1. Approve:

Regulations on the organization and functioning Organa of civil aviation according to appendix No. 1;

structure Organa of civil aviation according to appendix No. 2.

2. Establish extreme number Organa of civil aviation in number of 94 units.

3. Recognize invalid:

Regulations on the organization and functioning Organa of civil aviation

I. General provisions

1. Regulations on the organization and functioning Organa of civil aviation (further – the Provision) regulates mission, the main functions, obligations and common laws Organa of civil aviation (further – Body), and also procedure for its organization and functioning.

2. The body is administrative authority on certification, supervision and control in the field of civil aviation, has the status of the legal entity of the public law with the independent budget, performs activities on the basis of the principles of self-government and self-financing and submits to the Ministry of Economy and Infrastructure.

3. The office Organa is located at: MD 2026, Dacia Blvd., 80/2, mun. Chisinau, Republic of Moldova.

4. The body has seal with the State Emblem of the Republic of Moldova and the name in state language (full name – Autoritatea Aeronautica Civila, the abbreviated name – AAC) and in English (full name – Civil Aviation Authority, the abbreviated name – CAA), letterheads, own balance, settlement accounts, including currency, has financial and appliances.

4-1. Within Body Council for resolution of disputes according to part provisions is created (5) article 30 of the Law No. 131 of June 8, 2012 on the state control of business activity, structure and provisions about which activities affirm the director Organa.

5. In the activities the Body is guided by the Constitution of the Republic of Moldova, international conventions and agreements which party the Republic of Moldova is the laws of the Republic of Moldova, presidential decrees of the Republic of Moldova, ordinances, resolutions and orders of the Government, and also this Provision.

II. Mission, main functions, rights and obligations of body

6. The mission Organa of civil aviation consists in implementation of policy in the field of civil aviation and supervision of observance of the legislation by physical persons and legal entities in this area for safety of flights, aviation safety, consumer protection and safety of labor activity.

7. For the purpose of accomplishment of the mission the Body performs the following main functions:

1) submits to the Government by means of the Ministry of Economy and Infrastructure for approval according to competence drafts of regulations, the amount of payments for supervision implementation, and also, drafts of international agreements;

2) approves airways and rules of flight in airspace of the Republic of Moldova;

3) is conducted by the Aviation register of the Republic of Moldova;

4) monitors safety of flights of civil aircrafts and aviation safety by operators of aircrafts, operators of airfields (airports), suppliers of aeronautical services, other physical persons and legal entities performing activities in the field of civil aviation;

Accepts 5), within the powers, the solution of administrative nature, approves provisions, instructions and other acts of technical nature containing the standards and procedures obligatory for execution by the physical persons and legal entities performing activities in the field of civil aviation;

6) monitors observance of airworthiness standards by the operators and the companies performing repair and maintenance of the aircraft equipment in the territory of the Republic of Moldova;

Checks 7), issues, recognizes, suspends and withdraws certificates of the flight validity of civil aircrafts and other aircraft equipment.

8. For the purpose of performance of the mission and the assigned main Body functions performs the following main powers:

1) signs agreements on cooperation, about experience exchange and special information according to the current legislation;

2) determines prohibited areas and zones of restriction of flights in airspace of the Republic of Moldova;

3) is established together with the Ministry of Defence by procedure for coordination of flights of civil and military aircrafts in airspace of the Republic of Moldova;

4) is provided by implementation of activities for provision of aeronautical information;

5) is provided by collection from the physical persons and legal entities performing activities in the field of civil aviation, the statistical and other data necessary for the analysis of activities in the field, assessment and submission of these data to state bodies of statistics and the international organizations in the field;

6) coordinates actions for search and rescuing in case of aviation incidents in the territory of the Republic of Moldova;

7) registers civil airfields (airports), issues the conclusions on construction and reconstruction of civil airfields (airports), and also construction works in zones of civil airfields (airports);
