About approval of the Regulations on Group of implementation of investment projects of Islamic development bank of the Ministry of transport and communication of the Kyrgyz Republic

For the purpose of successful implementation of investment projects of Islamic development bank and the Arab coordination panel, I order:

1. Approve the enclosed Regulations on Group of implementation of investment projects of Islamic development bank Ministries of Transport and Communications of the Kyrgyz Republic.

2. Determine that financing of Group of the realization of investment projects of Islamic development bank Ministries of Transport and Communications of the Kyrgyz Republic is enabled according to the agreements signed between the Government of the Kyrgyz Republic and the international donors who became effective in accordance with the established procedure.

3. Declare invalid the order of the Ministry of transport, and communications of the Kyrgyz Republic of 02.12.2010 No. 318.

4. To impose control of execution of this order on the director Gruppy of implementation of investment projects of Islamic development bank of N. Zhumaliyev.

Regulations on group of implementation of investment projects of Islamic Development bank Ministries of Transport and Communications of the Kyrgyz Republic

I. General provisions

The group of implementation of investment projects of Islamic Development bank (further "GRIP IBR"), is created by the order of the Minister of Transport and Communications of the Kyrgyz Republic No. 281 of October 20, 2010 in pursuance of the signed and ratified Credit Agreements between the Government the Kyrgyz Republic and the international financial donors according to whom the Ministry of Transport and Communications of the KR is the Executive Agency.

Activities of GRIP IBR are performed and regulated by the current legislation of the Kyrgyz Republic, resolutions and orders of the Government of the Kyrgyz Republic, orders and orders of the Minister of Transport and Communications, managements and provisions of the international financial donors, and also this Provision.

GRIP IBR is not legal entity, is financed according to the international treaties signed between the Government of the Kyrgyz Republic, which became effective in accordance with the established procedure.

II. Main objectives and GRIP IBR functions

1. The main objectives of GRIP IBR are:

1.1. Preparation and implementation of the following investment projects:

- the project of rehabilitation of Bishkek-Naryn-Torugarg Highway, the site of 272-365 km (it is financed by the Arab coordination panel);

- the project of rehabilitation of Taraz-Talas-Suusamyr Highway, the Phase III and IV (it is financed by the Arab coordination panel);

- rehabilitation of Osh-Batken-Isfana Highway, the site of 75-108 km (it is financed by Islamic development bank);

- the construction project of the alternative highway North-South, km 159-183 (it is financed by the Arab coordination panel).

1.2. Responsibility for preparation and implementation of other projects can be conferred on GRIP IBR according to the decision of the Minister of Transport and Communications of the KR.

1.3. Implementation of necessary contacts between the Ministry of Transport and Communications of the Kyrgyz Republic, the international donors, consultants, contractors, departments, the agencies and the organizations concerning the project.

1.4. Constant control and supervision of timely execution together with the relevant managements of MTIK and other ministries and departments of execution of credit obligations by the borrower according to the signed and ratified Credit agreements on projects.

2. The main functions, according to the tasks set for GRIP IBR are:

- timely preparation, together with the international consultants, drafts of the relevant documents and coordination with donors, the Government of the Kyrgyz Republic, the relevant ministries and departments of the KR, regional authorities concerning preparation and implementation of the administered investment projects;

- participation in negotiations on discussion, the conclusion, execution and modification in credit, in the contractual and other agreements concerning implementation of investment projects;

- carrying out in accordance with the established procedure meetings and negotiations with donors on preparation and implementation of the administered investment projects, and also on discussion, the conclusion, execution and introduction of amendments to contractual and other agreements. Attraction in accordance with the established procedure for these purposes of representatives of the relevant structural managements / divisions and the subordinated organizations of the Ministry;

- the organization, together with the international consultants, republican and international tenders and tenders within implementable investment projects in strict accordance with rules and procedures of donors for carrying out purchases by the local legislation;

- submission to the Government of the Kyrgyz Republic, the Ministry of Finance of the KR, the Ministry of Economics of the KR, the Ministry of Transport and Communications of the KR and to donors of data on the planned and implementable investment projects in the form of the established monthly and quarterly statements, and also other information, content, form and which time of provision is approved with donors and other interested ministries and departments;

- possibility of visit by representatives of donors of the objects and building sites included in projects, checks and acquaintance with their condition, evaluating project implementation and input of projects in operation after their completion;

- monitoring of accomplishment of necessary actions for implementation of payment of the performed works according to procedures of donors based on agreements and signed contracts;

- monitoring of control of quality and work progress, obligation fulfillments on projects the consultant, contractors and suppliers, assessment of project decisions and amending, and also implementation of other functions following from contents of agreements and signed contracts;

- coordination of relations of consultants, contractors and suppliers with the local and republican authorities in aspect of the taxation and social payments;

- timely provision to donors and in the Ministry of Finance of the KR of audit reports on movement of project accounts;

- preparation for consideration by management of MTIK KR of drafts of decisions, orders, orders, correspondence on the questions which are within the competence GRIP IBR;

- participation in project development of the budget and other programs with necessary reasons in interaction with Management of highways MTIK KR, current and perspective plans of investments for development of highways;

- participation in project and technical, technological and prospecting projects;
