No. 131-133, 425) DECIDES: the Government

1. Found the government electronic service of recording (MLog) which is property of the state.

2. Approve Regulations on government electronic service of recording (MLog) it (is applied).

3. Appoint:

1) Public organization "Agency of Electronic Control" as the owner of government electronic service of recording (MLog);

2) Public organization "Service of Information Technologies and Cybernetic Safety" as the technical administrator of government electronic service of recording (MLog).

4. To the ministries, the State office, other central administrative authorities and organizational structures subordinated to the Government which are in the sphere of their competence (subordinated administrative authorities, deconcentrated and subordinated public services, and also public organizations in which the ministry, the State office or other central administrative authority acts as the founder), autonomous public organizations, and also the legal entities of private law who are providing public services within competence, stipulated by the legislation, and having information systems:

To integrate 1) by own financial means government electronic service of recording (MLog) into the new information systems including developed;

2) in 9-month time from the date of publication of this Resolution to develop and approve in case of obligatory coordination with Public organization "Agency of Electronic Control" plans for integration of the existing information systems with government electronic service of recording (MLog). Integration of the existing information systems according to the approved plans for integration will be performed on the basis of the agreements signed between Public organization "Agency of Electronic Control" and the owner of the corresponding system;

3) to plan the financial resources necessary for integration of the existing information systems with government electronic service of recording (MLog) according to the approved plans of integration;

4) it is free to use government electronic service of recording (MLog).

5. Other public bodies and organizations, except noted in item 4 of this Resolution, including bodies of local public authority, and also physical persons and legal entities of private law can use free of charge government electronic service of recording (MLog) according to this resolution.

6. Ceased to be valid according to the Order of the Government of the Republic of Moldova of 13.10.2021 No. 239

6-1. To public organization "Agency of Electronic Control":

1) to provide implementation, functioning and continuous development of government electronic service of recording (MLog);

2) to provide free provision of government electronic service of recording (MLog) to the subjects specified in items 4 and 5;

3) to approve contractual conditions of use of government electronic service of recording (MLog) and the corresponding rules of use.

7. Ceased to be valid according to the Order of the Government of the Republic of Moldova of 13.10.2021 No. 239

8. For the purpose of implementation of this resolution of the State office together with public organization "Agency of Electronic Control" annually to estimate the costs necessary for administration and continuous development of government electronic service of recording (MLog) and to make to the Ministry of Finance offers on request of financial resources, according to provisions of the Law No. 181/2014 on public finance and budget and tax responsibility, for their inclusion in the law on the government budget for the corresponding year.

9. To impose control over the implementation of this Resolution on the State office.

Regulations on government electronic service of recording (MLog)

Chapter I. General provisions

1. The regulations on government electronic service of recording (MLog) (further – the Provision) establish functions of government electronic service of recording (MLog), determine powers of participants of this service and provide requirements for safety of information and personal data protection within the service MLog.

2. For the purposes of this provision the following concepts are used:

government electronic service of recording (MLog) (further – the service MLog) – the centralized, reusable service placed on general government technological framework (MCloud) which purpose consists in providing the safe and flexible mechanism of recording and audit, with ensuring accounting of events in the context of use of information systems;

event – any transaction performed in information system in certain time;

the event which is subject to recording – any event which can entail legal consequences or which the owner of information system considers important proceeding from the purposes;

flow of events – class of events, similar from the point of view of audit;

the subject of event – subject or person whom the event concerns directly;

audit – method of the analysis and assessment of one or several flows of events for the purpose of interpretation and/or decision making about compliance of use of information systems to the purposes and interests of their obladetel and users or to legislation provisions;

recording – the acceptance used by information systems for registration of events, including date and time when there was event, activity undertaken, and also other details characteristic of event which completely describe it so that to meet the auditor requirements of owners of information systems and users of the service MLog;

participants of the service MLog – the owner of the service MLog, the administrator of the service MLog, the technical administrator of the service MLog, owners of the information systems integrated with the service MLog, users of the service MLog;

the owner of the service MLog – the public organization appointed by the Government in which use there is service MLog;

the administrator of the service MLog – person designated by the owner of the service MLog who has access to all functionality of system for the purpose of management of the service MLog, but without the right to change or delete the recorded events, except as specified, stipulated by the legislation;

the technical administrator of the service MLog – person who provides technical administration of technological framework of the service MLog;
