ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

of March 20, 2003 No. 325

About approval of the Regulations on activities of boundary representatives

(as amended of the Order of the Government of the Republic of Moldova of 12.12.2012 No. 925)

1. Approve Regulations on activities of boundary representatives it (is applied).

2. Boundary representatives are appointed the head of the department of Boundary police.

3. Permit the head of the department of Boundary police to involve in accordance with the established procedure the representative boundary device for implementation of representative boundary activities as experts and consultants of specialists of the ministries and departments, and also bodies of local public authority of border administrative and territorial units.

4. Determine that in case of release from post of the head of the department of Boundary police functions of the boundary representative of the Republic of Moldova are performed by person who is again appointed to this position, without adoption of the new order of the Government.

Regulations on activities of boundary representatives

I. General provisions

1. The Republic of Moldova performs cooperation with neighboring states in the field of protection of frontier on the basis of the principles of territorial integrity, respect for sovereignty and immunity of frontiers.

2. For the solution of the questions connected with observance of the mode of frontier and settlement of borderline cases on frontier from among boundary police officers the boundary representative device of the Republic of Moldova is created.

3. Activities of the boundary representative device of the Republic of Moldova are based on the Constitution of the Republic of Moldova, the Law No. 215 of November 4, 2011 on frontier of the Republic of Moldova, other regulations of the Republic of Moldova, international treaties of the Republic of Moldova, and also on this provision.

II. Organization of work of boundary representatives of the Republic of Moldova

4. The boundary representative of the Republic of Moldova appointed by the Government of the Republic of Moldova directs the boundary representative device.

5. The boundary representative of the Republic of Moldova appoints from among boundary police deputies (who are boundary representatives on sites of frontier) and the secretary.

6. Boundary representatives on sites of frontier have, in turn, the boundary representatives appointed to position and dismissed by the boundary representative of the Republic of Moldova for the offer on sites of frontier.

7. The government of the Republic of Moldova confers to the boundary representative of the Republic of Moldova powers in writing. The certificates signed by the boundary representative of the Republic of Moldova are issued to other boundary police officers performing boundary representational functions.

8. The boundary representative of the Republic of Moldova and personnel of the boundary representative device after their appointment are represented in diplomatic procedure (through the Ministry of Foreign Affairs and European Integration) to competent authorities of neighboring states.

9. The boundary representative of the Republic of Moldova sends the boundary representative of neighboring states the written message on position assignment and dismissal, and also on the location of personnel of the boundary representative device.

10. The common directorship and control of boundary representative activities is exercised by the Government of the Republic of Moldova.

11. The direct management of boundary representative activities is assigned to the boundary representative of the Republic of Moldova.

12. According to international treaties of the Republic of Moldova with neighboring states on frontier Items of reception-transmission of boundary representative correspondence, persons, animals and property are created.

13. Reception-transmission of boundary representative correspondence is performed constantly by the methods which are in advance approved between boundary representatives of the Republic of Moldova and neighboring states.

III. Main directions and tasks of activities of boundary representatives of the Republic of Moldova

14. The main activities of boundary representatives of the Republic of Moldova are:

a) ensuring immunity of frontier of the Republic of Moldova;

b) protection of political, territorial, economic and other interests of the Republic of Moldova on frontier;

c) creation of necessary conditions for strict observance of international treaties on boundary questions with neighboring states.

15. The main objectives of activities of boundary representatives of the Republic of Moldova are:

a) prevention of emergence of borderline cases and their fastest settlement;

b) the solution of the questions arising during the activities performed in border area by physical persons and legal entities of the Republic of Moldova and the adjacent states;

c) ensuring exact accomplishment by the public institutions, organizations, companies and citizens of the Republic of Moldova performing activities on frontier, international treaties on boundary questions with neighboring countries;

d) cooperation on boundary questions with authorities of the adjacent states and coordination of actions, joint with them;

e) protection of interests of physical persons and legal entities of the Republic of Moldova on frontier;

f) timely informing competent authorities of the Republic of Moldova on the facts of violation of the mode of frontier and the measures taken in these cases.

IV. Rights of boundary representatives of the Republic of Moldova

16. In case of accomplishment of the functions assigned to them boundary representatives of the Republic of Moldova have the right:

a) involve in accordance with the established procedure the boundary representative device for implementation of boundary representative activities as experts and consultants of specialists of the ministries, and also bodies of local public authority of border administrative and territorial units;

b) cross frontier at check points of frontier, and also out of check points by the rules established by international treaties of the Republic of Moldova with neighboring states;
