About measures of state regulation of consumption and the address of the substances destroying ozone layer

For the purpose of implementation of articles 54 and 69.1 of the Federal law "About Environmental Protection" Government of the Russian Federation decides:

1. Approve enclosed:

the list of the substances destroying ozone layer which address is subject to state regulation;

changes which are made to acts of the Government of the Russian Federation.

2. Determine that:

a) consumption of the substances destroying ozone layer which address is subject to state regulation (further - ozone-depleting substances), in the Russian Federation, except for the ozone-depleting substances specified in group I of the list C of the list approved by this resolution is performed in the amounts defined by international treaties of the Russian Federation;

b) the admissible amount of consumption of the ozone-depleting substances in the Russian Federation specified in group I of the list C of the list approved by this resolution, "i" of the Item "an" of Article 3 of the Montreal protocol determined according to the subitem on the substances destroying ozone layer of September 16, 1987 shall not exceed in 2014 999,2 of ton of ozone-depleting capability, in 2015 - 2019 399,69 of ton of ozone-depleting capability annually, in 2020 - 2029 19,98 of ton of ozone-depleting capability annually;

c) since 2030 consumption of the ozone-depleting substances specified in group I of the list C of the list approved by this resolution is performed in the amounts defined by international treaties of the Russian Federation;

d) since January 1, 2015 calculation of amount of specific ozone-depleting substances in the admissible amount of consumption of ozone-depleting substances in the Russian Federation established according to the subitem "b" of this Item is performed annually by the Ministry of Natural Resources and Environmental Protection of the Russian Federation taking into account amount of the ozone-depleting substances made in the Russian Federation and imported into the Russian Federation;

e) since January 1, 2015 the admissible production volume of ozone-depleting substances in the Russian Federation is established annually taking into account admissible amount of their consumption in the Russian Federation;

e) production of the ozone-depleting substances specified in groups I and III of the list C and in the list E of the list approved by this resolution is performed in case of their use only as raw materials for production of other chemicals, and also in the cases provided by international treaties of the Russian Federation in admissible production volume of ozone-depleting substances in the Russian Federation;

g) import to the Russian Federation of ozone-depleting substances is performed taking into account the established admissible amounts of their production and consumption in the Russian Federation and the quantitative restrictions which are annually established according to the legislation of the Customs union, except as specified, when these substances are imported into the Russian Federation for providing main types of use of the ozone-depleting substances determined according to international treaties of the Russian Federation;

h) since July 1, 2014 designing of the objects of economic and other activity performing production of ozone-depleting substances and products containing them is forbidden;

i) since January 1, 2015 it is forbidden construction of facilities of the economic and other activity, performing production of ozone-depleting substances and containing them products;

j) since January 1, 2015 the address of ozone-depleting substances is allowed only in reuse container, except for addresses of ozone-depleting substances in container by the amount less than 3 liters for laboratory and analytical types of use defined by international treaties of the Russian Federation.

3. Determine that the Ministry of Natural Resources and Environmental Protection of the Russian Federation performs:

a) yearly settlement of admissible production volume of ozone-depleting substances in the Russian Federation;

b) yearly settlement of amount of specific ozone-depleting substances in admissible amount of consumption of ozone-depleting substances in the Russian Federation taking into account information on the needs for ozone-depleting substances which arrived from the legal entities, individual entrepreneurs performing and planning to perform use of ozone-depleting substances which production in the territory of the Russian Federation is absent;

c) state accounting of the address of ozone-depleting substances.

4. To the Ministry of Natural Resources and Environmental Protection of the Russian Federation:

a) develop and approve in 6-month time in coordination with the Ministry of Industry and Trade of the Russian Federation, the Ministry of Economic Development of the Russian Federation and Federal Antimonopoly Service procedure for yearly settlement of admissible production volume of ozone-depleting substances in the Russian Federation and yearly settlement of amount of specific ozone-depleting substances in admissible amount of consumption of ozone-depleting substances in the Russian Federation;

b) bring annually, since 2014, no later than November 1, in the Government of the Russian Federation in accordance with the established procedure approved with the federal executive bodies specified in the subitem "an" of this Item, the draft of the act establishing amount of specific ozone-depleting substances in the admissible amount of consumption of ozone-depleting substances in the Russian Federation the next calendar year calculated according to the subitem "g" of Item 2 of this resolution and admissible production volume of ozone-depleting substances in the Russian Federation the next calendar year.
