ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

About procedure for establishment, change and annual indexation of rent of premises according to employment contracts of premises of housing stock of social use

In pursuance of part 5 of article 156.1 of the Housing code of the Russian Federation the Government of the Russian Federation decides:

1. Approve the enclosed Rules of establishment, change and annual indexation of rent of premises according to employment contracts of premises of housing stock of social use.

2. Determine that about application of the Rules approved by this resolution the Ministry of Construction and Housing and Communal Services of the Russian Federation gives explanations.

3. To the Ministry of Construction and Housing and Communal Services of the Russian Federation to approve the methodical recommendations about establishment of the maximum amount of rent of premises per 1 sq.m of total area of premises according to employment contracts of premises of housing stock of social use, change and annual indexation of such payment including recommendations about procedure for establishment of the maximum amount of the specified payment taking into account differentiation, change and annual indexation of such payment and also about financial and economic reasons for establishment and change of the maximum amount of such payment.

4. Recommend to public authorities of subjects of the Russian Federation to approve till March 1, 2015 the maximum amount of rent of premises per 1 sq.m of total area of premises according to employment contracts of premises of housing stock of social use taking into account differentiation according to the procedure for establishment, change and annual indexation of the maximum amount of such payment approved by them.

Rules of establishment, change and annual indexation of rent of premises according to employment contracts of premises of housing stock of social use

1. These rules determine procedure for establishment, change and annual indexation of rent of premises by the employment contracts of premises of housing stock of social use concluded according to the standard agreement of hiring of premises of housing stock of social use approved by the order of the Government of the Russian Federation of December 5, 2014 No. 1318 "On regulation of the relations on hiring of premises of housing stock of social use" (further respectively - employment contracts, rent of premises).

2. In case of establishment of the amount of rent of premises per 1 sq.m of total area of premises in the hired house of social use (further - the amount of payment for 1 sq.m of premises) are considered:

a) expense recovery of the owner of premises for construction or reconstruction of the hired house of social use in which the premises provided for rent are located or which is the apartment house provided for rent, or on acquisition of all rooms in such hired house of social use or such apartment house, including expenses on:

carrying out installation and construction works in case of construction or reconstruction of the hired house of social use;

acquisition of property right to all rooms in the hired house of social use or the apartment house which is the hired house of social use;

registration of the property right to all rooms in the hired house of social use or the apartment house which is the hired house of social use;

acquisition of property right or the rights of lease to the parcel of land on which the construction (creation) of the hired house of social use was performed or on which the hired house of social use is located;

registration of the property right or right of lease to the parcel of land on which the construction (creation) of the hired house of social use was performed or on which the hired house of social use is located;

lease of the parcel of land in the period of construction (creation) on such parcel of land of the hired house of social use (rent);

preparation of the project documentation and accomplishment of engineering researches for construction (creation) of the hired house of social use;

conducting examination of the project documentation and results of engineering researches if conducting such examination is obligatory;

construction of the systems of engineering facilities necessary for connection (technological accession) of the hired house of social use to networks of engineering facilities if it was provided by the project documentation;

introduction of connection fee (technological accession) of the hired house of social use to networks of engineering facilities;

improvement of the parcel of land on which the hired house of social use is located;

tax payment and other obligatory payments in connection with construction or reconstruction of the hired house of social use or acquisition of all rooms in the hired house of social use or the social use of the apartment house which is the hired house;

payment of the price for right to contract about development of the territory for the purpose of construction and operation of the hired house of social use (further - the agreement on development of the territory) and obligation fulfillment under the agreement on development of the territory if the construction (creation) of the hired house of social use was performed according to the agreement on development of the territory;

b) expenses of the owner and (or) lessor of premises if lessor is not the owner of premises, connected with capital repairs of the hired house of social use;

c) expense recovery of the owner and (or) lessor of premises if lessor is not the owner of premises, connected with the equipment located in the hired house of social use (the apartment house or the apartment house of the blocked building) of the rooms intended for satisfaction of social needs of employers, on condition of availability of the specified rooms;

d) expense recovery of the owner and (or) lessor of premises if lessor is not the owner of premises, connected with completion of premises property of the lessor (furniture, household appliances, household goods) provided that premises are completed with the specified property;

e) expenses of the owner of premises on lease of the parcel of land on which the hired house of social use is located (rent);

e) expenses of the owner and (or) lessor of premises if lessor is not the owner of premises, connected with management, content and running repair of the hired house of social use;

g) the expenses of the lessor connected with content and running repair of premises if according to the employment contract content and running repair of premises are obligation of the lessor of premises;
