Rules of turnover of military person-portable small arms and ammunition to it, and also cold weapon

1. General provisions

1. These rules regulate turnover of military person-portable small arms and ammunition to it, and also cold weapon (further - military weapon), including production, assembly, alteration, realization (trade), transfer, rewarding, acquisition, exhibiting, accounting, storage, storage and carrying, transportation and use of military weapon.

2. The weapon intended for the solution of fighting and operational and office tasks, accepted according to regulatory legal acts of the Government of the Republic of Kazakhstan on arms the subjects having right to use arms and military equipment according to the legislation of the Republic of Kazakhstan belongs to military weapon (further - the subjects having right to use military weapon).

5. The legal entities performing production of military weapon shall:

2) to ensure safety of production, accounting, safety and to exercise control over quality of products.

6. Each unit of the made military weapon shall have individual number.

7. The military weapon removed from arms (supply) of the subjects having right to use military weapon and also become useless is subject to write-off with execution of the relevant act.

8. The statement of write-off of military weapon is drawn up by the interdepartmental commission which structure is determined according to regulatory legal acts of the subjects having right to use military weapon then it is submitted for consideration of the Military and technical commission under the Ministry of Defence of the Republic of Kazakhstan for development of the offer on realization or utilization of military weapon.

9. Work on destruction (utilization) of written off military weapon is performed by the legal entities authorized by the Government of the Republic of Kazakhstan in coordination with the subjects having right to use military weapon on contractual basis.

3. Sale, transfer of military weapon

10. The subjects having right to use military weapon can sell the military weapon which is armed at them to persons having licenses for acquisition of weapon, and also for realization (trade) of civil and office weapon with the prior notice of it of law-enforcement bodies in the place of accounting of weapon. At the same time the sold military weapon shall correspond on the key parameters, characteristics to parameters of civil or office weapon.

13. The subjects having right to use military weapon can sell the civil and office weapon which is at them on legal causes and cartridges to it to the legal entities having licenses for realization (trade) in civil and office weapon with the prior notice of it of law-enforcement bodies in the place of accounting of weapon.

14. The subjects having right to use military weapon make transfer of the military weapon which is at them on arms to other subjects having right to use military weapon based on the decision of the Government of the Republic of Kazakhstan.

By transfer of military weapon the subjects having right to use military weapon are guided by regulatory legal acts of those subjects having right to use military weapon from which the military weapon is transferred.

4. Procedure for rewarding with military weapon

15. Rewarding with military weapon, except for firing queues and having shop (drum) more than 10 cartridges, and also prohibited to turnover in the territory of the Republic of Kazakhstan, is performed based on the Presidential decree of the Republic of Kazakhstan, the order of the Government of the Republic of Kazakhstan, prize papers of Chapters of foreign states, Chapters and members of the Governments of foreign states.

16. In case of the death of the owner of award weapon, the specified weapon is given to law-enforcement bodies.

17. The award weapon can be transferred for storage to the museums after the corresponding re-registration and alteration of military weapon by law-enforcement bodies.
