2. Enter to the order of the Government of the Republic of Kazakhstan of December 31, 2003 No. 1386 "About the National operator of mail of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2003, No. 50. Art. 575) following changes:

in Regulations on the National operator of mail of the Republic of Kazakhstan approved by the specified resolution:

Rules of assignment and withdrawal of powers of the assigned operator

1. General provisions

1. These rules of assignment and withdrawal of powers of the assigned operator (further - Rules) establish procedure for assignment and withdrawal of powers of the assigned operator, for the purpose of ensuring operation of postal services and accomplishment of the obligations relating to them following from acts of Universal Postal Union in all territory of the Republic of Kazakhstan.

2. In these rules the following basic concepts are used:

1) Universal Postal Union (further - VPS) - the international organization consisting of member countries which territories form the single mail territory for mutual exchange of the international mailings which purposes are providing the organization and enhancement of mail services and creation in this area of favorable conditions for development of international cooperation;

2) acts of Universal Postal Union - the documents accepted on the Congress of Universal Postal Union according to the Charter of Universal Postal Union;

3) authorized body in the field of mail service (further - authorized body) - the central executive body enabling within the competence the realization of state policy in the field of mail service, the state control, coordination and regulation of activities of operators of mail;

4) stationary department of mail service - production facility of the operator of mail in the form of the operational window (windows) placed in real estate object which is equipped and intended for provision of services of mail service to all users;

5) portable department of mail service - the production facility of the operator of mail created based on vehicles including under contracts with physical persons and legal entities which is equipped and intended for provision of services of mail service to all users;

6) the operator of mail - the physical person or legal entity having the right to provision of services in the field of mail activities;

7) the assigned operator - the operator of mail assigned by authorized body for ensuring operation of postal services and accomplishment of the obligations relating to them following from acts of Universal Postal Union in all territory of the Republic of Kazakhstan;

8) the place of the international mail exchange - production facility of the operator of mail in which processing of the incoming and outgoing international mailings is performed and also is made by customs authorities customs control of the specified departures.

2. Assignment of the assigned operator

3. The authorized body for the purpose of appointment of the operator of mail as the assigned operator performs order taking from operators of mail. Information on application process the operator of mail is placed on official Internet resource of authorized body.

4. Order taking from the operator of mail by authorized body is performed in the working days, except days off and holidays. The address and contacts of authorized body are placed on official Internet resource of authorized body.

5. The operator of mail submits to authorized body the request in the form established in appendix to these rules.

6. The operator of mail together with the request provides the following documents:

1) the copy of the certificate on the state (accounting) registration (re-registration) of the legal entity or the help about state registration (re-registration) of the legal entity or the copy of the help of the individual entrepreneur;

2) copy of the constituent document of the legal entity (charter or foundation agreement);

3) documents, confirmatory:

quantity and the location of stationary departments of mail service (in the settlements having the status of district value above), portable departments of mail service and mail carriers (in the notched Items having the status is lower than district value);

quantity and location of mailboxes in all settlements of the Republic of Kazakhstan;

availability of the mail routes used in case of provision of services of mail service in all settlements in the territory of the Republic of Kazakhstan for all users;
