Chapter 1. General provisions

1. These rules of release of material values from the state material reserve according to the procedure of refreshening and razbronirovaniye (further - Rules) are developed according to Item 9 of article 94 of the Law of the Republic of Kazakhstan "About civil protection" (further - the Law "About Civil Protection") and determine procedure for release of material values from the state material reserve according to the procedure of refreshening and razbronirovaniye, except as specified their release for taking measures to the prevention and liquidation of emergency situations and their consequences, rendering the regulating impact on the market, the help to refugees, the humanitarian assistance, transfer on balance to other state bodies.

2. In Rules the following concepts are used:

1) current price - the price of object of sale developing during the auction;

2) the initial price - the price of object of sale determined according to Item 13 of these rules;

3) auction - form of the biddings in case of which participants declare the offers publicly, carried out with use of the web portal of the register in electronic format;

4) the salesroom - the Section of the web portal of the register providing possibility of input, storage and the information processing necessary for holding the auction;

5) auction number - number assigned to the participant for participation in auction in the presence of the digital signature;

6) auction on advance in price - method of auction in case of which the starting price raises with in advance announced step;

7) auction on reduction in price - method of auction in case of which the starting price goes down with the announced step;

8) the starting price - the price with which the auction or the closed tender for object of sale begin;

9) minimum price - the price below which object of sale cannot be sold;

10) the closed tender - the tender in which the limited circle of participants takes part;

11) the winner - the participant of auction or the closed tender who offered top price for object of sale;

12) the guarantee fee - the sum of money in the amount of 15% of starting price of object of sale granted by the physical or non-state legal entity for participation in auction or the closed tender, but no more 30000-fold monthly settlement indicator;

13) the participant - the physical person or legal entity registered in accordance with the established procedure for participation in auction or the closed tender;

14) laying of material values in the state material reserve (further - bookmark) - acceptance of material values for storage in the state material reserve;

15) the subordinated organization of system of the state material reserve (further - the subordinated organization) - the legal entity performing storage of material values of the state material reserve;

16) authorized body in the field of the state material reserve (further - authorized body) - the central executive body performing executive and control functions, and also management of system of the state material reserve;
