About approval of regulatory legal acts in the field of veterinary science

According to the subitem 4) Articles 8, item 4 of Article 14, item 4 of Article 20, Items 1, 2 and 4 articles 30 of the Law of the Republic of Kazakhstan "About veterinary science" and the subitem 185) Item 15 of the Regulations on the Ministry of Agriculture of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of April 6, 2005 No. 310 "Some questions of the Ministry of Agriculture of the Republic of Kazakhstan", PRIKAZYVAYU:

1. Approve enclosed:

1) Regulations on the state veterinary health control and supervision according to appendix 1 to this order;

2) Rules of obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person or their obligatory neutralization (disinfecting) and conversion without withdrawal according to appendix 2 to this order;

3) Rules and conditions of compensation to physical persons and legal entities of cost of the withdrawn and destroyed sick animals, products and raw materials of animal origin constituting health hazard of the animals and the person or neutralized (disinfected) and processed without withdrawal of animals, products and raw materials of animal origin constituting health hazard of animals and the person according to appendix 3 to this order;

4) the List of especially dangerous diseases of animals in case of which obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person according to appendix 4 to this order are carried out;

5) the List of especially dangerous diseases of animals which prevention, diagnostics and liquidation are performed at the expense of budgetary funds according to appendix 5 to this order;

6) Rules of implementation of the state veterinary health control and supervision on veterinary inspection stations according to appendix 6 to this order;

7) Rules of the organization of veterinary inspection stations according to appendix 7 to this order.

2. To provide to department of veterinary and food safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication.

3. To impose control of execution of this order on the vice-Minister of Agriculture of the Republic of Kazakhstan Isaeva G. S.

4. This order becomes effective on the expirations of ten calendar days after day of its first official publication.

Regulations on the state veterinary health control and supervision

Chapter 1. General provisions

1. This Regulations on the state veterinary health control and supervision (further – the Provision) are developed according to item 4 of article 14 of the Law of the Republic of Kazakhstan "About veterinary science" (further – the Law).

Chapter 2. Implementation of the state veterinary health control and supervision in the Republic of Kazakhstan

2. The state veterinary health control and supervision is exercised concerning the objects specified in Item 1 of article 14-1 of the Law.

3. The state veterinary health control and supervision on the objects specified in Item 1 of article 14-1 of the Law is performed by the state veterinary health inspectors of the corresponding territories according to Chapter 3 of the Law and Chapter 13 of the Entrepreneurial code of the Republic of Kazakhstan.

Rules of obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person or their obligatory neutralization (disinfecting) and conversion without withdrawal

Chapter 1. General provisions

1. These rules of obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person or their obligatory neutralization (disinfecting) and conversion without withdrawal (further - Rules), are developed according to Item 1 of article 30 of the Law of the Republic of Kazakhstan "About veterinary science" (further - the Law) and determine procedure for obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person, or their obligatory neutralization (disinfecting) and conversion without withdrawal.

2. No. 325 is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 09.11.2021

Chapter 2. Procedure for obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person

3. Obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person is made with compensation of their cost to physical persons and legal entities in case of especially dangerous diseases of the animals included in the List of especially dangerous diseases of animals in case of which obligatory withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person are carried out approved by this order.

4. The resolution on withdrawal of the animals constituting health hazard of animals and the person is accepted by the Chief state veterinary health inspector of the Republic of Kazakhstan in form according to appendix 1 to these rules based on the appraisal certificate (test report) of veterinary laboratory within 1 (one) working day from the date of obtaining.

The resolution on withdrawal of the animals constituting health hazard of animals and the person, accepted by the Chief state veterinary health inspector of the Republic of Kazakhstan within 1 (one) working day from the date of its acceptance is brought to the attention of the relevant territorial subdivision of department of authorized body in the field of veterinary science and the state veterinary organization created according to the subitem 1) of Item 1 of article 11 of the Law.

5. The resolution on withdrawal of products and raw materials of animal origin constituting health hazard of animals and the person is accepted by the Chief state veterinary health inspector of area, city of republican value, the capital in form according to appendix 2 to these rules based on the appraisal certificate (test report) of veterinary laboratory within 1 (one) working day from the date of its obtaining.

6. For the solution of the questions connected with obligatory withdrawal and extermination of animals, products and raw materials of animal origin, constituting health hazard of animals and the person, the order of the head of territorial subdivision of department of authorized body in the field of veterinary science (in case of absence of the head - person fulfilling its duties) the corresponding administrative and territorial unit (area, the city of republican value, the capital) creates the commission from among representatives of local executive bodies, state body in the field of sanitary and epidemiologic wellbeing of the population (under approval in case of diseases, general for animals and the person), the state veterinary organization, public associations, subjects of entrepreneurship, the state veterinary health inspector of the corresponding territory.

7. The state veterinary health inspector of the corresponding territory with obligatory participation of members of the commission draws up in triplicate the statement on withdrawal of the animals, products and raw materials of animal origin constituting health hazard of animals and the person in form according to appendix 3 to these rules (further - the act on withdrawal) which is signed by all members of the commission and is sealed district (city) territorial subdivision of department of authorized body in the field of veterinary science.

The first copy of the act on withdrawal is handed on receipt to the owner of the animals, products and raw materials of animal origin constituting health hazard of animals and the person, the second copy is transferred to the representative of the state veterinary organization, the third copy remains at the state veterinary health inspector of the corresponding territory.

8. The state veterinary health inspector of the corresponding territory along with creation of the act on withdrawal issues the decree on withdrawal of the animals, products and raw materials of animal origin constituting health hazard of animals and the person in form according to appendix 4 to these rules (further - the resolution).

9. The withdrawn animals, products and raw materials of animal origin constituting health hazard of animals and the person are described in the resolution on their withdrawal or, the inventories attached to them with exact specifying of the name, quantity, weight and other characteristic signs.

10. The withdrawn animals, products and raw materials of animal origin constituting health hazard of animals and the person are liable to destruction.

11. In case the owner disappeared or refused animals, products and the raw materials of animal origin constituting health hazard of animals and the person, the questions connected with the procedure of withdrawal or destruction them decide according to the administrative, civil legislation of the Republic of Kazakhstan.

12. For the purpose of non-admission of distribution of sources of causative agents of especially dangerous infectious diseases of animals and environmental pollution all works connected with extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person are carried out in the places specially allotted for these purposes.
