AGREEMENT BETWEEN THE REPUBLIC OF KAZAKHSTAN AND TURKMENISTAN

About differentiation of bottom of the Caspian Sea between the Republic of Kazakhstan and Turkmenistan

The Republic of Kazakhstan and Turkmenistan which further are referred to as with the Parties

aiming to provide favorable conditions for realization of the sovereign rights to development and use of resources of bottom and subsoil of the Caspian Sea,

in view of that the existing legal regime of the Caspian Sea does not meet modern requirements and does not regulate in full relation of the Caspian states,

calling the Caspian states for the fastest conclusion on the basis of their consensus of the Convention on legal status of the Caspian Sea,

being guided by the principles and rules of international law,

convinced that this agreement will promote further strengthening of neighborliness and development of mutually beneficial and equal cooperation between the Parties,

agreed as follows:

Article 1

The bottom and subsoil of the Caspian Sea are differentiated between the Parties on the line which is under construction on the basis of the median line taking into account the principles and rules of international law, and also by agreement of the Parties (further - the line of demarcation).

Article 2

For creation of the line of demarcation of the Party proceeded from the average long-term level of the Caspian Sea equal to mark minus 28 meters of the Baltic system of 1977 of heights concerning zero Kronshtadsky tide gage.

Coordinates of rotary points of the line of demarcation are determined on the basis of the cartographic materials approved by the Parties in system of coordinates of 1942 and enshrined in the Catalogue of geographical coordinates of rotary points of the line of demarcation (Appendix 1).

The initial point No. 1 of the line of demarcation is the border point No. 13, specified in Appendix 1 to the Contract between the Republic of Kazakhstan and Turkmenistan about delimitation and process of demarcation of the Kazakhstan-Turkmen frontier of July 5, 2001.

The line of demarcation passes across the geodetic lines connecting the rotary points specified in Appendix 1 to this agreement.

Final point of the line of demarcation will be the point of joint of the lines differentiating sites of bottom of the Caspian Sea between the Republic of Kazakhstan, Turkmenistan and the Azerbaijan Republic which will be defined by the separate international treaty.

The line of demarcation is applied on the Scheme of the line of demarcation of sites of bottom and subsoil of the Caspian Sea approved by the Parties between the Republic of Kazakhstan and Turkmenistan (Appendix 2).

Appendices to this agreement are its integral part.

Article 3

Within the sites of bottom of the Party according to the international and national environmental standards, requirements and standards perform the sovereign rights for the purpose of investigation, development and use of resources of bottom and subsoil of the Caspian Sea, laying of underwater cables and pipelines on bottom of the Caspian Sea, creation of artificial islands, берм, dams, platforms, platforms and other engineering constructions, and also other lawful economic economic activity at the bottom.

Questions of investigation and development of perspective structures and fields in case of passing of the line of demarcation through them will be subject of free standing agreements between the Parties.

Article 4

Disagreements in interpretation and application of provisions of this agreement are permitted by consultations and negotiations or other peaceful means at the choice of the Parties.

Article 5

This agreement does not interfere with achievement of consensus of the Caspian states on legal status of the Caspian Sea and can be considered by the Parties as part of their general arrangements.

The line of demarcation can be accepted for delimitation between the Parties of sea belts to which their sovereignty and jurisdiction, according to arrangements of the Caspian states on legal status of the Caspian Sea extend.

Article 6

By mutual consent of the Parties changes and additions which are drawn up by the separate protocols which are integral part of this agreement and becoming effective according to the procedure, determined by Article 7 of this agreement can be made to this agreement.

Article 7

This agreement is termless and becomes effective from the date of receipt through diplomatic channels of the last written notice of its ratification.

It is made in the city ___________ "__" 20 ________ years in duplicate, everyone in the Kazakh, Turkmen and Russian languages, and all texts are equally authoritative. In case of disagreements in interpretation of provisions of this agreement, the Parties will use the text in Russian.
