According to the subitem 17) of Item 2 of article 6 of the Law of the Republic of Kazakhstan of April 23, 2014 "About law-enforcement bodies of the Republic of Kazakhstan" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of use of any kind of transport (except vehicles of representations of the foreign states and the international organizations having diplomatic immunity) for prosecution of persons suspected of making of criminal offense, arrival to the scene during action of emergency or warlike situation, in the conditions of armed conflict, in case of liquidation of emergency situations, and also for delivery of persons needing the emergency medical care in the medical organizations if the delay can create real threat of life or to human health, with compensation of material damage to owners in case of its causing.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

1. General provisions

These rules of use of any kind of transport (except vehicles of representations of the foreign states and the international organizations having diplomatic immunity) for prosecution of persons suspected of making of criminal offense, arrival to the scene during action of emergency or warlike situation, in the conditions of armed conflict, in case of liquidation of emergency situations, and also for delivery of persons needing the emergency medical care in the medical organizations if the delay can create real threat of life or to human health, with compensation of material damage to owners in case of its causing (further - Rules) are developed according to the Law of the Republic of Kazakhstan of April 23, 2014 "About law-enforcement bodies of the Republic of Kazakhstan" (further - the Law) and determine procedure for use by law-enforcement bodies of transport (except vehicles of representations of the foreign states and the international organizations having diplomatic immunity) for prosecution of persons suspected of making of criminal offense, arrival to the scene during action of emergency or warlike situation, in the conditions of armed conflict, in case of liquidation of emergency situations, and also for delivery of persons needing the emergency medical care in the medical organizations if the delay can create real threat of life or to human health, with compensation of material damage to owners in case of its causing.

2. Procedure for use of transport for prosecution of persons suspected of making of criminal offense, arrival to the scene during action of emergency or warlike situation, in the conditions of armed conflict, in case of liquidation of emergency situations, and also for delivery of persons needing the emergency medical care in the medical organizations if the delay can create real threat of life or to human health, with compensation of material damage to owners in case of its causing

2. The vehicles belonging to state bodies, the organizations and citizens are used by the staff of law-enforcement bodies (further - the employee of Department of Internal Affairs) in the following cases:

1) for prosecution of persons suspected of making of criminal offense, arrival to the scene during action of emergency or warlike situation, in the conditions of armed conflict, in case of liquidation of emergency situations;

2) for delivery of persons needing the emergency medical care in the medical organizations if the delay can create real threat of life or to human health.

3. It is not allowed to use vehicles of representations of the foreign states and the international organizations having diplomatic immunity.

4. It is necessary for the employee of Department of Internal Affairs for use of the vehicle:

1) to be provided to the owner of the vehicle, having called position, division, special rank and surname, by acquaintance with the official ID;

2) to explain the vehicle stop reason.

5. When using the vehicle the employee of Department of Internal Affairs on arrival constitutes the official report about use of the vehicle with the description of accessory (data of technical data sheet of the vehicle are specified) and conditions of the vehicle and things which are in it in which specifies about issue to the owner of the reference or mark in the route sheet with appendix of the inspection report of the vehicle in the form approved by authorized body and transfers to the person on duty of law-enforcement body.

6. The person on duty of law-enforcement body in accordance with the established procedure registers the message on use of the vehicle by the employee of Department of Internal Affairs in the book of accounting of statements, messages and other information on crimes, incidents (further - KUZI) then reports on the head of law-enforcement body.

7. The certificate of use of the vehicle by the employee of Department of Internal Affairs in the form approved by authorized body is issued to the owner of the vehicle.

3. Procedure for compensation of material damage to owners in case of its causing

For compensation of damage the owner within seven working days from the date of causing material damage, according to the inspection report of the vehicle, in the form approved by authorized body represents to law-enforcement bodies in the place of use of the vehicle the statement for compensation of the caused material damage in the form approved by authorized body.
