Based on the Law No. 161 of July 22, 2011 on implementation of single window in implementation of business activity (The official monitor of the Republic of Moldova, 2011, Art. No. 170-175, 496) and for the purpose of implementation of single window on development of technical assessment in construction and for issue of the certificate on professional certification of specialists in construction DECIDES: the Government

1. Approve:

Regulations on the organization and functioning of single window on development of technical assessment in construction according to appendix No. 1;

Regulations on the organization and functioning of single window for issue of the certificate on professional certification of specialists in construction according to appendix No. 2.

2. Recognize invalid some orders of the Government according to appendix No. 3.

3. Appoint the Ministry of Economy and Infrastructure responsible for creation and implementation of single window for development of technical assessment in construction and for issue of the certificate on professional certification of specialists in construction.

4. To impose control over the implementation of this Resolution on the Ministry of Economy and Infrastructure.

5. This Resolution becomes effective on January 2, 2015.

Regulations on the organization and functioning of single window on development of technical assessment in construction

I. General provisions

1. The regulations on the organization and functioning of single window on development of technical assessment in construction (further – the Provision) are developed for the purpose of implementation of single window on development and approval of the technical assessment in construction provided by the Law of the Republic of Moldova No. 721-XIII of February 2, 1996 about quality in construction.

2. In Items 3, of 5, of 28, of 29, of 30, of 38, of 42, of 54, of 55, 60-63, 75 and 77 of this provision Articles 1, of 2, of 15, of 19, of 20, of 21, of 22, of 24, of 26, of 29, 30 and 64 Regulations (EU) No. 305/2011 of the European Parliament and Council of March 9, 2011 about establishment of some agreed terms for trade in products for construction and about cancellation of the Directive of Council 89/106/CEE were partially shifted.

3. This Provision establishes delivery conditions on the market or for placement in the market of products for construction, determining the agreed terms concerning method of expression of efficiency of products for construction concerning its main characteristics.

4. This Provision is applied to all economic operators who make, deliver or sell the new domestic or imported products, and also to investors, designers, contractors, owners, users of buildings for which use of the corresponding products is provided.

II. Terminology

5. For the purpose of this provision the following terms are determined as follows:

1) the technical conclusion – the document on favorable technical conclusions of Permanent technical Council on construction on check of compliance of developed technical assessment to provisions of the procedure for technical assessment in construction;

2) the main characteristics – product characteristics for construction which concern the fundamental requirements imposed to construction;

3) class – the range divided by one minimum and one peak value of levels of efficiency of products for construction;

4) the distributor - any physical person or legal entity in supply chain, except the producer or the importer which sells products for construction;

5) the document by assessment – the document accepted by the organization of bodies for technical assessment for creation of technical assessments;

6) technical assessment – documentary efficiency evaluation of products for construction concerning its main characteristics according to the relevant document by assessment;

7) the producer – any physical person or legal entity which makes products for construction or has designing or production of such products and sells the corresponding products under the name or under the trademark;

8) the importer – any physical person or legal entity which enters on the market products for construction from the third country;

9) level – the result of efficiency evaluation of products for construction in relation to its main characteristics expressed as numerical value;

10) threshold level – the minimum or peak value of efficiency of products for construction;

11) the economic operator – the producer, the importer, the distributor or the authorized representative;

12) efficiency of products for construction – the efficiency connected with the corresponding main characteristics, expressed by the level, class or the description;

13) products for construction – any products or set of the made products placed in the market for the purpose of permanent application in construction or its parts whose efficiency influences efficiency of construction of rather fundamental requirements applied to construction;

14) product standard – set of demonstrative levels or classes of efficiency of product for construction in relation to its main characteristics made with use of certain combination of raw materials or other elements in specific production process;

15) the authorized representative – any physical person or legal entity which received in writing powers from the producer to be effective from his name in connection with the specified tasks;

16) intended use – the provided use of products for construction as it is determined in the applied approved technical specifications.

III. Organization of activities of single window

6. Activities of single window are organized as a part of the authorized bodies developing technical assessments (further – OTO) with specialized groups for implementation of the activities connected with development of technical assessments.

7. Activities of single window are carried out according to the program of work of representatives of OTO and provided with his specialists.

8. The program of work of single window is installed so that to meet most needs and expectationses of applicants of technical assessments in construction.

The program of work and carrying out activities are obligatory for all employees authorized by OTO which provide functioning of single window.

9. The specialist of single window in development of technical assessments in construction performs the following operations:

1) informs the applicant of technical assessment in construction on the procedure of giving and consideration of the application about technical assessment in construction, about the preliminary technical file which should be provided, method of development of technical assessment through single window and the expenses caused by process of development of technical assessments, and also procedure of the technical conclusion for technical assessments in Permanent technical Council on construction (further - technical council);
