Regulations on Department of statistics of Akmola area of Committee according to the statistics Ministries of national economy of the Republic of Kazakhstan

1. General provisions

1. The department of statistics of Akmola area of Committee according to the statistics of the Ministry of national economy of the Republic of Kazakhstan (further - Department) is the territorial state body of Committee according to the statistics the Ministries of national economy of the Republic of Kazakhstan (further - Committee) performing management in the sphere of the state statistical activities.

2. The department performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. The department is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

4. The department enters the civil relations from own name.

14. Functions of Department:

1) development of offers on forming and realization of state policy in the field of the state statistics;

2) introduction of offers on forming of statistical methodology;

3) the organization and carrying out nation-wide statistical observations according to the plan of statistical works;

4) providing program implementation of national censuses;

5) use of administrative data only for production of statistical information and updating of statistical registers;

6) providing respondents with statistical forms and instructions for their filling in case of representation of primary statistical data by them;

7) exercises the state control in the field of the state statistics concerning respondents in the form of preventive control without visit of respondents;

7-1) conducts national censuses;

7-2) exercises the state control in the field of the state statistics concerning administrative sources in form of preventive control without visit and with visit of administrative sources;

7-3) carries out refining of accuracy of the data of pokhozyaystvenny accounting;

7-4) performs monitoring, the analysis and comparison of the data obtained by authorized body from official sources;

7-5) carries out registration of the prices;

8) ensuring accumulating, maintaining and updating of information statistical databases about economic and social situation of area and its cities, areas;

9) excitement, hearing of cases about administrative offenses and imposing of administrative punishments in the field of the state statistics according to the procedure established by the legislation on administrative offenses;

10) implementation of other functions assigned to Department by the legislation of the Republic of Kazakhstan.

15. Rights and obligations of Department:

receive on a grant basis from respondents primary statistical data;

receive on paid and non-paid basis necessary primary statistical data from households about their income and expenses;

in case of production of statistical information for confirmation of reliability of primary statistical data to demand from respondents the additional information;

in case of identification of misstatements by respondents of primary statistical data to demand from respondents of entering of corrections into the statistical forms containing primary statistical data;

own, use and dispose of the base containing personal data;

obtain contact information on respondents from telecom operators;

data collection from respondents and users for the purpose of monitoring of level of satisfaction with activities of Committee;

attract persons as interviewers when carrying out nation-wide statistical observations and national censuses;

carry out together with the relevant state bodies, the commissions, census personnel of mass and explanatory work among the population about the purposes and procedure for carrying out national censuses;

matching of census personnel and the conclusion of contracts with them for participation in national censuses according to the legislation of the Republic of Kazakhstan;

carry out testing of schedules, forming, refining, and also representation by akimats of areas and cities of republican value to Committee of lists of subjects of agricultural census by carrying out pilot census according to the decision of authorized body;

3. Organization of activities of Department

16. Management of Department is performed of the Head of Department who bears the personal responsibility for accomplishment of the tasks assigned to Department and implementation of the functions by it.

17. The head of Department is appointed to position and dismissed by the responsible secretary of the Ministry of national economy of the Republic of Kazakhstan of representation of the chairman of Committee.

18. The head of Department has deputies who are appointed to positions and are dismissed according to the legislation of the Republic of Kazakhstan.

19. Powers of the Head of Department:

1) makes offers in the developed program documents of Committee approved by the Chairman of Committee;

2) determines obligations and powers of the deputies and employees of Department;

3) appoints to positions and dismisses employees of Department, except for workers whose questions of employment relationships are carried to competence of higher state bodies and officials;

4) resolves issues of sending, provision of leaves, rendering financial support, preparation (retraining), advanced training, encouragement, payment of allowances and awarding, and also attraction to disciplinary responsibility of employees of Department;

5) within the competence publishes legal acts, instructs, obligatory for execution by employees of Department;

6) is represented by Department in state bodies and other organizations according to the current legislation;

7) approves provisions of structural divisions of Department;

8) takes the measures directed to anti-corruption in Department;

9) will be organized by information and analytical, organizational, material and financial provision of activities of Department;

10) performs other powers according to the legislation of the Republic of Kazakhstan.

Execution of powers of the Head of Department in the period of its absence is performed by person replacing it according to the current legislation.

20. The head of Department determines powers of the deputies according to the current legislation.

4. Property of Department

21. The department can have on the right of operational management the isolated property in cases, stipulated by the legislation

The property of Department is created at the expense of the property given it by the owner and also the property (including cash incomes) acquired as a result of own activities and other sources which are not forbidden by the legislation of the Republic of Kazakhstan.

22. The property assigned to Department belongs to republican property.

23. The department has no right to alienate independently or to dispose otherwise of the property assigned to it and the property acquired at the expense of the means issued to it according to the plan of financing if other is not established by the legislation.

5. Reorganization and liquidation of Department

24. Reorganization and abolition of Department are performed according to the legislation of the Republic of Kazakhstan.
