of March 25, 2002 No. 161

About the compensation applied in special conditions

(as amended on 28-05-2014)

For the purpose of implementation of Articles 164 and 224 of the Labor code of the Kyrgyz Republic, the Government of the Kyrgyz Republic decides:

1. Approve enclosed:

- Payment procedure of work, applied in special conditions;

- The standard list of works for which allowances to official pay rates working in special conditions can be established.

2. Recommend to all business entities to determine the list of workplaces with harmful or dangerous (especially harmful or especially dangerous) working conditions, on hard work, at works in the territories of radioactive infection, with indication of the amount of the increased compensation.

3. To the Ministry of Finance of the Kyrgyz Republic annually when forming the budget to provide means for the organizations and organizations financed from means of the government budget, according to the Payment procedure of work, applied in special conditions.

4. Publish this resolution in mass media.

5. To impose control over the implementation of this resolution on department of social development of Government office of the Kyrgyz Republic and the Ministry of Labour and the social Kyrgyz Republic of development.

Payment procedure of work, applied in special conditions

1. On hard work, at works with harmful or dangerous (especially harmful or dangerous) working conditions and at works in the territories of radioactive infection establish the increased compensation.

2. The list of workplaces with harmful or dangerous (especially harmful or dangerous) working conditions, on hard work, at works in the territories of radioactive infection (further - the List) is determined at the companies by the collective agreement if the collective agreement is not signed - the employer in coordination with trade-union or other representative body of employees of the company after carrying out certification of workplaces.

3. The list is annually reviewed taking into account the carried-out work on enhancement of the organization and working conditions, mechanization of manual work.

4. In elimination cases on workplaces of harmful production factors, improvements of working conditions, the corresponding work types from the Section with especially harmful or especially dangerous working conditions are transferred to the Section with harmful or dangerous working conditions, or carry them to works with normal working conditions.

5. Allowances for special working conditions are established as a percentage of official pay rates (tariff charges), depending on degree of harm of working conditions, but at least 15 percent at works with heavy and harmful working conditions and at least 30 percent - at works with especially heavy and especially harmful working conditions.

6. The increased compensation is established to workers if they are engaged at hard work, at works with harmful or dangerous (especially harmful or dangerous) working conditions and at works with impact of ionizing radiation at least 50 percent of working hours.

7. Heads and specialists have the right to the increased compensation in shops, on sites and productions where more than a half of workers receive allowances for special working conditions, in case of stay at least 50 percent of working hours in these shops, sites and productions.

8. To the workers allowed to temporary execution of positions on which the allowance is established this allowance it is paid for the period of replacement.

9. The allowance for work in special conditions does not join in rates (salaries).

10. The allowance for work in special conditions is considered in all cases in case of calculation of average monthly earnings.

the microscopic analysis using toxic immersion liquids and ultra-violet light sources;

assay analysis;

sample preparation;

chemical analysis.

7. Paintings in the enclosed space using nitropaints, varnishes and toxic solvents.

8. Open mining operations at the operational, experienced mountain companies under construction.

9. Handling works.

10. Underground mining operations.

11. Work in crushing shops on processing of geological tests.

12. Prospecting drilling on solid and liquid minerals and underground waters.

13. Repair of the prospecting and electrotechnical equipment.

14. Repair of the equipment installed on sites of the operating productions.

15. Welding works.

16. Land works.

17. Cargo transportation at exploration works.

18. Cold processing of metals.

19. Shops of covering of metals and enameling.

Mining and metallurgical industry

I. Works with heavy and harmful working conditions

1. Drilling-and-blasting works, leave, transportation and transferring of explosive materials, blasting agents.

2. Crushing and packaging of lime.

3. Charging and cleaning of rechargeable batteries.

4. Fixture of excavations.

5. Metal working.

6. Transportation of ore, breed and concentrates on cars.

7. Superficial works on the prevention and suppression of the underground fires, decontamination of coal layers, drilling of exploratory technical wells.

8. Product acceptance of non-ferrous metallurgy.

9. Production of rare-earth elements by chemical method from radioactive rare-earth raw materials.

10. Production of the titan and rare metals.

11. Washing of details and nodes in the course of precision etching.

12. Work in administrative and household buildings of mines, mines:

- production baths, shower;

23. Works on loading, transportation and delivery of ore and breed in underground conditions.

24. Works on receipt of rare metals and antimony.

28. Works on separation and recovery of rare-earth elements on furnaces by thermal method.

Servicing of pumps together with electric motors general capacity to 500 kW on pumping points and technological installations of bulk distribution lines, transshipment petroleum storage depots and the oil processing companies. Servicing of pumping and reservoir parks of sulphurous oils.

17. Servicing of processing equipment of sectional pumping points, block sectional pumping points and electrocentrifugal submersible installations on pumping fresh, highly mineralized sewage, water distribution devices, installations on collection and preparation of water. Maintenance of the set mode of pumping water in layer on each well. Installation and dismantle of the equipment. Processing by reagents of technological liquid (water) for the purpose of decrease in corrosion activity or increase in the petrowashed-away and petroforcing out properties.

18. Coloring of devices and details and varnishing using the nitropaints, nitrovarnishes and varnishes containing benzene, toluene, complex alcohols and other hazardous substances, manually, by method of okunaniye and spray, coloring of devices and details the shining paints.
