About approval of Rules of calculation and confirmation of insurance years of service for establishment of insurance pensions

1. Approve the enclosed Rules of calculation and confirmation of insurance years of service for establishment of insurance pensions.

2. To make to the Ministry of Labour and Social Protection of the Russian Federation in coordination with Fund of pension and social insurance of the Russian Federation explanations about procedure for application of the Rules approved by this resolution.

Rules of calculation and confirmation of insurance years of service for establishment of insurance pensions

I. General provisions

1. These rules determine procedure for calculation and confirmation of insurance years of service for establishment of insurance pensions.

2. Join in insurance years of service (are set off):

a) the periods of work and (or) other activities which were carried out in the territory of the Russian Federation by persons insured according to the Federal Law "About Mandatory Pension Insurance in the Russian Federation" (further - insured persons) provided that for these periods insurance premiums were assessed or paid to Fund of pension and social insurance of the Russian Federation (further - insurance premiums);

b) the periods of work and (or) other activities which were carried out by insured persons outside the Russian Federation, in cases, stipulated by the legislation the Russian Federation or international treaties of the Russian Federation, or in case of payment of insurance premiums according to the Federal Law "About Mandatory Pension Insurance in the Russian Federation";

(1)) the periods of payment of insurance premiums by the physical persons who voluntarily entered legal relationship on mandatory pension insurance for the purpose of payment of insurance premiums for other physical person for which payment of insurance premiums by the insurer according to the Federal Law "About Mandatory Pension Insurance in the Russian Federation" and the legislation of the Russian Federation on taxes and fees is not performed;

(2)) the payment periods pro se insurance premiums in Fund of pension and social insurance of the Russian Federation by the physical persons who voluntarily entered legal relationship on mandatory pension insurance, constantly or temporarily living in the territory of the Russian Federation to whom mandatory pension insurance, according to the Federal Law "About Mandatory Pension Insurance in the Russian Federation" does not extend;

(3)) the payment periods pro se insurance premiums in Fund of pension and social insurance of the Russian Federation by the physical persons who voluntarily entered legal relationship on mandatory pension insurance, constantly or temporarily living in the territory of the Russian Federation, applying special tax regime "Tax on the professional income";

(4)) the payment periods pro se insurance premiums in Fund of pension and social insurance of the Russian Federation by the physical persons who voluntarily entered legal relationship on mandatory pension insurance from among individual entrepreneurs, lawyers, arbitration managers, notaries who are engaged in private practice and the other persons who are engaged in private practice and not being individual entrepreneurs, being receivers of long-service pension or disability pension according to the Law of the Russian Federation "About provision of pensions of persons passing military service, service in law-enforcement bodies, the Public fire service, drug trafficking monitoring bodies and psychotropic substances, organizations and bodies of criminal executive system, troops of national guard of the Russian Federation, bodies of forced execution of the Russian Federation, and their families";

c) other periods:

the period of passing of military service, and also other service equated to it provided by the Law of the Russian Federation "About provision of pensions of persons passing military service, service in law-enforcement bodies, the Public fire service, drug trafficking monitoring bodies and psychotropic substances, organizations and bodies of criminal executive system, troops of national guard of the Russian Federation, bodies of forced execution of the Russian Federation, and their families";

the period of receipt of benefit on compulsory social insurance in the period of temporary disability;

the period of care of one of parents of each child before achievement of age by it one and a half years, but no more than 6 years in total;

the period of receipt of unemployment benefit, the period of participation in paid social jobs and the period of moving or resettlement in the direction of public service of employment to other area for employment;

the period of detention of persons who are unreasonably brought to trial, unreasonably repressed and subsequently rehabilitated, and the period of serving by these persons of punishment in places of detention and in the reference;

the period of the leaving performed by able-bodied person for the disabled person of the I group, the handicapped child or behind person which reached age of 80 years;

the period of accommodation of spouses of the military personnel passing military service under the contract together with spouses in areas where they could not work due to the lack of employment opportunity, but no more than 5 years in total;
