About approval of Regulations on licensing of sales activity of oil products

One of the reasons of it is unsatisfactory work of territorial working groups of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent, and also lack of due control of their activities from authorized bodies.

In this regard according to the legislation on licensing of separate types of activity the great value is attached to timely critical evaluation of execution of the obligations by licensing authorities and determination of accurate regulations of activities republican and the territorial commissions.

In pursuance of article 5 of the Law of the Republic of Uzbekistan "About licensing of separate types of activity" the Cabinet of Ministers decides:

1. Approve:

Regulations on licensing of sales activity of oil products (except realization of oil products through gas stations and exchange bureaus of oils) according to appendix No. 1;

Regulations on licensing of sales activity of oil products through gas stations and exchange bureaus of oils according to appendix No. 2;

Structure of the Commission on licensing of sales activity of oil products of the Cabinet of Ministers of the Republic of Uzbekistan according to appendix No. 3;

Standard structure of the territorial commissions of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent on licensing of sales activity of oil products through gas stations and exchange bureaus of oils according to appendix No. 4.

2. Determine that:

decisions on issue and cancellation of licenses for activities on realization of oil products (except realization of oil products through gas stations and exchange bureaus of oils), the termination or prolongation their actions are taken by the Commission on licensing of sales activity of oil products of the Cabinet of Ministers of the Republic of Uzbekistan;

decisions on issue and cancellation of licenses for activities on realization of oil products through gas station and exchange bureaus of oils, suspension, the termination or prolongation their actions are taken by the relevant territorial commissions of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent.

3. Assign functions of the working body performing documents acceptance, licensing, the conclusion of the license agreement and control of its accomplishment:

The commissions on licensing of sales activity of oil products of the Cabinet of Ministers of the Republic of Uzbekistan - on Uzgosneftegazinspektion;

the territorial commissions on licensing of sales activity of oil products through gas stations and exchange bureaus of oils of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent - on territorial departments of Uzgosneftegazinspektion.

4. The commissions on licensing of sales activity of oil products of the Cabinet of Ministers of the Republic of Uzbekistan in two weeks to develop and approve:

regulations on the commission on licensing of sales activity of oil products of the Cabinet of Ministers of the Republic of Uzbekistan;

standard regulations on the commission on licensing of sales activity of oil products through gas stations and exchange bureaus of oils of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent.

5. To department on development of fuel and energy complex of the Cabinet of Ministers of the Republic of Uzbekistan to carry out inventory count of the licenses granted before entry into force of this resolution in a month, to provide reduction of terms of their action in compliance with Regulations on licensing of sales activity of oil products (except realization of oil products through gas stations and exchange bureaus of oils) and to sign license agreements with licensees.

6. To Council of Ministers of the Republic of areas and Tashkent:

in ten-day time at meetings of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent to approve structures of the territorial commissions on licensing of sales activity of oil products through gas stations and exchange bureaus of oils, according to the Provision approved by this resolution and standard structure, to take measures for increase in responsibility of the commissions;

together with Uzgosneftegazinspektion to provide the conclusion through territorial departments of Uzgosneftegazinspektion of license agreements with the licensees who obtained licenses for sales right of oil products through gas stations and exchange bureaus of oils before entry into force of this resolution in a month.

To provide to the commission on licensing of sales activity of oil products of the Cabinet of Ministers of the Republic of Uzbekistan coordination and control of accomplishment of this Item.

7. Make changes to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 5.

8. To impose control over the implementation of this resolution on the Prime Minister of the Republic of Uzbekistan Sultanov U. T.

Regulations on licensing of sales activity of oil products (except realization of oil products through gas stations and exchange bureaus of oils)

I. General provisions

1. This Provision determines procedure for licensing of sales activity of oil products (except realization of oil products through gas station and exchange bureaus of oils).

2. The sales activity of motor gasoline, aviation petrol, ekstrabenzin, diesel fuel, aviation fuel, fuel oil, oven fuel, petrobitumen, and also the technical oils and lubricants which except for are packed up in original packings is subject to licensing.

3. The sales activity of oil products is performed only by legal entities.

4. On the right of implementation of sales activity of oil products standard (simple) licenses are granted.
