According to Item 23 of the Regulations on transfer and distribution of the special, anti-dumping, compensatory duties (appendix to appendix No. 8 to the Agreement on the Eurasian Economic Union of May 29, 2014) the Board of the Euroasian economic commission solved:

1. Approve the enclosed Regulations on exchange between authorized bodies of state members of the Eurasian Economic Union of information connected with transfer, distribution, transfer and return of the special, anti-dumping, compensatory duties.

3. Determine that the Provision approved by this Decision is applied in the part concerning the Republic of Armenia from the 1st following after month of entry into force of the Agreement of October 10, 2014 on accession of the Republic of Armenia to the Agreement on the Eurasian Economic Union of May 29, 2014.

4. This Decision becomes effective from the effective date Agreements on the Eurasian Economic Union of May 29, 2014, but not earlier than after 30 calendar days from the date of its official publication.

Regulations on exchange between authorized bodies of state members of the Eurasian Economic Union information connected with transfer, distribution, transfer and return of the special, anti-dumping, compensatory duties

1. This Provision is developed according to Item 23 of the Regulations on transfer and distribution of the special, anti-dumping, compensatory duties (appendix to appendix No. 8 to the Agreement on the Eurasian Economic Union of May 29, 2014) and determines procedure, forms and terms of exchange between authorized bodies of state members of the Eurasian Economic Union (further – state members) information connected with transfer, distribution, transfer and return of the special, anti-dumping, compensatory duties.

2. The concepts used in this Provision are applied in the values determined by the Protocol on procedure for transfer and distribution of the amounts of import customs duties (other duties, taxes and fees having equivalent action), their transfers in the income of budgets of state members (appendix No. 5 to the Agreement on the Eurasian Economic Union of May 29, 2014), the Protocol on application of special protective, anti-dumping and countervailing measures in relation to the third countries (appendix No. 8 to the Agreement on the Eurasian Economic Union of May 29, 2014) and the international treaties regulating customs legal relationship incoming the right of the Union.

3. The authorized body of state member daily, no later than 16 hours local time (for the Republic of Armenia – time of Yerevan, for the Republic of Belarus – time of Minsk, for the Republic of Kazakhstan – time of Astana, for the Kyrgyz Republic - time of Bishkek, for the Russian Federation – time of Moscow) the present day, sends to authorized bodies of other state members the report containing information on transfer and distribution of the amounts of the special, anti-dumping, compensatory duties for reporting day and the accruing result since the beginning of calendar year on form according to appendix.

4. The authorized body of state member monthly, for the 5th working day of the month following reporting sends to the Euroasian economic commission stipulated in Item 3 this provision information for the last reporting day of month under report and the accruing result since the beginning of calendar year in the form provided by appendix to this Provision.

5. Authorized bodies of state members perform operational reconciliation of information obtained according to Item 3 this provision. In case of establishment of discrepancies the protocol is drawn up and state members take measures for settlement of discrepancies.

6. Information sent by authorized body of one state member to authorized bodies of other state members and to the Euroasian economic commission according to this Provision is signed by the head of this authorized body (other authorized person) and goes in electronic form with use of the integrated information system of the Eurasian Economic Union, and before input of the specified system to action – on electronic communication links in the form of graphical electronic copies of the documents containing this information.
