According to the Law of the Republic of Uzbekistan "About realtor activities", resolutions of the Cabinet of Ministers of the Republic of Uzbekistan of May 10, 2011 "About approval of the Regulations on licensing of realtor activities" and of December 30, 2012 No. 374 "About measures for the organization of activities of the State committee of the Republic of Uzbekistan for privatization, demonopolization and development of the competition" the State committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition decides No. 129:

1. Approve the National standard of realtor services of the Republic of Uzbekistan (NSRU No. 2) "Information and consulting services in the real estate market" according to appendix.

2. This Resolution becomes effective from the date of its official publication.

Information and consulting services in the real estate market

This National standard of realtor services (NSRU No. 2) "Information and consulting services in the real estate market" (further - the standard) according to the Law of the Republic of Uzbekistan "About realtor activities" and the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 10, 2011 No. 129 "About approval of the Regulations on licensing of realtor activities" determines requirements imposed to the realtor activities performed by rendering information and consulting services in the real estate market.

Chapter 1. Basic concepts

1. For the purpose of this standard the following basic concepts are used:

information and consulting services (further - IKU) - the type of the realtor services rendered in the real estate market by the realtor organizations and realtors (individual entrepreneurs) on contractual basis including providing the customer with information on real estate objects and the rights to them about the analysis and the forecast of market situation of the real estate and his participants, about environment of this market, regulatory legal acts in the field of the real estate market, and also the organization of distribution of advertizing of real estate objects, recommendations about the choice of the parties in the transaction;

internal regulations - the documents determining the requirements to implementation of realtor services approved by the realtor organization for the purpose of ensuring increase in efficiency of implementation of realtor activities and its compliance to requirements of the legislation on realtor activities;

the agreement on rendering IKU - the agreement owing to which one party shall render IKU in the caused time and other party shall accept services and pay them;

the contractor - the realtor organization or the realtor (individual entrepreneur) who obtained in the procedure established by the legislation the license for the right of implementation of realtor activities which entered contractual relations with the customer for rendering the services specified in the agreement rendering IKU;

the customer - physical person or legal entity, entered contractual relations with the contractor, for receipt of the services specified in the agreement rendering IKU, and also undertaken to pay these services;

consolidation - the merging of the realtor organizations or realtors created in the procedure established by the legislation for the purpose of representation and protection of common interests;

the real estate - land areas, subsoil, buildings, constructions, long-term plantings and other property firmly connected with the earth that is objects which movement without disproportionate damage to their assignment is impossible;

real estate object - the specific land area, the building, construction and other property firmly connected with the earth, the transactions which are subject.

Chapter 2. General provisions

2. Tasks of the standard is establishment of conditions and procedure for rendering by the realtor organizations and realtors (individual entrepreneurs) of IKU in the real estate market, the single requirements to their structure, quality, execution of documentation regulating process of provision of these services.

3. The standard is obligatory for application by the realtor organizations and realtors (individual entrepreneurs) when rendering IKU.

Chapter 3. Content of services

4. IKU in the real estate market appear for the purpose of assistance to protection of interests of customers of realtor services by their providing with up-to-date, objective and reliable information about the real estate market.

5. IKU appear for use in the subsequent transactions connected with purchase and sale, hiring (lease), pledge, exchange, donation, rent, transfer to trust management, the organizations of the biddings, free use of real estate object or alienation of real estate object with condition of the perpetual maintenance and also for carrying out analytical and marketing researches of the real estate market.

6. IKU include the questions connected with:

acquaintance of the customer with all regulatory legal acts regulating realtor activities;

rules and features of transactions on alienation of real estate object;

procedure for the conclusion of agreements;

state registration of the property right;

recommendations about the choice of the parties in real estate transaction;

general information about the technical condition of real estate object, its technical and operational characteristics and consumer qualities influencing its cost and liquidity;

the current market prices of the real estate objects interesting the customer, dynamics of their change, potential benefits from the transaction with real estate object at present or at some point in the future;

cost of services in preparation of necessary document package;

development of professional consulting projects on creation and object management of the real estate;

the organization of advertizing of real estate object from name and for the benefit of the customer;
