About formation of Public council concerning lustration under the Ministry of Justice of Ukraine

1. Form Public council concerning lustration under the Ministry of Justice of Ukraine (further - Council) and to approve Regulations on Public council concerning lustration under the Ministry of Justice of Ukraine which is applied.

2. To department of the constitutional, administrative and social laws to submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

3. Assign obligations on organizational support of activities of Council to Department concerning lustration.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the deputy minister - the chief of staff of Alekseev I. S.

Regulations on Public council concerning lustration under the Ministry of Justice of Ukraine

I. General provisions

1. The public council concerning lustration under the Ministry of Justice of Ukraine (further - Council) is the joint advisory advisory body formed for ensuring participation of citizens in administration of state affairs, implementation of public control over process of cleaning of the power (lustration), establishing effective interaction of the Ministry of Justice of Ukraine with the public, accounting of public opinion during the forming and realization of state policy.

2. Council in the activities is guided by the Constitution of Ukraine, the Law of Ukraine "About cleaning of the power" and other laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, this Provision and other acts of the legislation.

3. The main objectives of Council are:

creation of conditions for realization by citizens of constitutional right on participation in administration of state affairs;

implementation of public control over process of cleaning of the power (lustration);

ensuring accounting of public opinion by Ministry of Justice when implementing the actions provided by the Law of Ukraine "About cleaning of the power";

carrying out the analysis of interaction of Ministry of Justice (official and/or officials) with the public in the course of implementation of cleaning of the power (lustration);

implementation of monitoring and information analysis, including that that arrives from physical persons and legal entities to post and electronic addresses of Council, about distribution on persons of the prohibitions provided by the Law of Ukraine "About cleaning of the power";

assistance to information support of the work of Ministry of Justice directed to clarification of the power (lustration);

preparation of offers for drafts of regulatory legal acts on the questions connected with realization of provisions of the Law of Ukraine "About cleaning of the power".

4. Council has the right to have the form with the name and to perform publicizing of the activities through the official site of Ministry of Justice.

5. The regulations on Council are developed by public council and affirm Ministry of Justice.

The regulations on Council are published on the official site of body within three working days from the moment of approval.

Development and modification of the Regulations on public council are performed in the same order, as development and approval of the Regulations on public council.

6. The term of office of Council constitutes 2 years.

II. Powers of Council

1. Council according to the tasks assigned to it is authorized:

exercise public control over observance of the plan of conducting checks of state bodies and local government bodies, companies according to the procedure, stipulated by the legislation;

exercise public control over maintaining the Unified state register of persons to whom the provision of the Law of Ukraine "About cleaning of the power" is applied;

submit to Ministry of Justice decisions, obligatory for consideration, on the questions connected with realization of provisions of the Law of Ukraine "About cleaning of the power";

submit to Ministry of Justice proposals on preparation of drafts of regulatory legal acts on the questions, obligatory for consideration, connected with realization of provisions of the Law of Ukraine "About cleaning of the power";

inform the public on the activities on the official site of Ministry of Justice and other acceptable method, prepare and promulgate the annual statement about the activities;

send for consideration of the head of body to which powers conducting check belongs, arrived to Council, about person concerning whom it is performed, about distribution of the prohibitions on it provided by the Law of Ukraine "About cleaning of the power" what to inform Ministry of Justice on;

collect, generalize and provide to Ministry of Justice information on offers on the solution of the questions connected with carrying out process of cleaning of the power (lustration);

organize public actions for discussion of topical issues of carrying out lustration, activities of Ministry of Justice concerning lustration.

2. Council has the right:

receive from state bodies which competence includes conducting check, information on conducting check according to the legislation;

form standing and temporary working bodies (committees, the commissions, working and expert groups, etc.), to initiate creation of the representations or appointment of representatives of Council by and according to the procedure which are determined at meeting of Council;

choose and stop powers of members of council;

involve in accordance with the established procedure Council of employees of state bodies and local government bodies, representatives of the domestic and international expert and scientific organizations, the companies, organizations and the organizations, and also certain specialists, other subjects of physical persons with the consent of such persons;
