About the basic principles of cooperation in the field of transport

The government of the Republic of Belarus and the Government of Turkmenistan which are hereinafter referred to as with the Parties

considering importance of development of trade and economic cooperation between two states,

being guided by aspiration to further development of cooperation in the field of transport,

recognizing that effective functioning of transport is the most important factor of ensuring development of economy of the states of the Parties,

wishing to develop all modes of transport on the basis of reciprocity and aiming to provide favorable conditions for simplification of implementation of freight and passenger traffic between both states, and also transit across their territories to the third countries,

confirming the cross international liabilities which are earlier assumed by the Parties in the field of transport,

agreed as follows:

Article 1

The parties will develop and deepen mutual economic and sci-tech cooperation in the field of transport.

Article 2

Each of the Parties will provide in the territory, according to the legislation of the states of the Parties and on the principles of reciprocity, favorable conditions for functioning of all modes of transport of other Party transporting passengers and loads between both Parties and transit across their territories.

The procedure for the organization of transportations of passengers and loads by railway, air, sea, river and road transport between both states and transit across their territories will be determined on the basis of the international treaties signed between the Parties.

Article 3

The parties will promote development of direct commercial ties of transport enterprises and organizations of both states and creation of joint businesses in the field of transport.

The parties will help cooperation of the companies of both states in the field of production and repair of vehicles.

Article 4

The parties will notify each other on the changes in the conditions of activities of transport in the state infringing on interests of other Party.

Article 5

For the purpose of ensuring accomplishment of this Memorandum of understanding, and also in case of difficulties in transportations between both states, the relevant ministries and departments of the Parties will perform direct contacts and to hold, as required, bilateral meetings for development of mutually acceptable decisions.

Article 6

All matters of argument which can arise in connection with interpretation and accomplishment of individual clauses of this Memorandum of understanding will be permitted by the Parties by negotiations and consultations.

Article 7

This Memorandum of understanding does not mention obligations assumed by the Parties according to other international treaties which participants they are.

Article 8

This Memorandum of understanding becomes effective from the date of its signing.

This Memorandum of understanding consists for the five-year period and is automatically prolonged for the subsequent five-year periods if any of the Parties does not send to other Party through diplomatic channels the written notice of its intention to stop this Memorandum of understanding. In this case this Memorandum of understanding will be stopped after six months from the date of receipt of the notification of other Party on the termination.

From the effective date this Memorandum of understanding is terminated by the Agreement between the Government the Republic of Belarus and the Government of Turkmenistan about the basic principles of relations in the field of transport signed in Minsk on February 17, 1993.

It is made in the city of Minsk on October 8, 2014 in two authentic copies, everyone in the Russian and Turkmen languages, and both texts are equally authentic. In case of disagreements in interpretation of this Memorandum of understanding of the Party will be guided by the text in Russian.
