Rules and conditions of rendering paid services in the organizations of health care

1. General provisions

1. These rules and conditions of rendering paid services in the organizations of health care (further - Rules) are developed according to the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" and determine procedure and conditions of rendering paid services in the organizations of health care.

2. Paid medical services are rendered to physical persons, the being consumers of medical services (further - patients).

3. In these rules the following concepts are used:

the guaranteed amount of free medical care (further - GOBMP) - the amount of the medical care, single on the list of medical services, provided to citizens of the Republic of Kazakhstan and oralmans, determined by the Government of the Republic of Kazakhstan;

paid services - the services which are not entering the list of GOBMP and other services paid at the expense of own means of patients, means of the employer, system of voluntary medical insurance, other sources which are not forbidden by the legislation of the Republic of Kazakhstan;

paid departments (chambers) - departments (chamber) in the organizations of health care intended for rendering the medical services which are not entering the list of GOBMP on paid basis;

the organization of health care - the legal entity performing activities in the field of health care.

2. Procedure for rendering paid services

4. Types of paid services and the price list of the prices of them are brought to the attention of the population through evident information in the state and private medical organizations.

5. Maintaining accounting and reporting documentation when rendering paid services to citizens is performed in the forms established by authorized body.

6. To the patients who received medical care on paid basis, the organizations of health care provide:

the conclusion of the corresponding health workers when rendering the out-patient and polyclinic help;

the statement from the clinical record when rendering the stationary, hospital-replacing help, recovery treatment and medical rehabilitation;

expense information for the provided medical care.

7. Paid medical services are rendered based on the agreement according to appendix to these rules signed between the patient and the subject of health care providing these services.

8. The contract between the patient and the subject of health care consists before rendering paid service.

9. The state organizations of health care of the price of paid services are determined taking into account all cost types connected with rendering medical, services and other additional expenses and can be reviewed not more often than once a half-year.

The prices of paid services are established not below the rate of similar medical service established by the administrator of the budget programs for GOBMP.

10. The subject of health care bears responsibility for the allowed violation cases on rendering paid services (collection of payment from citizens for the services entering the guaranteed amount of free medical care, collection of double payment for rendering the same medical service from the patient and budgetary funds, rendering medical services of inadequate amount and quality).

3. Conditions of rendering paid services

11. Paid medical services are the state and private medical organizations in case of compliance of profile of disease and the license for occupation medical activities.

12. Rendering paid services by the organizations of health care is performed under following conditions:

rendering primary health care, diagnostic and medical services in initiative of patients, including without the direction of specialists of primary health care and the organizations of health care;

treatment by the medicines which are not included in the medicinal form;

carrying out the medical researches which are not entering the list of the guaranteed amount of free medical care;

sanatorium treatment without the corresponding direction;

medico-genetic researches without medical indications;

physical examination of citizens for revenues to work and study;

delivery of health care under the contract with the organization, including on voluntary insurance;

provision of additional services.
