PRESIDENTIAL DECREE OF THE RUSSIAN FEDERATION

of October 13, 2004 No. 1313

Questions of the Ministry of Justice of the Russian Federation

(as amended on 14-01-2021)

For the purpose of enhancement of activities of the Ministry of Justice of the Russian Federation for protection of rights and freedoms of man and citizen and according to article 32 of the Federal constitutional Law of December 17, 1997 "About the Government of the Russian Federation" I decide No. 2-FKZ:

1. Approve the enclosed Regulations on the Ministry of Justice of the Russian Federation.

2. Permit to have in the Ministry of Justice of the Russian Federation ten deputy ministers, including the One first Deputy Minister, one secretary of state - the deputy minister and one Representative of the Russian Federation under the European Court of Human Rights - the deputy minister, and also to 12 departments on the main activities of the Ministry and the office of the Representative of the Russian Federation under the European Court of Human Rights - the deputy minister of justice of the Russian Federation.

2.1. Determine that the representatives of the Ministry of Justice of the Russian Federation performing as a part of Permanent mission of the Russian Federation under the Council of Europe (without inclusion in its number of staff) functions on ensuring activities of the Representative of the Russian Federation under the European Court of Human Rights - the deputy minister of justice of the Russian Federation, constitute the foreign office of the Ministry of Justice of the Russian Federation.

3. Establish:

the extreme number of employees of central office of the Ministry of Justice of the Russian Federation in number of 701 units (without personnel on protection, servicing of buildings and transport service);

the extreme number of employees of territorial authorities of the Ministry of Justice of the Russian Federation in number of 2809 units (without personnel on protection, servicing of buildings and transport service);

the extreme number of workers of the foreign office of the Ministry of Justice of the Russian Federation in number of five units.

4. Determine that financing of the expenses connected with implementation of this Decree is performed at the expense of the funds allocated from the federal budget for the corresponding year to the Ministry of Justice of the Russian Federation.

5. To the government of the Russian Federation:

in 3-month time to bring the acts into accord with this Decree, and also to provide offers on reduction of acts of the President of the Russian Federation to compliance with this Decree;

provide financing of the expenses connected with implementation of this Decree.

6. To the Minister of Justice of the Russian Federation together with heads of Federal Penitentiary Service, Federal registration Service and Federal Bailiff Service to resolve in accordance with the established procedure the organizational matters, questions of material logistics and other questions connected with formation of the specified services and their territorial authorities.

7. Recognize invalid:

The presidential decree of the Russian Federation of May 2, 1996 No. 642 "About measures for development of judicial authorities of the Russian Federation" (The Russian Federation Code, 1996, No. 19, the Art. 2259);

The presidential decree of the Russian Federation of August 2, 1999 No. 954 "Questions of the Ministry of Justice of the Russian Federation" (The Russian Federation Code, 1999, No. 32, the Art. 4043);

The presidential decree of the Russian Federation of June 8, 2000 No. 1080 "About modification of the Regulations on the Ministry of Justice of the Russian Federation approved by the Presidential decree of the Russian Federation of August 2, 1999 No. 954 "Questions of the Ministry of Justice of the Russian Federation" (The Russian Federation Code, 2000, No. 24, the Art. 2546);

The presidential decree of the Russian Federation of December 10, 2001 No. 1416 "About modification and amendments in the Presidential decree of the Russian Federation of August 2, 1999 No. 954 "Questions of the Ministry of Justice of the Russian Federation" and in the Provision approved by this Decree" (The Russian Federation Code, 2001, No. 51, the Art. 4872);

item 4 of appendix No. 1 to the Presidential decree of the Russian Federation of October 21, 2002 No. 1209 "About reduction of acts of the President of RSFSR and the President of the Russian Federation in compliance with the Federal Law of August 8, 2001 No. 129-FZ "About state registration of legal entities" (The Russian Federation Code, 2002, No. 43, the Art. 4228);

The presidential decree of the Russian Federation of January 21, 2003 No. 67 "About modification of the Regulations on the Ministry of Justice of the Russian Federation approved by the Presidential decree of the Russian Federation of August 2, 1999 No. 954 "Questions of the Ministry of Justice of the Russian Federation" (The Russian Federation Code, 2003, No. 4, the Art. 297);

The presidential decree of the Russian Federation of January 30, 2003 No. 126 "About modification of the Regulations on the Ministry of Justice of the Russian Federation approved by the Presidential decree of the Russian Federation of August 2, 1999 No. 954" (The Russian Federation Code, 2003, No. 5, the Art. 437);

The presidential decree of the Russian Federation of July 24, 2003 No. 832 "About maintaining the register of national and cultural autonomies" (The Russian Federation Code, 2003, No. 30, the Art. 3048);

The presidential decree of the Russian Federation of September 30, 2003 No. 1160 "About entering of amendment and change into the Regulations on the Ministry of Justice of the Russian Federation approved by the Presidential decree of the Russian Federation of August 2, 1999 No. 954 "Questions of the Ministry of Justice of the Russian Federation" (The Russian Federation Code, 2003, No. 40, the Art. 3846).

8. This Decree becomes effective from the date of its official publication.

Regulations on the Ministry of Justice of the Russian Federation

I. General provisions

1. The Ministry of Justice of the Russian Federation (Ministry of Justice of the Russian Federation) is federal executive body which management of activities is performed by the President of the Russian Federation. The Ministry of Justice of the Russian Federation performs:

1) functions on development and realization of state policy and normative legal regulation in the established field of activity, including in the sphere:

execution of criminal penalties;

registration of non-profit organizations, including departments of the international organizations and foreign non-profit non-governmental organizations, political parties, other public associations and the religious organizations;

legal professions;

notariate;

state registration of acts of civil status;

providing established procedure of activity of the courts and execution of court resolutions and acts of other bodies;

rendering free legal aid and legal education of the population;
