On regulation of the relations on hiring of premises of housing stock of social use

In pursuance of part 6 of Article 91.1 and Item 2 of part 1 of article 91.2 of the Housing code of the Russian Federation, Item 3 of part 7 of article 55.29 of the Town-planning code of the Russian Federation and Item 5 of article 26.1 of the Federal law "About State Registration of the Rights to Real Estate and Transactions with It" Government of the Russian Federation decides:

1. Approve enclosed:

standard agreement of hiring of premises of housing stock of social use;

requirements to the organizations, being lessors according to employment contracts of premises of housing stock of social use in respect of premises of private housing stock;

the list of the documents confirming the right of the applicant applying for participation in auction on right to contract about development of the territory for the purpose of construction and operation of the hired house of social use to act as the lessor according to employment contracts of premises of housing stock of social use;

the list of the documents confirming the right of the lessor and employer to the conclusion of the employment contract of premises of housing stock of social use in case of state registration of the restriction (encumbrance) of the property right to premises arising based on such agreement.

2. To the Ministry of Construction and Housing and Communal Services of the Russian Federation to approve:

form of the declaration of conformity to requirements to the organizations, being lessors according to the employment contracts of premises of housing stock of social use in respect of premises of private housing stock approved by this resolution;

form of the declaration of the lessor according to the employment contract of premises of social use about absence of other citizens having the right to the conclusion of the employment contract of premises of housing stock of social use in respect of the specified premises or about availability of other premises which can be provided to the specified citizens according to employment contracts of premises of housing stock of social use.

3. Recommend to public authorities of subjects of the Russian Federation and local government bodies of municipalities in which territories provision of premises according to employment contracts of premises of housing stock of social use is performed or planned, to form public councils with participation of representatives of the interested socially oriented non-profit organizations for the purpose of the organization of public control over activities of lessors for employment contracts of premises of housing stock of social use, carrying out independent quality evaluation of work of such lessors and the address in need of body of the state housing supervision on the issue of additional check of activities of such lessors.

4. Item 9 of the requirements approved by this resolution becomes effective since May 1, 2015.
