Regulations on the Sales representative of Ukraine

1. The sales representative of Ukraine on position is the deputy minister of development of economy, trade and agricultural industry.

The position of the deputy minister of development of economy, trade and agricultural industry - the Sales representative is entered within the extreme number of employees of Ministry of Economics.

The deputy minister of development of economy, trade and agricultural industry - the Sales representative (further - the Sales representative) directly submits to the Minister of development of economy, trade and agricultural industry.

2. The sales representative is appointed to position and dismissed by the Cabinet of Ministers of Ukraine on representation of the Prime Minister of Ukraine according to proposals of the Minister of development of economy, trade and agricultural industry.

3. The sales representative in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, this Provision and orders of Ministry of Economics.

The main objectives of the Sales representative is ensuring promotion of economic interests of Ukraine in the European and world market, implementation within the powers of coordination of activities of the trade missions as a part of foreign diplomatic organizations of Ukraine.

4. The sales representative according to the tasks assigned to him provides:

1) carrying out analysis:

condition and tendencies of international trade, development of offers concerning priorities, the main directions of development and forming of trade policy of Ukraine, ensuring interaction of executive bodies on the specified questions;

impacts of instruments of trade protection on trade development, development of offers on increase in efficiency of its use for achievement of economic growth;

2) accomplishment of tasks concerning economic cooperation of Ukraine with the EU and development of suggestions for improvement of the mechanism of interaction with institutes of the EU;

3) development in accordance with the established procedure offers and the organization of accomplishment of the made decisions for forming and realization of the external economic policy;

4) carrying out monitoring of accomplishment by members of the WTO of obligations within the WTO for the purpose of ensuring protection of the rights and interests of Ukraine;

5) representation of Ukraine in the WTO, the Black Sea bank of trade and development and other international economic organizations;

6) preparation in accordance with the established procedure offers concerning participation of Ukraine in activities of the relevant international economic organizations, and also about appointment of representatives of Ukraine in such organizations and determination of national coordinators on cooperation with them;

7) participation in:

coordination of accomplishment by the Ukrainian Side of obligations according to international treaties of Ukraine from the EU and the negotiations aimed at providing development of contractual relations from the EU concerning trade and economic cooperation with the EU;

to work of bilateral bodies of format Ukraine - the EU, formed within international treaties;

8) coordination of activities of executive bodies concerning functioning of the Ukrainian part of the bilateral commissions, committees, coordination councils and other intergovernmental authorities concerning trade and economic cooperation including created according to free-trade agreements, in particular Committee on questions of trade and the relevant subcommittees in format Ukraine - the EU;

9) development of offers on implementation of new forms of cooperation with foreign states for the purpose of improvement of trade and economic cooperation with them;

10) implementation of coordination of negotiations between Ukraine and other states according to the conclusion of free-trade agreements, interaction of other central executive bodies for preparation of line item of Ukraine in such negotiations, and also preparation of economic cases concerning such agreements;

11) carrying out:

negotiations within the WTO and interaction of the central executive bodies concerning participation in multilateral trade negotiations of the WTO, bilateral and multilateral negotiations within the working groups on consideration of requests of the states joining WTO, meetings of councils, committees and all other bodies of the WTO;

permanent monitoring of development of foreign economic relations, efficiency analysis of export and commodity import and services, development and implementation of actions for development and enhancement of structure of export and commodity import and services, development of recommendations for the corresponding industries of economy taking into account tactical changes in the world market;

12) within the powers adaptation of the legislation of Ukraine to the legislation of the EU;

13) participation in development of offers on harmonization of regulatory legal acts and regulating documents of Ukraine with the international, including European rules and standards which determine requirements in the sphere of trade in goods and services;

14) conducting examination of drafts of regulatory legal acts on compliance to regulations of agreements of the WTO and to obligations of Ukraine as member of the WTO;

15) participation in upholding of trade and economic interests within the CIS, GUAM and with the countries of EurAsEC and Customs union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation;

16) interaction:

central and local executive bodies on development of bilateral cooperation with foreign states in the trade and economic sphere;

concerning implementation of trade and economic provisions of the Agreement on association between Ukraine, on the one hand, and European Union, European Atomic Energy Community and their state members, on the other hand;

the central executive bodies, connected with creation of the free trade area between Ukraine and the EU, and also concerning accomplishment of the obligations of Ukraine undertaken within accession to WTO, reduction of the legislation of Ukraine in compliance with regulations of agreements of the WTO;

the central executive bodies concerning processing of requests of the WTO and state members of the WTO and their informing, and also cooperation with the relevant committees of the WTO;

the central executive bodies concerning development and accomplishment of bilateral trade agreements of Ukraine;

17) implementation of actions for providing in accordance with the established procedure protection of the economic rights and legitimate interests of Ukraine, her subjects;
