About creation, functioning and development of the integrated information system of foreign and mutual trade of the Customs union

The governments of state members of the Customs union within Eurasian economic community which are hereinafter referred to as with the Parties

based on the Constitutive treaty of Eurasian economic community of October 10, 2000, the Agreement on the Commission of the Customs union of October 6, 2007 and the Agreement on the Secretariat of the Commission of the Customs union of December 12, 2008,

based on the Agreement on creation of single customs area and forming of the Customs union of October 6, 2007,

for the purpose of creating favorable conditions to subjects of managing of the states of the Parties, ensuring effective regulation of foreign and mutual trade on single customs area of the Customs union, implementation customs, tax, transport and other types of the state control with use of information and telecommunication technologies, ensuring processes of economic integration, the organization of effective work of Interstate Council of Eurasian economic community (The Supreme body of the Customs union) and the Commission of the Customs union,

realizing that for achievement of these purposes broad use of information technologies when forming and functioning the Customs union is determining,

agreed as follows:

Article 1

The parties create and provide functioning, and also development of the integrated information system of foreign and mutual trade of the Customs union (further - System).

Article 2

This agreement determines bases of creation, functioning and development of System, power of the Commission of the Customs union (further - the Commission), the Secretariat of the Commission (further - the Secretariat) and the Parties by creation of System, sources and procedure for financing, procedure for the choice of contractors (suppliers) for goods (works, services).

Article 3

In this agreement the following terms and their determinations are applied:

"the database about foreign and mutual trade" - set of the structured and interconnected information organized by certain rules and systematized so that this information could be found and processed by means of the electronic computer (database);

"information security" - complex of the legal, organizational and technical measures aimed at providing integrity (invariance), confidentiality, availability and safety of information;

"information" - data (messages, data) irrespective of form of their representation;

"information system" - set of information containing in databases and information technologies and technical means providing its processing;

"information technologies" - processes, methods of search, collection, storage, processing, provision and distribution of information, and also methods of implementation of such processes and methods;

"information resource" - the organized set of documentary information containing in information systems;

"integration segment" - the information system providing information exchange of information resources and information systems of state bodies of the states of the Parties regulating foreign and mutual trade, information systems and information resources of the Commission.

Article 4

The system is organizational set of the geographically distributed state information resources and information systems of the state bodies regulating foreign and mutual trade of the states of the Parties, information systems and information resources of the Commission, combined by the state integration segments of the states of the Parties and integration segment of the Commission.

Article 5

The commission performs the rights and performs duties of the owner concerning such components of System as integration segment of the Commission, information systems and information resources of the Commission.

Article 6

The secretariat coordinates creation, ensuring functioning and development of System according to the documents approved by the Commission.

The secretariat performs the rights and performs duties of the customer of goods (works, services) during creation of the components of System specified in Article 5 of this agreement according to the legislation of the state of stay of the Secretariat regulating questions of implementation of orders (purchases) of goods (works, services) for the state needs.

Article 7

For ensuring unification of the applied organizational and technical solutions during creation, development and functioning of integration segments of System, maintenance of proper level of information security the Secretariat coordinates project development of the technical and organizational documents approved by the Commission.

Article 8

Each of the Parties determines the operator of the state integration segment which performs the rights and performs duties on its creation, ensuring functioning and development.

Article 9

The secretariat will organize designing, development, implementation, acceptance of results of works and further maintenance of the components of System specified in Article 5 of this agreement according to the documents specified in Article 7 of this agreement, and on the questions which are not settled by the specified documents - according to the legislation of the state of stay of the Secretariat.

The specification on system development is approved by the Parties.

Article 10

Concerning the components of System specified in Article 5 of this agreement, assessment of the competitive proposals submitted during the implementing of orders (purchases) of goods (works, services) and acquisition of rights of property rights, and also acceptance of results of works on designing and development of these components are performed by working bodies which structure affirms the decision of the Commission on representation of the Secretariat.

Article 11

Works on creation and development of System are performed based on the annual plans developed by the Secretariat and approved by the decision of the Commission.
