About approval of the Technique of annual assessment of activities of administrative government employees of the case "B" of bodies, departments and organizations of prosecutor's office of the Republic of Kazakhstan

According to Item 27 of Rules of carrying out annual assessment of activities and certification of the administrative government employees approved by the Presidential decree of the Republic of Kazakhstan of January 21, 2000 No. 327, Item 2 of the Standard technique of annual assessment of the activities of administrative government employees of the case "B" approved by the order of the acting as the Chairman of the Agency of the Republic of Kazakhstan for public service of June 5, 2014 No. 04-2-4/93 and being guided by the subitem 4) of article 11 of the Law of the Republic of Kazakhstan "About Prosecutor's office", PRIKAZYVAYU:

1. Approve the enclosed Technique of annual assessment of activities of administrative government employees of the case "B" of bodies, departments and organizations of prosecutor's office of the Republic of Kazakhstan.

2. To the head of the department of personnel work to take measures to state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.

3. To inform all staff of bodies, departments and organizations of prosecutor's office of the Republic of Kazakhstan of this order.

4. To impose control of execution of this order on Department of personnel work of the Prosecutor General's Office of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Technique of annual assessment of activities of administrative government employees of the case "B" of bodies, departments and organizations of prosecutor's office of the Republic of Kazakhstan

1. General provisions

1. This Technique of annual assessment of activities of administrative government employees of the case "B" of bodies, departments and organizations of bodies of prosecutor's office of the Republic of Kazakhstan (further - the Technique) is developed in implementation of the Presidential decree of the Republic of Kazakhstan of January 21, 2000 No. 327 "About approval of Rules of carrying out annual assessment of activities and certification of administrative government employees" and determines methods of annual assessment of activities of administrative government employees of bodies, departments and organizations of prosecutor's office of the Republic of Kazakhstan (further - employees).

2. Annual assessment of activities of employees (further - assessment) is carried out for determination of efficiency and quality of their work.

3. Assessment is carried out after every year of stay in public service, no later than three months from the date of its approach, but not earlier than six months from the date of the occupation of this position.

4. Assessment of the employee develops from:

1) estimates of the direct head of the employee;

2) circular assessment (assessment of subordinates or employee's colleagues);

3) final assessment of the employee.

The direct head of the employee is person to whom he submits according to the job description.

5. By results of assessment offers on remedial action in activities of employees are developed, the directions them activities requiring improvement are determined offers on career promotion and training of employees are developed.

6. Obtaining serving estimates "effectively" within three years forms the basis for increase it in position.

7. Receipt of two estimates by the employee "unsatisfactorily" within the last three years is the basis for carrying out certification.

In case of decision making about carrying out certification results of assessment which were the basis for carrying out the previous certification are not considered.

8. Final assessment of the employee affirms the permanent Commission on assessment (further - the Commission) which is created by person having the right of appointment to positions and releases from positions of employees.

9. The commission consists at least, than of three members, including the chairman.

10. Results of vote are determined by a majority vote members of the commission. In case of equality of votes the voice of the commission chairman is decisive.

Chairmen of the commissions are:

in the Prosecutor General's Office - the chief of staff of the Attorney-General;

in bodies, department and organization of prosecutor's office - one of deputy corresponding authorized heads of body, department or organization of prosecutor's office.

The secretary of the Commission is the employee of division of personnel work of the Prosecutor General's Office, body, department or organization of prosecutor's office of the Republic of Kazakhstan (further - divisions of personnel work). The secretary of the Commission does not take part in vote.

If the direct head of the employee concerning whom assessment is carried out is part of the Commission, and also the employees specified in the subitem 2) of item 4 of this Technique they do not take part in vote and decision making on this employee.

2. Preparation for evaluating

11. Divisions of personnel work are created by the schedule of evaluating in coordination with the commission chairman.

The division of personnel work notifies the employee who is subject to assessment and also persons specified in subitems 1) and 2) of item 4 of this Technique on evaluating and sends them estimative sheets for filling no later than one month before its carrying out.

3. Assessment of the direct head

12. The direct head fills in the estimative sheet in form according to appendix 1 to this Technique within three working days from the date of its obtaining from division of personnel work, informs the employee of the completed estimative sheet and sends the completed estimative leaf to personnel division within two working days.

Acquaintance of the employee with the completed estimative leaf is performed in written or electronic form.

The refusal of the employee of acquaintance cannot serve as obstacle for the direction of documents for commission session. In this case the employee of division of personnel work and the direct head of the employee in any form draw up the statement of refusal of acquaintance.
