ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About approval of the Regulations on filling, the certificate, issue and the subsequent verification of preferential certificates of origin of goods

(as amended on 24-06-2020)

Based on the Law of the Republic of Moldova No. 1380-XIII of November 20, 1997 about customs tariff (The official monitor of the Republic of Moldova, the special edition of January 1, 2007), with subsequent changes and amendments, and also for the purpose of regulation of the procedure of approval of preferential goods origin, exported within the free-trade agreements ratified by the Republic of Moldova, the Government DECIDES:

1. Approve Regulations on filling, the certificate, issue and the subsequent verification of preferential certificates of origin of goods it (is applied).

2. To impose control over the implementation of this resolution on the Ministry of Finance.

Regulations on filling, certificate, issue and subsequent verification of preferential certificates of origin of goods

I. General provisions

1. This Provision is developed according to Law No. 112 provisions of July 2, 2014 on ratification of the Agreement on association between the Republic of Moldova, on the one hand, by both the European Union and European Atomic Energy Community and their state members, from other party (The official monitor of the Republic of Moldova, 2014, Art. No. 185-199, 442), the Law No. 120-XVI of May 4, 2007 on ratification of the Agreement on modification and accession to the Central European free-trade agreement (CEFTA) (The official monitor of the Republic of Moldova, 2007, Art. No. 70-73, 330), the Law No. 201 of September 27, 2007 on ratification of the Agreement on the free trade area (The official monitor of the Republic of Moldova, 2012, No. 228, the Art. 728), The law No. 111 of May 28, 2015 on accession of the Republic of Moldova to the Regional convention on preferential rules of goods origin of the Pan-European and Mediterranean area (The official monitor of the Republic of Moldova, 2015, Art. No. 166-176, 350), the Law No. 49 of March 31, 2016 on ratification of the Free-trade agreement between the Republic of Moldova and the Republic of Turkey (The official monitor of the Republic of Moldova, 2016, Art. No. 114-122, 227) and the international acts which regulate the procedure of filling, the certificate, issue and the subsequent verification of preferential certificates of origin of goods.

2. Customs authorities will certify goods origin, exported to member states of the European Union – agreement parties about association between the Republic of Moldova, on the one hand, both the European Union and European Atomic Energy Community and their state members, on the other hand, to member countries of the Central European free-trade agreement (CEFTA) or to the State Parties of other free-trade agreements ratified by the Republic of Moldova which provide in quality of the proof about origin type of the certificate of EUR.1, according to provisions of the Protocol on determination of the concept "the goods coming from the states parties" and methods of administrative cooperation within agreements which provide in quality of the proof about origin type of the certificate of EUR.1, and issue certificates of movement of goods EUR.1.

3. Ceased to be valid according to the Order of the Government of the Republic of Moldova of 23.12.2016 No. 1402

4. Customs authorities will certify origin of the exported goods to the states which are not members of the European Union and provide to the Republic of Moldova the General preferential system and issue the certificates of origin Form A.

4-1. Customs authorities in information system of the registered exporters register the exporters which are performing commodity export, coming from the Republic of Moldova to the countries providing to the Republic of Moldova the General preferential system. The procedure of registration is established by Customs Service.

5. Ceased to be valid according to the Order of the Government of the Republic of Moldova of 23.12.2016 No. 1402

6. For the goods coming from the Republic of Moldova in case of their export to member countries of the Agreement on creation of the Free trade area within the Commonwealth of Independent States (CIS), and also to the countries with which the Republic of Moldova signed bilateral agreements about free trade customs authorities will certify goods origin according to the procedure established by the Rules of determination of the country of goods' origin approved by the Decision of Council of Heads of Government of the Commonwealth of Independent States (CIS) of November 20, 2009 according to the procedure established by Rules of determination of the country of goods' origin within bilateral agreements (further – Rules) and issue certificates of origin of goods of the ST-1 form according to the conditions established in these Rules.

7. The method of filling of forms of preferential certificates of origin of goods affirms Customs Service.

A. Certificate of movement of goods EUR.1

8. The certificate of movement of goods EUR.1 is the supporting document unambiguously testimonial of the country of goods' origin, exported to the states specified in Item 2.

9. The certificate of movement of goods EUR.1 represents the set consisting of three forms:

a) form of the original certificate of movement of goods EUR.1;

b) copy of the certificate of movement of goods EUR.1;

c) the application blank for the certificate of movement of goods EUR.1.

10. The certificate of movement of goods EUR.1 represents forms in English which are filled in with the exporter or his representative printing font by means of the printing device or by hand (ink and printing capital letters are used), in strict accordance with requirements of columns of the form of the certificate.

11. Certificates of movement of goods EUR.1 represent the forms which are specially numbered for the purpose of identification, produced by typographical method. The format of forms constitutes 210х297 mm with admissible error in relation to length and width in minus no more than 5 mm and in plus no more than 8 mm. The white paper with optimum parameters for records which is not containing mechanical cellulose and weighing at least 25 g/m2 is used. At the original of forms of certificates of origin there are signs of protection of green color thanks to which any possible mechanical or chemical falsification becomes noticeable with the naked eye.
