Russian Federation and having the similar technical and operational characteristics allowing it to perform the same functions and to be commercially interchangeable;

8) industrial infrastructure - set of the real estate units, objects of transport infrastructure and utility infrastructure necessary for implementation of activities in the field of the industry;

9) infrastructure of support of activities in the field of the industry - the commercial organizations and non-profit organizations performing measures of stimulation of activities in the field of the industry;

10) development of production of industrial output - the actions providing training of subjects of activities in the field of the industry to release of the industrial output which is earlier not made by them or essential increase in quantity of earlier made industrial output and the including preparations for commissioning of fixed assets and their commissioning, development and working off of engineering procedures, mastering practical skills of production of industrial output;

11) the state information system of the industry - the federal state information system containing information on condition of industries and the forecast of their development;

12) the industrial (industrial) park - set of the objects of industrial infrastructure intended for creation of industrial production or upgrade of industrial production and managed by managing company - the commercial or non-profit organization created in accordance with the legislation of the Russian Federation;

13) industrial cluster - set of the subjects of activities in the field of the industry connected by the relations in the specified sphere owing to proximity and functional dependence and placed in the territory of one subject of the Russian Federation or in the territories of several subjects of the Russian Federation;

14) the engineering center - the legal entity rendering engineering and consulting services in preparation of production process and sales of products (works, services), preparation of construction and operation of industrial, infrastructure and other facilities, preproject and project services;

15) authorized body - the federal executive body determined by the Government of the Russian Federation in the field of industrial policy;

16) the integrated structure of defense industry complex - consolidation of the legal entities conducting joint activities which is not legal entity is created according to decisions of the President of the Russian Federation or the Government of the Russian Federation and in which one legal entity has opportunity to determine the decisions made by other legal entities;

17) parent organization of the integrated structure of defense industry complex - the legal entity who is included into the integrated structure of defense industry complex and has opportunity to determine the decisions made by other legal entities;

18) technology infrastructure - set of the real estate units and the equipment necessary for implementation of scientific and technical activities or innovative activities;

19) industrial technopark - the objects of industrial infrastructure and technology infrastructure intended for implementation by subjects of activities in the field of the industry of industrial production, and (or) scientific and technical activities, and (or) innovative activities for the purpose of development of production of industrial output and commercialization of the received scientific and technical results and managed by managing company - the commercial or non-profit organization created in accordance with the legislation of the Russian Federation;

20) technology - set of the results of intellectual activities expressed in objective form which can form technology basis for production of industrial output of certain type and includes in this or that combination of the invention, useful models, industrial designs, programs for electronic computers or other results of intellectual activities which are subject to legal protection according to the Section VII of the Civil code of the Russian Federation and the results of intellectual activities which are not subject to legal protection according to the Section VII of the Civil code of the Russian Federation including specifications and other information;

21) single engineering procedure - set scientifically and almost reasonable production and technology operations necessary for production of one or at the same time several types of industrial output determined based on the All-Russian Product Classifier by types of economic activity;

22) technopark in the field of high technologies - set of objects of technology infrastructure, transport infrastructure and utility infrastructure, buildings, structures, the constructions intended for implementation by legal entities, individual entrepreneurs of scientific and technical activities, and (or) innovative activities, and (or) activities in the field of information technologies for the purpose of ensuring production of industrial output and (or) removal on the market of the new products, technologies and (or) services and managed by managing company - the commercial or non-profit organization created in accordance with the legislation of the Russian Federation;

23) congress and (or) exhibition action - the event held by the legal entity or the individual entrepreneur for whom congress and (or) exhibition activities are determined as core activity or one of additional types of activity, at the scheduled time in specially prepared territories and (or) capital construction projects and in non-capital structures, constructions for the purpose of knowledge sharing and experience between representatives of the countries, industries of economy, professions or the organizations, demonstrations and distribution of goods (works, services) and (or) information on them, search of the necessary directions of development in the field of the industry and cross-industry interaction.

Article 4. Purposes, tasks and principles of industrial policy

1. The purposes of industrial policy are:

1) forming of the high-technology, competitive industry providing transition of economy of the state from export and raw type of development to innovative type of development;

2) ensuring defense of the country and safety of the state;

3) employment of the population and increase in level of living of citizens of the Russian Federation.

2. Tasks of industrial policy are:

1) creation and development of modern industrial infrastructure, infrastructure of support of activities in the field of the industry, answering the purpose and tasks determined by documents of strategic planning at the federal level;

2) creation of competitive conditions of implementation of activities in the field of the industry in comparison with conditions of implementation of the specified activities in the territories of foreign states;

3) stimulation of subjects of activities in the field of the industry to perform implementation of results of intellectual activities and development of production of innovative industrial output;

4) stimulation of subjects of activities in the field of the industry rationally and effectively to use material, financial, labor and natural resources, to provide work performance improvement, implementation of import-substituting, resource-saving and ecologically safe technologies;

5) increase in production with high share of value added and support of export of such products;

6) support of technology rearmament of subjects of activities in the field of the industry, upgrade of the fixed business assets proceeding from the rates advancing their aging;

7) decrease in risk of emergency situations of technogenic nature on objects of industrial infrastructure;

8) ensuring technology independence of national economy.

3. The basic principles of industrial policy are:

1) program and target method of forming of documents of strategic planning in the field of the industry;

2) measurability is more whole than development of the industry and implementation of measures of stimulation of subjects of activities in the field of the industry;

3) monitoring of efficiency of industrial policy and control of its realization;

4) application of measures of stimulation of activities in the field of the industry for achievement of the measures and indicators established by documents of strategic planning;

5) coordination of the measures of stimulation of activities in the field of the industry performed by public authorities of the Russian Federation, public authorities of subjects of the Russian Federation, local government bodies;
