About information exchange of the State Parties of the CIS in the field of ensuring transport safety

The governments of the State Parties of the Commonwealth of Independent States which further are referred to as with the Parties

for the purpose of realization:

The declaration concerning safety on transport in the State Parties of the Commonwealth of Independent States adopted by the Decision of Council of CIS Heads of Government of September 18, 2003

The priority directions of state cooperation – the members of the CIS in the field of transport for the period till 2020 approved by the Decision of Council of CIS Heads of Government of November 14, 2008

Agreements on the approved development of the international transport corridors passing on the territory of the State Parties of the CIS of November 20, 2009

recognizing need of harmonization of the legislation on transport safety, including for the purpose of creating favorable conditions for effective operation and development of sites of the international transport corridors passing on the territories of the State Parties of the CIS

wishing to develop international cooperation concerning realization of the practical measures directed to the prevention of the acts of illegal intervention menacing to steady and safe functioning of transport complex, creating threat to interests of the personality, society and state

realizing mutual advantage of combination of efforts of the Parties in the field of ensuring transport safety and noting usefulness of two - and multilateral arrangements on exchange of information in this area,

agreed as follows:

Article 1

For the purposes of this agreement the following terms are used:

the act of illegal intervention – the illegal action (failure to act), including act of terrorism which is menacing to safe activities of transport complex, entailed damnification of life and to human health, material damage or created threat of approach of such effects;

categorization of objects of transport infrastructure and vehicles – their reference to certain categories taking into account the degree of threat to making of the act of illegal intervention and its possible effects;

competent authorities of the Parties – the bodies determined by the Parties for the organization and implementation of information exchange within this agreement;

objects of transport infrastructure – the technological complex including: railway, automobile stations and stations; tunnels, platforms, bridges; maritime terminals, water areas of seaports; ports which are located on inland waterways and in which landing (disembarkation) of passengers and (or) transfer of loads of the increased danger based on special permissions, navigable hydraulic engineering constructions are performed; airfields, airports, objects of communication systems, navigation and traffic control of vehicles; sections of highways, railway and inland waterways, helidromes, airfields, and also other buildings providing functioning of transport complex, constructions, devices and the equipment;

assessment of vulnerability of objects of transport infrastructure and vehicles – determination of degree of security of objects of transport infrastructure and vehicles from threats of making of acts of illegal intervention;

carrier – the legal entity or the individual entrepreneur who assumed obligation to bring the passenger, the load entrusted to it by the sender, baggage, cargo baggage from the point of departure in destination, and also to issue load, baggage, cargo baggage to person (receiver) authorized on its obtaining;

forces of ensuring transport safety – persons responsible for ensuring transport safety in the subject of transport infrastructure, on object of transport infrastructure, the vehicle, including the personnel of the subject of transport infrastructure or division of transport safety which are directly connected with ensuring transport safety of objects of transport infrastructure or vehicles;

subjects of transport infrastructure – legal entities and physical persons, being owners of objects of transport infrastructure and/or vehicles or using them on other legal cause;

transport safety – condition of security of objects of transport infrastructure and vehicles from acts of illegal intervention;

vehicles – the devices intended for transportation of the physical persons, loads, baggage, hand luggage, personal belongings, animals or the equipment, devices established on the specified vehicles, and including:

the vehicles of road transport used for regular transportation of passengers and baggage or transportation of passengers and baggage by request or used for transportation of dangerous goods on which implementation special permission is required;

aircrafts of commercial civil aviation;

aircrafts of aircraft of general purpose;

the vessels used for the purpose of merchant shipping (ocean ships), except for pleasure crafts, sports sailing ships;

the vessels used on inland waterways for transportation of passengers, except for pleasure crafts, sports sailing ships, and (or) for transportation of goods of the increased danger, allowed to transportation on special permissions;

the railway rolling stock transporting passengers and (or) the loads of the increased danger allowed to transportation on special permissions;

vehicles of urban land electric transportation.

Article 2

Subject of this agreement is determination of the general principles of the organization of information exchange of the Parties for the purpose of:

to harmonization of approaches to development of state policy and normative legal regulation in the field of ensuring transport safety;

informing on threats of making and on making of acts of illegal intervention on objects of transport infrastructure and vehicles when implementing international carriages on the territories of the State Parties of this agreement.

Article 3

The parties determine information exchange by subject of this agreement as basic component of the steady international transit message and creation of mutually advantageous conditions for free transportation of passengers, loads, baggage and cargo baggage on the territories of the State Parties of this agreement.

Article 4

Within implementation of this agreement of the Party will organize information exchange in the following directions:

determination of threats of making of acts of illegal intervention in activities of objects of transport infrastructure and vehicles;

evaluating vulnerability of objects of transport infrastructure and vehicles;

categorization of objects of transport infrastructure and vehicles;

development and implementation of requirements for ensuring transport safety;

planning and implementation of measures for ensuring transport safety;

training and certification of forces of ensuring transport safety;

implementation of the state control (supervision) in the field of ensuring transport safety;

information, material and scientific and technical support of transport safety;
