About approval of the Regulations on the General armorial of the Republic of Moldova

(as amended of the Presidential decree of the Republic of Moldova of 26.10.2015 No. 1793)

Based on Item j) article 88 of the Constitution of the Republic of Moldova and part (article 10 of the Law on public symbols the President of the Republic of Moldova DECIDES: 5)

Approve Regulations on the General armorial of the Republic of Moldova which are component of this decree.

Regulations on the General armorial of the Republic of Moldova

Chapter I. General provisions

1. This provision is developed according to the Law on public symbols and establishes procedure for maintaining the General armorial of the Republic of Moldova.

2. In this provision concepts, the stipulated in Article 3 Laws on public symbols, and also the following concepts are used:

General armorial of the Republic of Moldova (further – the General armorial) – the state register containing documentary information on the name of public symbol, the owner of symbol, identification number and date of its registration; about the document based on which registration was performed changes are made or removal of public symbol from the address is performed; about standards of official descriptions and standards of color drawings of public visual symbols, verses and musical scores of public sound symbols;

state registration of public symbol – the action directed to entering into the General armorial of the data confirming the fact of organization, change or removal from the address of public symbol;

storage – accumulating of data on public symbol on any carriers;

accounting case of public symbols (further accounting case) – set of the documents relating to development, coordination, organization, registration, use, change and removal from the address of the public symbols belonging to one owner and grouped in separate archival unit;

the diploma about registration of public symbol in the General armorial – the official solemn document issued in the procedure established by this provision, confirming state registration of public symbol in the General armorial and exclusive right of the owner on it;

the statement about registration of public symbol from the General armorial – the act issued in the procedure established by this provision and reproducing part of the data on registration of public symbol included in the General armorial;

the statement – the act issued and certified in the procedure established by this provision, reproducing part of the original of the stating document or other document from accounting case and concerning any problem, the fact or person;

the copy – the act issued and certified in the procedure established by this provision, which is precisely reproducing contents of the original of the stating document or other document from accounting case.

3. The general armorial is the single official source of information on the registered public symbols and component of the state information resources of the Republic of Moldova.

4. Owner of the General armorial is the state, the owner – the Office of the President of the Republic of Moldova, and the holder – heraldry Office as a part of the Office of the President of the Republic of Moldova.

5. The national commission on heraldry renders assistance to maintaining the General armorial.

6. Ensuring functioning of the General armorial is performed for the account and within the financial resources allocated to the Office of the President of the Republic of Moldova.

Chapter II. Structure of the General armorial

7. The general armorial consists of the following Sections and parts:

Section "Heraldry" (heraldic, veksillologichesky, sfragistichesky, gimnovy signs, etc.):

part "National heraldry";

part "Territorial heraldry";

part "Corporate heraldry";

part "Private heraldry";

part "The international heraldry".

Section "Faleristika" (distinctions):

part "National faleristika";

part "Territorial faleristika";

part "Corporate faleristika";

part "Private faleristika";

part "The international faleristika".

Section "Uniformistika" (uniformistsky signs and signs of distinction):

part "National uniformistika";

part "Territorial uniformistika";

part "Corporate uniformistika";

part "Private uniformistika";

part "The international uniformistika".

8. Depending on heraldic tradition, quantity of signs and other criteria each part can be divided into subparts, including for the signs withdrawn from circulation.

Chapter III. Maintaining the General armorial

9. The general armorial is conducted according to the legislation on registers, other regulations in this area and this provision.

10. The general armorial is conducted on paper (manual form) and electronically in state language.

11. Maintaining the General armorial is on paper performed by entering into appropriate sections and parts of data on public symbols and filing of sheets with standards of official descriptions and standards of color drawings of public visual symbols or with verses and musical scores of public sound symbols.

12. Maintaining the General armorial is electronically performed by creation of the specialized automated information system.

13. Maintaining the General armorial on paper and electronically shall provide protection against non-authorized access to information containing in it.

14. If between data of the General armorial on paper and this electronically there are discrepancies, data on paper are recognized reliable.

Chapter IV. Procedure for coordination, registration, removal from address and protection of public symbols

Part 1. Coordination of projects of public symbols

15. For review the project of public symbol the applicant submits to the National commission on heraldry (further – the Commission) the statement for coordination and registration of public symbol and depending on its category – the documents provided by appendix 1.

16. Documents for review and registration of public symbol are constituted according to rules of clerical work (on white paper format A 4, on one party of leaf, in case of strict observance of fields for filing of the document in case and for information security) in three identical copies which are unpacked and electronically.
