About conditions of application of the concept "industrial assembly of motor vehicles" in the territories of state members of the Customs union and the Common economic space

For the purpose of forming of the conditions promoting creation and effective development in state members of the Customs union and the Common economic space of industrial assembly productions in automotive industry (further - car assembly productions), and having taken into consideration information of the Eurasian economic commission, the Supreme Eurasian economic council at the level of heads of states solved:

1. To state members of the Customs union and the Common economic space (further - state members) within 90 calendar days from the effective date this Decision to provide fixing in the legislation:

1) conditions of application of the concept "industrial assembly of motor vehicles" on the list according to appendix for car assembly productions when importing to single customs area of the Customs union of the goods classified by codes of the single Commodity nomenclature of foreign economic activity of the Customs union (further - FEACN CU) for "industrial assembly";

2) deadline of operation of agreements between authorized bodies of state members and legal entities of state members about industrial assembly of motor vehicles (further - agreements) - on December 31, 2020;

3) possibilities of use of the following measures for non-compliance with conditions of application of the concept "industrial assembly of motor vehicles":

for failure to carry out of terms of agreement - suspension of operation of the agreement before accomplishment of its requirements;

for inappropriate use of the goods imported on single customs area of the Customs union using the FEACN CU codes for "industrial assembly" - payment of difference in duties on the goods used not for designated purpose;

4) the provisions determining that the motor vehicles made in the territory of one state member as it is determined by the concept "industrial assembly of motor vehicles", freely address in the territories of other state members on condition of implementation of technological transactions on welding and coloring of body and achievement of level of localization of production of motor vehicles in the territories of state members at least 30 percent from the effective date of this Decision, and since July 1, 2018 - in case of achievement of level of localization of production of motor vehicles at least 50 percent;

the provisions determining that the motor vehicles made in the territory of the Republic of Belarus as it is determined by the concept "industrial assembly of motor vehicles", in case of the level of localization of production of motor vehicles less than 30 percent, freely address in the territory of the Russian Federation from the effective date this Decision till January 1, 2017 according to annually approved total quota for cars of no more than 10 thousand units a year, and since January 1, 2017 - in case of achievement of the conditions established by paragraph one of this subitem.

By agreement of the Republic of Belarus and the Russian Federation the quota can be reviewed towards increase.

2. To provide to the Republic of Belarus and the Republic of Kazakhstan the termination of the conclusion of new agreements in the relation:

motor vehicles of goods item 8703 FEACN CU - after entry into force of this Decision, except for multilateral agreements with the legal entities who signed agreements before entry into force of this Decision;

motor vehicles of goods items 8701, 8702, 8704 and 8705 FEACN CU - after 60 calendar days from the effective date this Decision.

3. To provide to the government of the Republic of Belarus, the Government of the Republic of Kazakhstan and the Government of the Russian Federation:

1) carrying out monitoring of accomplishment of conditions of application of the concept "industrial assembly of motor vehicles" for the car assembly productions in case of commodity importation classified by the FEACN CU codes for "industrial assembly";

2) submission annually to the Eurasian economic commission of information:

about results of the monitoring provided by the subitem of 1 this Item;

about the legal entities performing production of motor vehicles with observance of conditions of application of the concept "industrial assembly of motor vehicles" and about model range of such motor vehicles conforming to the requirements established by the subitem 4 of Item 1 of this Decision.

4. The Eurasian economic commission to claim within 90 calendar days from the effective date of this Decision procedure for forming and maintaining the register of the legal entities performing production of motor vehicles as it is determined by the concept "industrial assembly of motor vehicles", and their model range, that such persons and model range shall conform to the requirements established by the subitem 4 of Item 1 of this Decision and provide forming, maintaining and publishing of such register on the official site of the Commission on the Internet based on information provided according to the subitem 2 of Item 3 of this Decision.
