Agreement on the status of Bases of the legislation of Eurasian economic community, procedure for their development, acceptance and realization

The state members of Eurasian economic community which are hereinafter referred to as with the Parties

being guided by the Constitutive treaty of Eurasian economic community of October 10, 2000 and the Agreement on legal support of forming of the Customs union and the Common economic space of October 26, 1999,

aiming to pursue the approved legal policy providing effective integration interaction within Eurasian economic community (further - EurAsEC),

recognizing need of development of the unified procedure for regulation of legal relationship within EurAsEC,

agreed as follows:

Article 1. Regulation subject

Define by this Agreement of the Party the status of Bases of the legislation of Eurasian economic community (daleeosnova of the legislation of EurAsEC), establish the unified procedure for their development, consideration, acceptance, change, suspension and cancellation.

Bases of the legislation of EurAsEC are understood as legal acts of EurAsEC which establish regulations of legal regulation, single for the Parties, in basic spheres of legal relationship and which are adopted by the conclusion by the Parties of the relevant agreements (daleesoglasheniye about acceptance of Bases of the legislation of EurAsEC).

Article 2. Principles of development of Bases of the legislation of EurAsEC

In case of development of Bases of the legislation of EurAsEC the following principles shall be observed:

a) compliance of Bases of the legislation of EurAsEC to the conventional principles and rules of international law;

b) comprehensive study of legal, social and economic and other effects of action of Bases of the legislation of EurAsEC.

Article 3. Development, consideration, acceptance, change, suspension and cancellation of Bases of the legislation of EurAsEC

Development, consideration, acceptance, change, suspension and cancellation of Bases of the legislation of EurAsEC are performed according to the enclosed Procedure for development, consideration, acceptance, change, suspension and cancellation of Bases of the legislation of EurAsEC which is integral part of this Agreement.

Article 4. Procedure for entry into force of agreements on acceptance of Bases of the legislation of EurAsEC

Agreements on acceptance of Bases of the legislation of EurAsEC become effective from the date of delivery to depositary of the last written notice of accomplishment of the interstate procedures by the Parties necessary for their entry into force.

Article 5. Control of realization of Bases of the legislation of EurAsEC

State bodies of the Parties within the competence exercise control of realization of Bases of the legislation of EurAsEC by conducting legal examination of projects of legislative and other regulatory legal acts for the purpose of check of their compliance to Bases of the legislation of EurAsEC and representation of the relevant information to parliaments and governments of the Parties.

The secretariat of Integration Committee of EurAsEC informs Interstate Council of EurAsEC, Inter-parliamentary Assembly of EurAsEC and Integration Committee of EurAsEC on realization of Bases of the legislation of EurAsEC.

Article 6. Information exchange

The parties, using national information resource, perform exchange of information about realization of Bases of the legislation of EurAsEC through the Secretariat of Integration Committee of EurAsEC and the Secretariat of Bureau of Inter-parliamentary Assembly of EurAsEC.

Article 7. Entry into force

This Agreement is subject to ratification and becomes effective from the date of delivery of the last ratification letter to depositary.

Article 8. Accession

This Agreement is open for accession to it of any state which entered EurAsEC. The document on accession to this agreement is checked to depositary.

For the joined state this Agreement becomes effective from the date of delivery to depositary of the document on accession.

Article 9. Ratio with other international treaties

This Agreement does not affect the rights and obligations of the Parties following from other international treaties which participants they are.

Article 10. Modification

Changes are made to this Agreement by mutual consent of the Parties and drawn up by protocols which will be integral parts of this Agreement and to become effective according to the procedure, stipulated in Article the 7th this Agreement.

Article 11. Dispute resolution

In case of disputes between the Parties on interpretation and/or application of this Agreement they will be permitted by negotiations or consultations between the Parties.

Article 12. Effective period

This Agreement is signed sine die. Each of the Parties has the right to withdraw from this Agreement by the written notice of it of depositary at least in twelve months, previously having settled the obligations within EurAsEC.

It is made in the city of Astana on June 18, 2004 in one authentic copy in Russian.

The authentic copy is stored in Integration Committee of EurAsEC which will send to each Party its verified copy.
