Regulations on Government commission on increase in competitiveness and regulation of the alcoholic market

1. Government commission on increase in competitiveness and regulation of the alcoholic market (further - the Commission) is the coordinating body formed for ensuring coordinated actions of federal executive bodies, executive bodies of subjects of the Russian Federation for the purpose of development of measures for enhancement of economic methods of regulation of production and turnover of alcoholic products, legal and market mechanisms of development of the competition in this sphere on counteraction to illegal production and turnover of ethyl alcohol, alcoholic and alcohol-containing products, including illegal retail sale of alcoholic products, and violation of requirements of the antitrust law of the Russian Federation.

2. The commission is guided in the activities by the Constitution of the Russian Federation, the Federal constitutional Laws, the Federal Laws, decrees and orders of the President of the Russian Federation, resolutions and orders of the Government of the Russian Federation, and also this Provision.

3. The main objective of the Commission is coordination of activities of federal executive bodies and executive bodies of subjects of the Russian Federation on questions:

a) monitoring of market situation of alcoholic products and efficiency evaluation of measures of state regulation in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products;

b) development and taking measures to realization of state policy in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products;

c) development and taking measures to the prevention and suppression of illegal production and turnover of ethyl alcohol, alcoholic and alcohol-containing products;

d) developments of offers on increase in competitiveness and enhancement of normative legal regulation in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products;

e) implementation of the complex analysis of the criminogenic situation developing in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products, and observance of requirements of the antitrust law of the Russian Federation for the purpose of determination of the priority directions requiring collateral actions of federal executive bodies and executive bodies of subjects of the Russian Federation on strengthening of state regulation in the field;

e) developments and considerations of the course of coordination of drafts of the Federal Laws and other regulatory legal acts in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products;

g) interactions of federal executive bodies when holding the actions for control directed to counteraction to illegal production and turnover of ethyl alcohol, alcoholic and alcohol-containing products including to illegal retail sale of alcoholic products, and violation of requirements of the antitrust law of the Russian Federation;

h) generalization of practice of interaction of federal executive bodies and executive bodies of subjects of the Russian Federation on state regulation in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products and development of the competition in the field.

4. The commission for accomplishment of the tasks assigned to it:

a) considers offers on implementation of measures of state regulation in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products;

b) provides carrying out efficiency analysis of measures of state regulation of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products, preparation on its basis of relevant proposals, including the offers requiring solutions of the President of the Russian Federation and (or) the Government of the Russian Federation;

c) informs the Government of the Russian Federation on the course of activities of the Commission, results of realization by federal executive bodies and executive bodies of subjects of the Russian Federation of decisions of the Commission, and also on market situation of alcoholic products.

5. The commission has the right:

a) request in accordance with the established procedure from federal executive bodies and executive bodies of subjects of the Russian Federation, local government bodies and the interested organizations materials and information on the questions which are within the competence of the Commission;

b) create the working groups on the questions carried to competence of the Commission;

c) make in accordance with the established procedure offers on the questions requiring the solution of the President of the Russian Federation and the Government of the Russian Federation;

d) hear at the meetings representatives of federal executive bodies and executive bodies of subjects of the Russian Federation on the questions carried to competence of the Commission;

e) make decisions on the questions carried to competence of the Commission;

e) exercise control of implementation of offers and decisions of the Commission.

6. The structure of the Commission affirms the Government of the Russian Federation.

The commission chairman directs its activities and bears responsibility for accomplishment of the tasks assigned to the Commission.

The responsible secretary of the Commission will organize carrying out commission session, creates the agenda of meeting, informs members of the commission on the regular meeting, and also takes and draws up the protocol of its meeting.

7. The commission performs the activities according to the plan approved by the commission chairman.

Commission sessions are held by the commission chairman or according to its order the vice-chairman of the Commission.
