Rules of realization of the right of the officers passing military service under the contract on training in the civil professional educational organizations or the civil educational organizations of the higher education and on preparatory departments of such educational organizations of the higher education with development of educational programs on intramural and extramural or extramural studies

1. These rules regulate according to paragraph one of Item 2 of article 19 of the Federal law "About the Status of the Military Personnel" the questions connected with realization of the right of the officers passing military service under the contract (further - officers), on training in the civil professional educational organizations or the civil educational organizations of the higher education and on preparatory departments of such educational organizations of the higher education with development of educational programs on intramural and extramural or extramural studies.

2. The document confirming the right of officers to educational leaves and other social guarantees for passing of entrance tests in case of acceptance on training and during training in the educational organizations (further - educational leaves and other social guarantees), is the reference challenge granting the right to provision of guarantees and compensations to the workers combining work with education in the form approved by the Ministry of science and the higher education of the Russian Federation in coordination with the Ministry of Public Education of the Russian Federation.

3. Educational leaves and other social guarantees are provided to officers in case of education of appropriate level for the first time, and also to the officers directed to training by federal executive body (federal state body) in which the Federal Law provides military service.

4. Officers are granted educational leaves for passing:

a) entrance tests in case of receipt in the civil professional educational organizations - 10 calendar days;

b) entrance tests in case of receipt in the civil educational organizations of the higher education - 15 calendar days;

c) final assessment on preparatory departments of the civil educational organizations of the higher education - 15 calendar days.

5. The officers who are successfully mastering educational programs of secondary professional education for intramural and extramural and correspondence forms of education are granted educational leaves for passing:

a) intermediate certification on the first and second rates - for 30 calendar days, on each subsequent rate - for 40 calendar days;

b) State Final Examination - up to 2 months according to the curriculum of the mastered educational program of secondary professional education.

6. The officers who arrived in the civil educational organizations of the higher education on training in programs of bachelor degree, programs of specialist programme or programs of magistracy in intramural and extramural and correspondence forms of education and successfully mastering these programs are granted educational leaves for passing:

a) intermediate certification on the first and second rates - for 40 calendar days, on each subsequent rate - for 50 calendar days (in case of development of educational programs of the higher education in the reduced terms on the second year - 50 calendar days);

b) State Final Examination - up to 4 months according to the curriculum of the mastered educational program of the higher education.

7. To the officers who are at the same time studying in 2 and more educational organizations, educational leaves and other social guarantees are provided only in connection with training in one of the educational organizations (at the choice of the officer).

8. In case of impossibility of timely arrival of the officer for passing of intermediate or final assessment in connection with its participation in doctrines, campaigns of the ships and other actions which list is determined by heads of federal executive bodies (federal state bodies) in whom the Federal Law provides military service the educational organization gives to the officer opportunity of passing of certification in other time.

The basis for transfer of time of passing of intermediate or final assessment is the reference confirming participation of the officer in the specified actions, the officer issued by the commander of military unit (the military prosecutor, the head of military investigating body of the Investigative Committee of the Russian Federation), in which passes military service.

9.
