Regulations of Federal Agency for Sea and Inland Water Transport

I. General provisions

1.1. The regulations of Federal Agency for Sea and Inland Water Transport (further - Regulations) are developed according to the Constitution of the Russian Federation, the Federal constitutional Laws, the Federal Laws, acts of the President of the Russian Federation, the Government of the Russian Federation, the Regulations of the Government of the Russian Federation and Regulations on the Russian Government Office approved by the order of the Government of the Russian Federation of June 1, 2004 No. 260 <1> (further - Regulations of the Government of the Russian Federation), the Regulations on the Ministry of Transport of the Russian Federation approved by the order of the Government of the Russian Federation of July 30, 2004 No. 395 <2>, Regulations on Federal Agency for Sea and Inland Water Transport approved by the order of the Government of the Russian Federation of July 23, 2004 No. 371 <3> (further - Regulations on Rosmorrechflot), The standard regulations of interaction of federal executive bodies approved by the order of the Government of the Russian Federation of January 19, 2005 No. 30 <4> (further - Standard regulations of interaction of federal executive bodies), the Standard regulations of the internal organization of federal executive bodies approved by the order of the Government of the Russian Federation of July 28, 2005 No. 452 <5> (further - Standard regulations of the internal organization of federal executive bodies), also establishes general rules of the organization of activities of Federal Agency for Sea and Inland Water Transport (further - Rosmorrechflot).

1.2. Rosmorrechflot is the federal executive body performing functions on rendering the state services and management of state-owned property in the sphere sea (including seaports, except for the maritime terminals intended for complex servicing of vessels of the fishery fleet) and river transport, and also function on rendering the state services in the field of ensuring transport safety in this sphere.

Rosmorrechflot performs powers of competent authority in the field of sea and inland water transport on accomplishment of the obligations following from international treaties of the Russian Federation regarding accomplishment of functions on rendering the state services and management of state-owned property.

1.3. Rosmorrechflot is under authority of the Ministry of Transport of the Russian Federation (further - the Ministry).

1.4. Rosmorrechflot in the activities is guided by the Constitution of the Russian Federation, the Federal constitutional Laws, the Federal Laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, acts of the Ministry, and also these Regulations.

1.5. Rosmorrechflot performs the activities directly or through the subordinated organizations in interaction with other federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies, public associations and other organizations.

1.6. Rosmorrechflot within the competence publishes individual legal acts on the basis and in pursuance of the Constitution of the Russian Federation, the Federal constitutional Laws, the Federal Laws, acts and orders of the President of the Russian Federation, the Government of the Russian Federation and the Ministry.

1.7. Rosmorrechflot has no right to perform in the established field of activity normative legal regulation and functions on control and supervision, except the cases established by presidential decrees of the Russian Federation or orders of the Government of the Russian Federation. 1.8. The structure and the staff list of Rosmorrechflot affirm the head of Rosmorrechflot within the salary fund and number (without personnel on protection and servicing of buildings) established by the President of the Russian Federation or the Government of the Russian Federation taking into account the register of positions of Federal public civil service and acts determining the normative number of the relevant divisions.

1.9. The structure of Rosmorrechflot includes management of Rosmorrechflot (the head of Rosmorrechflot and deputy managers of Rosmorrechflot), assistants (advisers) to the head of Rosmorrechflot and structural divisions (managements) of Rosmorrechflot on the main activities, and also the departments which are independent structural divisions, submitting directly to the head of Rosmorrechflot and performing mobilization preparation, actions for civil defense, protection of the state secret, and providing public service and personnel. Organizational support of activities of the deputy minister of transport of the Russian Federation - the head of Federal Agency for Sea and Inland Water Transport (further - the head of Rosmorrechflot) is performed by assistants (advisers) to the deputy minister of transport of the Russian Federation - the head of Federal Agency for Sea and Inland Water Transport (further - the head of Rosmorrechflot).
