RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

About additional measures for simplification of the procedure of certification of products

(as amended on 20-05-2020)

For the purpose of further forming of favorable conditions for subjects of business activity, simplification and removal of bureaucratic barriers in products certification process the Cabinet of Ministers decides:

1. Approve:

Regulations on procedure for carrying out certification of products according to appendix №1;

2. Enter since October 1, 2004 system of confirmation of conformity of products to the established requirements by declaring.

In two-month time to provide to the Uzstandart agency in accordance with the established procedure development and registration in the Ministry of Justice of the Republic of Uzbekistan of regulations on procedure for declaring of compliance of products to requirements of its safety.

3. To the Uzstandart agency, the Ministry of Health, the Ministry of agricultural and water economy of the Republic of Uzbekistan, the State committee of the Republic of Uzbekistan on conservation together with the interested ministries and departments in a month according to this resolution:

establish limit rates of selection of the imported products for testing by accredited bodies and laboratories;

determine types of testing, meaning exception of their duplication between accredited bodies and laboratories;

4. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 19.04.2013 No. 108

5. Determine that verification of presence of certificates of conformity can be performed by the state bodies authorized according to the legislation only concerning products which are subject to obligatory certification.

6. In three-months time to provide to the Uzstandart agency:

registration in the Ministry of Justice of the Republic of Uzbekistan Regulations on procedure for preparation and registration in standardization Uzstandart Agency of categories of the regulating documents established by the Law of the Republic of Uzbekistan "About standardization" and Rules of certification on each type of the uniform products which are subject to obligatory certification with indication of in them the indicators of safety established by the relevant regulating documents;

the edition and mailing to customs, tax and accredited bodies of the nomenclature list of products which are subject to obligatory certification with indication of the regulating documents determining indicators of their quality and safety.

7. Consider expedient transformation of EAN Uzbekistan LLC under Chamber of producers and entrepreneurs of the Republic of Uzbekistan in BAN Uzbekistan association.

In two-month time to provide to chamber of producers and entrepreneurs of the Republic of Uzbekistan accomplishment of this Item.

8. To the Uzstandart agency, Chamber of producers and entrepreneurs of Uzbekistan, Broadcasting company of Uzbekistan, the Uzbek agency on seal and information together with other interested ministries and departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent to develop and realize package of measures for finishing all normative legal documents in the field of certification to wide layers of entrepreneurs of the republic, including by means of the Internet.

9. Recognize invalid:

the paragraph of the second of Item 1 of the resolution of the Cabinet of Ministers of August 12, 1994 № 409 "About approval of the list of products, the subject obligatory certification, procedure for carrying out certification, import to the territory of the Republic of Uzbekistan and export from its territory of goods which require confirmation of their safety" and appendix №1 to this resolution (the joint venture of the Republic of Uzbekistan, 1994, to №8, by the Art. 38);

the paragraph third Item 2 of the resolution of the Cabinet of Ministers of December 5, 2002 №427 "About implementation of measures for enhancement of import of consumer goods to the Republic of Uzbekistan" (the joint venture of the Republic of Uzbekistan, 2002, №12, the Art. 75) and appendix №3 to this resolution.

10. To the Ministry of Justice of the Republic of Uzbekistan together with the interested ministries and departments to make in the Cabinet of Ministers offers on the changes and amendments in the legislation following from this resolution in a month.

To the ministries and departments to take stock and bring the departmental acts regulating questions of certification of products and services into compliance with this resolution in a month and to register in the Ministry of Justice of the Republic of Uzbekistan in accordance with the established procedure.

11. To impose control over the implementation of this resolution on the Deputy prime minister of the Republic of Uzbekistan Sultanov U. T.

Regulations on procedure for carrying out certification of products

I. General provisions

1. This Provision determines procedure for carrying out certification of the made and delivered products (further - certification).

The procedure for certification on each type of products is determined by the corresponding rules of certification registered in the Ministry of Justice of the Republic of Uzbekistan.

Change of design or the external product characteristics which are not influencing on earlier checked during certification of the characteristic on safety, does not involve carrying out additional certification on the modernized products. Obligatory characteristics on safety of products are determined in the relevant regulating documents by standardization.

Certification of vehicles is carried out according to the General technical regulation about safety of the wheel vehicles released the approved resolution of the Cabinet of Ministers of April 25, 2017 No. 237

2. Action of this provision extends to obligatory and voluntary certification.

The list of products which are subject to obligatory certification and also compliance of which can be confirmed with the conformance statement, is determined by the Cabinet of Ministers of the Republic of Uzbekistan.

3. Carrying out certification is performed, as a rule, in two stages according to the scheme according to appendix.

The first stage includes execution of the sanitary and epidemiologic conclusion in the bodies of the state sanitary inspection accredited by the Uzstandart Agency with simultaneous execution, as required, of the veterinary and phytosanitary conclusions respectively in bodies of the state veterinary supervision and public service on quarantine of plants.
