About licensing of business activity on management of apartment houses

1. Approve enclosed:

Regulations on licensing of business activity on management of apartment houses and about implementation of regional state licensed control of implementation of business activity on management of apartment houses;

Regulations on maintaining the register of persons performing functions of sole executive body of the licensee which license is cancelled and also persons on whom the charter or other documents of the licensee confer responsibility for observance of requirements to ensuring proper maintenance of common property in the apartment house and to which administrative punishment in the form of disqualification, individual entrepreneurs whose license is cancelled and (or) to which administrative punishment in the form of disqualification is applied (further - Regulations on maintaining the register of the disqualified persons of management companies) is applied;

Regulations on control of observance of the subjects of the Russian Federation by executive bodies exercising regional state housing supervision, requirements of the Housing code of the Russian Federation and the Federal Law "About Licensing of Separate Types of Activity" to licensing of business activity on management of apartment houses (further - Regulations on control of observance of requirements to licensing of activities for management of apartment houses).

2. Determine that on application of the Regulations on licensing of business activity on management of apartment houses, Regulations on maintaining the register of the disqualified persons of management companies and Regulations on control of observance of the requirements to licensing of activities for management of apartment houses approved by this resolution the Ministry of Construction and Housing and Communal Services of the Russian Federation gives explanations.

3. Realization of the powers provided by Regulations on licensing of business activity on management of apartment houses, Regulations on maintaining the register of the disqualified persons of management companies and Regulations on control of observance of requirements to licensing of activities for management of the apartment houses approved by this resolution is performed by the Ministry of Construction and Housing and Communal Services of the Russian Federation within the number of employees of the Ministry and budgetary appropriations provided to the Ministry in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

4. To the Ministry of Construction and Housing and Communal Services of the Russian Federation to approve:

methodical recommendations about development of administrative regulations of provision of the state service in licensing of business activity about management of apartment houses, including approximate document forms, used when licensing business activity on management of apartment houses;

methodical recommendations about development of administrative regulations of execution of the state function about licensed control of the state housing supervision of the subject of the Russian Federation by body.

5. Recommend to public authorities of subjects of the Russian Federation:

in 2-month time from the date of approval of methodical recommendations, the specified in paragraphs four and the fifth item 4 of this resolution to approve administrative regulations on provision of the state service in licensing of business activity on management of apartment houses and administrative regulations of execution of the state function on licensed control of the state housing supervision of the subject of the Russian Federation by body;

no later than January 1, 2015 to provide possibility of giving and receipt of documents concerning licensing according to the Federal Law "About Licensing of Separate Types of Activity" in the form of the electronic documents signed by the digital signature with use of information and telecommunication networks public, including the federal state information system "Single Portal of the State and Municipal Services (Functions)".

6. This resolution is effective till March 1, 2028.

3. Licensed requirements to the licensee in addition to the requirements provided by Items 1 - 6.1 parts 1 of article 193 of the Housing code of the Russian Federation, are the following requirements:

a) observance of the requirements provided by part 2.3 of article 161 of the Housing code of the Russian Federation;
