1. Approve the enclosed Rules of development and application of safety management systems of flights of air vehicles, and also collection and data analysis about the factors of danger and risk creating safety hazard of flights of civil air vehicles, storages of these data and exchange of them.

2. Determine that realization by the Ministry of Transport of the Russian Federation and Federal Air Transport Agency of the powers provided by this resolution is performed in the limits set by the Government of the limiting Russian Federation of number and salary fund of employees of the Ministry of Transport of the Russian Federation, central office and territorial authorities of Federal Air Transport Agency, and also the budgetary appropriations provided by it in the federal budget on management and management in the field of the established functions.

3. This resolution becomes effective in 360 days from the date of its official publication.

Rules of development and application of safety management systems of flights of air vehicles, and also collection and data analysis about the factors of danger and risk creating safety hazard of flights of civil air vehicles, storages of these data and exchange of them

1. These rules establish procedure for development and application of safety management systems of flights of air vehicles by legal entities - the developers and manufacturers of civil air vehicles, legal entities and individual entrepreneurs performing commercial air transportations, the legal entities performing maintenance of civil air vehicles, aeronautical servicing of flights of air vehicles, the educational organizations and the organizations performing training of pilots of civil air vehicles, operators of the certified airfields of civil aviation concerning air vehicles, development, production, operation or servicing of which is performed by the specified legal entities, individual entrepreneurs, educational institutions (further - service providers), and also procedure Federal Air Transport Agency of collection and data analysis about the factors of danger and risk creating safety hazard of flights of civil air vehicles, storages of these data and exchange of them according to international standards of International Civil Aviation Organization.

2. The terms used in these rules mean the following:

"the state safety management system of flights" - set of the actions for identification of potential and actual factors of danger, for risk assessment of their manifestation, for development and acceptance of the corrective actions necessary for maintenance of acceptable level of aviation safety, for efficiency evaluation of measures for safety management of flights of civil air vehicles performed at the national level;

"risk" - the predicted probability and weight of effects of manifestation of one or several factors of danger;

"safety management system of flights of service providers" - set of the actions for identification of potential and actual factors of danger, for risk assessment of their manifestation, for development and acceptance of the corrective actions necessary for maintenance of acceptable level of aviation safety, for efficiency evaluation of measures for safety management of flights performed by the service provider;

"danger factor" - the result of action or failure to act, circumstance, condition or their combination influencing aviation safety of civil air vehicles.

3. The service provider creates safety management system of flights taking into account the tasks solved by him by means of the development and document approval determining:

a) obligations of service employees of the service provider on the organization and ensuring functioning of safety management system of flights of the service provider;

b) the list of data in the field of aviation safety, procedure for their accounting and storage;

c) data sources for receipt of data in the field of aviation safety;

d) procedure for identification of factors of danger;

e) procedure for data collection about danger factors;

e) procedure for data analysis about factors of danger and evaluating risk;

g) procedure for development of actions for decrease in risk;

h) procedure for providing with organizational and financial resources of actions for decrease in risk;

i) evaluation procedure of efficiency of the realized actions for decrease in risk.

4. The service provider develops the plan of implementation of safety management system of flights of the service provider including assignment of the employees responsible for aviation safety, and establishment of their obligations, responsibility and powers.

5. The service provider according to the documents specified in Item 3 of these rules:

a) performs collection and data processing about danger factors;

b) carries out the analysis of the revealed factors of danger and risk assessment;

c) performs development and implementation of actions on decrease in risk;

d) carries out efficiency evaluation of functioning of safety management system of flights of the service provider;

e) makes decisions on modification of safety management system of flights of the service provider.

6. The service provider represents to Federal Air Transport Agency the dangers this about factors and risk which structure and format is established by the Ministry of Transport of the Russian Federation.

7. Within the state safety management system of flights sources of information are:

a) the dangers this about factors and risk;

b) information on technical condition of aviation engineering and on features of its operation;

c) results of holding supervising actions behind execution of the air legislation of the Russian Federation;

d) results of investigation of aviation events;

e) the messages on the actual or potential shortcomings and difficulties in safety-of-life function directed by legal entities and physical persons on their initiative (further - voluntary messages).

8. The Federal Air Transport Agency receives:

a) the dangers this about factors and risk - from the service providers performing commercial air transportations, maintenance of civil air vehicles, aeronautical servicing of flights of air vehicles and training of pilots of civil air vehicles on paper, electronic media or by means of the Internet in the format established by the Ministry of Transport of the Russian Federation;
