1. Approve the enclosed Regulations on features of application of the legislation of the Russian Federation in communication service industry in the territories of the Republic of Crimea and Sevastopol.

2. Determine that this resolution is effective till January 1, 2017.

Regulations on features of application of the legislation of the Russian Federation in communication service industry in the territories of the Republic of Crimea and Sevastopol

1. This Provision establishes features of application of the legislation of the Russian Federation in communication service industry in the territories of the Republic of Crimea and Sevastopol the organizations of communication operating in the territories of the Republic of Crimea and Sevastopol, performing activities for rendering services of telecommunication and (or) services of public mail service (further - the organizations of communication).

2. For the purpose of this provision are understood as the organizations of communication:

a) the legal entities taking according to constituent documents the location of permanent executive body or in case of absence of permanent executive body - other body or person having the right to act on behalf of the legal entity without power of attorney, in the territory of the Republic of Crimea or Sevastopol and the having licenses for activities in the field of rendering communication services, acts of assignment (appointment) of radio frequencies and (or) radio-frequency channels, the acts of allocation of resource of numbering issued by the state and other official organs of Ukraine, the state and other official organs of the Autonomous Republic of Crimea, the state and other official organs of Sevastopol (further - the allowing documents) valid as of March 21, 2014;

b) the individual entrepreneurs who were rendering communication services in the territory of the Republic of Crimea and Sevastopol and having the allowing documents valid as of March 21, 2014;

c) the legal entities taking according to constituent documents the location of permanent executive body or in case of absence of permanent executive body - other body or person having the right to act on behalf of the legal entity without power of attorney, in the territory of the Republic of Crimea or Sevastopol, performing activities for rendering communication services which provision did not require receipt of allowing documents, and the individual entrepreneurs rendering such communication services in the territory of the Republic of Crimea and Sevastopol.

3. The organization of communication has the right to perform in the territories of the Republic of Crimea and Sevastopol till May 1, 2015 activities for rendering services of telecommunication based on allowing documents in case of observance of provisions of items 4 - the 6th this provision.

4. The organization of communication sends till January 1, 2015 to Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications:

a) the notification on implementation of activities for rendering services of telecommunication which shall contain the following data:

the complete and reduced (in the presence) name, including trade name, form of business and the location address of the organization of communication - the legal entity (for the legal entity);

surname, name and middle name (in the presence), the residential address, details of the identity document of the individual entrepreneur (for the individual entrepreneur);

contact information of the organization of communication, including e-mail address;

information on communication network, including data on the technological capabilities of communication network, means and communication lines used in communication network and also on the rendered communication services and on the number of subscribers (users) on each service of communication, about services of accession and services in traffic transmission. Data on technological capabilities of communication network shall contain the scheme of creation of communication network of the organization of communication in which investment of funds of communication and communication lines, and also accession it to communication networks of other organizations of communication is reflected. On the scheme of creation of communication network of the organization of communication territorial placement of communication centers, the central terrestrial stations managing network of satellite communication, and the stations providing interaction of network of satellite communication with communication network public, stations and substations of network of cable communication, radio-electronic means, communication lines, points of accession to other communication networks, points of allocation of communication channels for rendering communication services on provision of communication channels, addresses or geographical coordinates of placement of communication centers, means of communication and communication lines is designated. Submission of several (separate) schemes of creation of communication networks which are used for rendering various communication services is allowed;

b) the statement for intention of the organization of communication to render in accordance with the legislation of the Russian Federation services of telecommunication in the territories of the Republic of Crimea and (or) Sevastopol.

5. If for implementation of activities in the field of rendering services of telecommunication the radio-frequency range is used, are in addition applied to the notification on implementation of activities for rendering services of telecommunication:

a) the statement for intention of the organization of communication to use the Russian radio-frequency resource in the territories of the Republic of Crimea and Sevastopol in accordance with the legislation of the Russian Federation;

b) copies of allowing documents for use of radio frequencies and (or) radio-frequency channels in the territories of the Republic of Crimea and Sevastopol;

c) copies of the documents confirming registration of radio-electronic means and high-frequency devices, issued by the state and other official organs of Ukraine and valid as of March 21, 2014;
