For the purpose of ensuring accomplishment of Art. 147 of the h. (61) and (62) the Law No. 171 of 11.07.2012 "About the capital market" (The official monitor of the Republic of Moldova, 2012, No. 193-197, the Art. 665), with subsequent changes, based on Art. 1 of the h. (1), Art. 3, Art. 8 b) and e), Art. 9 of the h. (1) item d), Art. 25 of the h. (2) the Law No. 192-XIV of 12.11.1998 "About the National commission on the financial market" (it is repeatedly published in the Official monitor of the Republic of Moldova, 2007, No. 117-126 BIS) the National commission on the DECIDES: financial market

1. Order to the professional participants of the security market and issuers owning the license for implementation of activities for maintaining the register:

1.1. Transfer to the National commission on the financial market electronically via safe channels of transportation:

a) electronic copies of registers of owners of the securities which are in system of maintaining the register, using digital key, according to the schedule established in appendix No. 1;

b) all changes entered in registers of owners of securities throughout the working day, using digital key, since next day after execution of item 1.1 of subitem of a), daily till 18:00 for the corresponding day.

1.2. Data transmission according to item 1.1 of subitem of a) will be accompanied by the Declaration under the personal liability on the integrity, correctness and accuracy of the data containing in the transferred electronic copy of registers of owners of securities according to appendix No. 2.

1.3. Connect the Internet on cable for ensuring the continuous information transfer provided in item 1.1 of subitem of b.

2. The safe channel of transportation of the owners of securities this between system of maintaining the register and appendix on the server of the National commission on the financial market which will provide storage of information transferred according to the item 1, is created by the National commission on the financial market.

3. Digital keys of access to the safe channel of transportation of data will be transferred by the National commission on the financial market to the authorized faces of professional participants of the security market and the issuers owning the license for implementation of activities for maintaining the register in temporary use based on the act of acceptance transfer with the obligation to return these keys in case of the activities termination.

4. The professional participants of the security market and issuers owning the license for implementation of activities for maintaining the register within 30 days from the effective date of this resolution will provide to the National commission on the financial market for each issuer of securities the Card containing information on the agreement on maintaining the register, on the independent registrar signed with the issuer from which the register, about the discrepancies existing in the register at the time of transfer of its electronic copy, and also information established throughout the period of maintaining the register, etc. was received.

5. To impose control over execution of this resolution on general management of supervision of securities, general management of legal assistance, management of information technologies both general financial and economic and managerial control.

6. This resolution becomes effective from the date of publication.
