According to the Item of article 6 of the Law of Ukraine "About the state control of use and protection of lands", I order to the subitem 14 of item 4 of the Regulations on the State inspection of the agricultural industry of Ukraine approved by the Presidential decree of Ukraine of April 13, 2011 No. 459, to Item 8 of the Regulations on the Ministry of Agricultural Policy and Food of Ukraine approved by the Presidential decree of Ukraine of April 23, 2011 No. 500,:

1. Approve the Procedure for preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation which is applied.

2. Declare invalid the order of the State committee of Ukraine on land resources of December 14, 2004 No. 407 "About approval of the Procedure for preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation", No. 1635/10234 registered in the Ministry of Justice of Ukraine on December 24, 2004.

3. To department of agriculture (Lazarus T. I.) in the procedure established by the legislation to provide submission of this order on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the deputy minister Dikun A. E.

Procedure for preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation

I. General provisions

1.1. This Procedure is developed according to Article 15-2, Article part two 144, Article 188 of the Land code of Ukraine, Article part one 5, the subitem "b" of Article 6, article 10 of the Law of Ukraine "About the state control of use and protection of lands", Article 18-1 and part one of article 19 of the Law of Ukraine "About protection of lands", the subitem 14 of item 4 of the Regulations on the State inspection of the agricultural industry of Ukraine approved by the Presidential decree of Ukraine of April 13, 2011 No. 459, subitem 4.10 of Item 4, Item 6 of the Regulations on the state inspection of agricultural industry in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol the Ministry of Agricultural Policy and Food of Ukraine approved by the order of December 23, 2011 No. 770, registered in the Ministry of Justice of Ukraine on January 12, 2012 on No. 34/20347, also establishes the procedure of preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation (further - the Petition), their accounting, control over the implementation and taking measures of reaction in case of failure to meet requirements specified in the petition.

1.2. The petition is written appeal to executive body or local government body about need of taking measures to ensuring compliance with the land legislation.

1.3. On behalf of the State inspection of agricultural industry of Ukraine and its territorial authorities (further - inspection bodies of State agricultural inspectorate of Ukraine) have the right to introduce the Petition in executive bodies or local government bodies: The chief state inspector of agricultural industry of Ukraine and his deputies, the chief state inspectors of agricultural industry in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol and their deputies.

1.4. Requirements of this Procedure extend on:

the state inspectors of agricultural industry of inspection bodies of State agricultural inspectorate of Ukraine - regarding observance of established procedure of preparation and introduction by them (deliveries, the directions) Petitions, ensuring their accounting and control over the implementation of the requirements specified in the petition;

executive bodies, local government bodies - regarding consideration and fulfillment of requirements of the Petitions introduced by inspection bodies of State agricultural inspectorate of Ukraine, reduction of own decisions in compliance with requirements of the current legislation, acceptance for the law of measure for the termination of violations of the land legislation.

II. Bases for introduction of the Petition

2.1. The petition which form is given in appendix 1 to this Procedure is introduced in executive bodies or local government bodies in case of identification of violations of requirements of the land legislation.

2.2. Petitions are introduced on purpose:

reductions in compliance with the legislation of the decisions made by executive bodies or local government bodies concerning regulation of land relations, use and protection of lands;
