RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

of December 3, 1997 No. 534

About measures for implementation of independent examination of contracts of pre-shipment inspection of imported goods

(as amended on 21-07-2014)

For the purpose of expansion of the market of consulting services in the sphere of foreign economic activity, ensuring import of high-quality consumer goods, food, machines, the equipment and the Cabinet of Ministers technologies decides:

1. Approve the Provision on implementation of independent examination of import contracts and pre-shipment inspection of the goods imported to the Republic of Uzbekistan according to appendix No. 1 and enact it since December 15, 1997.

2. Agree with the offer of the Ministry of external commercial relations and Uzinvestproyekt engineering company about creation of the joint consulting firms performing independent examination of contracts for compliance to their quality, quantity, price level of imported goods and other conditions of contracts, and also conducting pre-shipment inspection according to the principles of the Agreement on pre-shipment inspection of the GATT/the WTO and other international requirements.

Consulting firms have the right to perform independent examination of contracts and conducting pre-shipment inspection if they meet the requirements of the International federation of the inspection agencies and are accredited in the Uzstandart agency.

3. The business entities of the Republic of Uzbekistan performing delivery of import goods have the right at the choice to address to consulting firms for examination of contracts and conducting pre-shipment inspection of imported goods with the subsequent registration of contracts in the Ministry of Foreign Economic Relations, Investments and Trades for examination and registration of contracts in accordance with the established procedure without conducting pre-shipment inspection except as specified, stipulated by the legislation.

4. Determine that conducting pre-shipment inspection does not extend:

on deliveries of goods under contracts which total cost does not exceed 10 thousand dollars of the USA;

on deliveries of specific goods which import is performed according to the licenses granted by the Ministry of Foreign Economic Relations, Investments and Trades of the Republic of Uzbekistan.

5. Determine that:

responsibility for reliability and objectivity of results of examination of contracts and pre-shipment inspection of imported goods is assigned to consulting firms;

the results of examination of contracts and pre-shipment inspection of imported goods issued by consulting firms and which are drawn up in accordance with the established procedure are recognized the Republic of Uzbekistan as appraisal certificates on quality, quantity and price level;

The Ministry of Foreign Economic Relations, Investments and Trades performs examination of import contracts based on the appraisal certificates on quality, quantity and price level issued by consulting firms within 2 working days from the moment of receipt of documents in attendance procedure.

7. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 26.07.2004 No. 358

8. To khokimiyat of Tashkent to provide provision to the consulting firms created according to this resolution, buildings with necessary communications and communication lines for placement and the subsequent redemption.

9. To impose control over the implementation of this resolution on the Prime Minister of the Republic of Uzbekistan Sultanov U. T.

to the Resolution of the Cabinet of Ministers of December 3, 1997 No. 534

Regulations on procedure of independent examination of import contracts and pre-shipment inspection of the goods imported to the Republic of Uzbekistan

1. As pre-shipment inspection it is understood:

physical inspection for the confirmation of quantity, quality and goods origin which are subject to shipment;

the comparative analysis for identification of whether there corresponds the price of goods, the freight, insurance and other charges to the developed price level in country of source and to the prices of the international market;

check of compliance of this consignment to contractual requirements, and also customs instructions of the Republic of Uzbekistan;

verification of data for taxation by duty/tax on the basis of the Commodity nomenclature and foreign economic activity.

2. Independent examination of import contracts and pre-shipment inspection of imported goods is performed according to the principles of the Agreement on pre-shipment inspection of the GATT/the WTO by the consulting firms meeting the requirements of the International federation of the inspection agencies and accredited in the Uzstandart agency.

3. The business entities of the Republic of Uzbekistan performing delivery of import goods have the right at the choice to address to consulting firms for examination of contracts and conducting pre-shipment inspection with the subsequent examination of contracts in the Ministry of Foreign Economic Relations, Investments and Trades or the Ministry of Foreign Economic Relations, Investments and Trades in cases, stipulated by the legislation for examination of contracts in accordance with the established procedure without conducting pre-shipment inspection except as specified, stipulated by the legislation.

4. Conducting pre-shipment inspection of imported goods does not extend:

on deliveries of goods under contracts which total cost does not exceed 10 thousand dollars of the USA;

on deliveries of specific goods which import is performed according to the licenses granted by the Ministry of Foreign Economic Relations, Investments and Trades of the Republic of Uzbekistan.

5. Article about carrying out or not conducting pre-shipment inspection of imported goods shall be provided in the contracts signed between the importer and the foreign exporter.

6. Conducting independent examination of import contracts and pre-shipment inspection of the goods imported to the Republic of Uzbekistan assumes the following procedure for works:

The importer represents to consulting firm according to the approved list necessary documents for:

a) examinations of the contract according to requirements of provisions of the resolution of the Cabinet of Ministers of October 1, 1996 No. 342 "About commodity import rationalization measures to the Republic of Uzbekistan";

b) implementation of pre-shipment inspection of goods in the country of the exporter.

The consulting firm accepts the request from the importer for the specified works and draws up work conditions in the form of the agreement, guaranteeing at the same time confidentiality of the provided materials against unauthorized transfer to the third parties.
