About approval of the Regulations on Public council under the National Bank of Ukraine
For the purpose of creation of conditions for realization by citizens of constitutional right on participation in administration of state affairs, the Board of the National Bank of Ukraine decides establishing effective interaction of the National Bank of Ukraine with the public for ensuring protection of the rights and consumer interests of banking services:
1. Approve Regulations on Public council under the National Bank of Ukraine which are applied.
2. Determine that the structure of Public council under the National Bank of Ukraine affirms the order of the National Bank of Ukraine.
3. Assign to Information directorate and public communications coordination of relations with Public council under the National Bank of Ukraine.
4. I reserve control over the implementation of this resolution.

1. The public council under the National Bank of Ukraine (further - Public council) is the permanent joint advisory advisory body formed for the purpose of establishing effective interaction of the National Bank of Ukraine (further - National Bank) with the public for ensuring banking system stability of protection of the rights and consumer interests of banking services and provision of suggestions for improvement of the legislation of Ukraine by Public council in this sphere.
In this Provision terms are used in such value:
banking services - the services provided according to the Law of Ukraine "About banks and banking activity";
institutes of civil society - the public associations legalized according to the legislation of Ukraine which are effective at least one year and which purpose of activities is, in particular, protection of consumer interests of banking services;
regulatory legal acts of the National Bank of Ukraine - regulatory legal acts which affirm the resolution of Board of National Bank within its powers on accomplishment of the Law of Ukraine "About banks and banking activity" and other laws of Ukraine;
consumers of banking services are the physical persons using services of bank for the personal needs which are directly not connected with business activity.
2. In the activities the Public council is guided by the Constitution of Ukraine, the laws of Ukraine, and also the presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, National Bank, this Provision and the Regulations under the National Bank of Ukraine (further - Regulations).
1. The main objectives of Public council are:
creation of conditions for realization by citizens of constitutional right on participation in administration of state affairs, establishing effective interaction of National Bank with the public, accounting of public opinion during the forming and realization of state policy in banking sector of Ukraine;
cooperation with National Bank in preparation and carrying out public discussions on questions of activities of banks, protection of the rights and consumer interests of banking services;
preparation of drafts of regulatory legal acts on regulation of activities of banks and protection of the rights and consumer interests of banking services;
development and provision of offers on implementation in practice of efficient mechanisms in the sphere of consumer protection of banking services;
consideration of problematic issues of bank system and in the sphere of consumer protection of banking services, provision of offers concerning ways of their decision;
assistance to carrying out dialogue between citizens and National Bank as banking supervisor authority.
2. Public council according to the main objectives assigned to it:
Prepares 1) and provides to National Bank of the offer on reforming of bank system, ensuring its stability, protection of the rights and consumer interests of banking services;
Collects 2), generalizes and provides to National Bank information on offers of institutes of civil society in the solution of the questions having important social significance will organize public actions for discussion of topical issues of bank system and protection of the rights and legitimate interests of consumers of banking services;
Prepares 3) and represents to National Bank of the offer on enhancement of bank system and protection of the rights and legitimate interests of consumers of banking services;
4) is informed surely by the public on the activities, the made decisions and their accomplishment on pages of Official Internet representative office of National Bank and other acceptable method, prepares and publishes the annual report on the activities;
5) will organize annual forums of the public at which reports on activities for accomplishment of plan targets.
3. The public council has the right:
1) to form standing and temporary working bodies (the secretariat, the commissions, expert and working groups, etc.);
To involve 2) Public council of employees of National Bank, representatives of the domestic and international expert and scientific organizations, the companies, organizations and the organizations (in the consent of their heads), and also certain specialists;
3) to organize and hold seminars, conferences, meetings of round tables and other communicative actions;
4) to receive drafts of regulatory legal acts of National Bank, to submit proposals on development of new drafts of regulatory legal acts and modification and amendments in acting which regulate legal relationship in the sphere of banking activity, including concerning protection of the rights and legitimate interests of consumers of banking services;
5) to interact with public authorities, local self-government, institutes of civil society, other public councils under executive bodies and local self-government, their structural divisions concerning protection of the rights and consumer interests of banking services, improvement of activities of bank system;
6) to send queries to National Bank;
7) in coordination of National Bank to direct representatives of Public council for participation in the actions (meetings, meetings of boards, etc.) held by National Bank;
8) to consider offers of institutes of civil society and the address of citizens on the questions which are within the competence of Public council to analyze and generalize them, to give on them oral and written answers;
To submit 9) in National Bank of the recommendation and proposal of Public council on the questions carried to its competence and at the scheduled time to receive the reply of National Bank;
10) to consider other questions having important social significance and are within the competence of National Bank.
