Regulations on sale of forest plantings for procurement of wood when implementing purchases of works on protection, protection and reproduction of the woods

1. This Provision establishes procedure for sale of forest plantings for procurement of wood when implementing purchases of works on protection, protection and reproduction of the woods.

2. Public authorities and local government bodies within the powers determined according to Articles 81 - 84 Forests codes of the Russian Federation, when implementing purchases of works on protection, protection and reproduction of the woods according to the Federal Law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" and the Forest code of the Russian Federation at the same time perform sale of forest plantings for wood procurement.

3. Sale of forest plantings for procurement of wood is performed on the lands which are in the state-owned or municipal property within forest area (forest park) in which implementation of actions for protection, protection and reproduction of the woods is planned.

At the same time the amount of the wood which is subject to procurement is determined proceeding from amounts of works by protection, protection and reproduction of the woods provided in forestry and landscape regulations of forest areas (forest parks), forest management documentation, and results of forest pathological inspections.

4. The contract for performance of works on protection, protection and reproduction of the woods in addition to terms of the contract, stipulated by the legislation the Russian Federation about contractual system in the field of purchases of goods, works, services for ensuring the state and municipal needs, joins the following purchase and sale terms of forest plantings:

a) location of forest plantings (name of the subject of the Russian Federation, name of the municipal district, forest area (forest park), local forest area, natural boundary (in the presence), forest quarter and (or) lesotaksatsionny apportionment (number), area of apportionment, cutting area);

b) amount to subject wood procurement (including specific (pedigree) composition of wood) with its distribution on business (large, average, small) and wood;

c) the payment for the wood which is subject to procurement, determined by the rates established according to Article 76 of the Forest code of the Russian Federation (including account details for transfer of payment and the terms of introduction of payment which are not exceeding the duration of the contract);

d) the wood procurement term (which is not exceeding the duration of the contract).
